As part of the plat approval, a I portion of Lot 6 was within the Lake Lucy Road right-of-way. Lake Lucy Road was realigned to the south as part of Lake Lucy Highlands subdivision and was intended to be vacated where it previously Iexisted adjacent to Whitetail Ridge and Pheasant Hill. The applicant is requesting vacation of the portion of Lake Lucy Road that is a part of Lot 6 Whitetail Ridge. It is no longer I necessary to maintain this area as a public street right-of-way since Lake Lucy has been realigned to the south. The Engineering Department is requesting a 20 ft. permanent utility easement to go I over a sanitary sewer line as shown in Attachment #2. In addition, the Park and Recreation Department is reviewing whether or not a trail easement should be maintained within the right-of-way for 1 future trail development. Staff has not yet received comments back from the Park Department or Park and Recreation Commission. Approval of the vacation would be conditioned upon final review by the Park and Recreation Commission. 1 RECOMMENDATION I The proposed vacation is consistent with what was reviewed at time of the Whitetail Ridge subdivision. As long as the proper drainage, utility and trail easements are retained, staff has no I objection to vacating the remaining portion of Lake Lucy Road as part of Lot 6, Whitetail Ridge. Staff recommends that the City Council adopt the following motion: I "The City _Council recommends approval of Vacation No. 89-10 for that portion of Lake Lucy Road within Lot 6, Whitetail Ridge with'the following conditions: II II L 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 11 1. II City Council Meeting - May 18, 1987 Jeremy Jenson: It will be built strong enough for bicycle traffic to go across. Mayor Hamilton: I'm not concerned about them going across. I don't want them going across. They should be deterred from going across there I would think. Bicycles shouldn't be allowed on that path. Mike Lynch: You've got a steep hill which is the only south access to that bridge where Steve is putting in his steps in now and that will be an extremely difficult access for a bicycle. A real determined bicycler could get through there but not normal. Mayor Hamilton: How about in the wintertime? Do you see any problem in the wintertime with any type of all terrain vehicle or snowmobile or something? Mike Lynch: Not that we wouldn't have otherwise. In the winter there was a snowmobile and all terrain that could use •the bridge, or use the lake or they could drive through the stream bed but it certainly improve access for them though. Councilman Johnson: As far as the steps, it also makes it harder on the handicapped access. Unless we put down a path next to the steps for the handicapped access. One of the biggest group that goes through there is kids on bicycles. Councilman Geving moved, Councilman Horn seconded to approve the Eagle Scout Project at the Chanhassen Park Pond and to amend the budget to include the $1,000.00 for this project. All voted in favor and motion carried. CONSENT AGENDA: FINAL PLAT APPROVAL, WHITETAIL RIDGE. Councilman Johnson: My problem was we have a final plat for approval. ' However, part of our approval is to submit a new final plat. It's kind of a circular approval. Item number 3 is to submit a revised final plat. If it's not ready to be approved, I don't want to approve it. Why can't the changes be made. If the applicant knows he has to move a lot line, let's go ahead and move the lot line. Barbara Dacy: It was at the request of the applicant. He came in the office late on Thursday afternoon and said I have been working on building plans and I want to shift over the lot line by 3 or 4 feet. Jo Ann had already finished that report and it was such a minor change that we listed a condition that we get the right line. Councilman Johnson: He didn't put the drainage easement in also so he has to submit the drainage easement or is that another issue that doesn't show? Gary Warren: That shows. Councilman Johnson: I think it's pretty standard to have to submit financial securities. Basically, I see we have an incomplete, if he wants to change the 28 0- I II &17L IICity Council Meeting - May 18, 1987 ' plat at the 11th hour, then he can wait two weeks and submit us the proper paperwork and we can consider this on June 1st. ' Barbara Dacy: I assume the responsibilities. If you want to table it that's fine. He came and spoke with me and I said yes, we can process the application with the change so I should accept responsibility. Mayor .Hamilton moved, Councilman Horn seconded approval of the final plat for Whitetail Ridge dated May 7, 1987 with the understanding that the revised ' final plat, the lot line be shifted no more than 4 feet and with the following conditions: ' 1. Submittal of a :drainage easement over Lot 6. 2. Submittal of financial securities and approved development contract. ' 3. Submittal of a revised final plat. All voted in favor except Councilman Johnson who opposed and motion carried. CONSENT AGENDA: APPROVAL OF PLANS AND SPECIFICATIONS FOR 1987 STREET SEALCOATING PROJECT. Councilman Geving: Just a quick comment. I think we're into about the third or fourth year of the sealcoating project and as I look at what we are attempting to do this particular year, I refer you to page 1 of 2 in the very back of the sealcoating spec and bid proposal. I see now we're working on the • north end of Chanhassen and I would like to make a proposed change to the specs to add the area of Lyndon just to the north. The whole area there where we have Lyndon Circle, Kirkwood Circle, Joslin Circle and the reason I'm asking that we add it, it would complete that one whole area of the north end of Chanhassen all in one shot. That's quite a large area but I think rather ' than come back and pick it up next year or the year after, we can add it to our specs and I wanted to ask Gary if we were either to add it to the specs or to trade off that Pipewood Curve area across TH 7, what are your thoughts on ' that Gary? Gary Warren: I asked the street superintendent to give me a list of streets here and I'm not personally familiar with the condition of the streets in the Lyndon Circle area. Mayor Hamilton: They're good. Councilman Geving: They're about the same age as all the rest of them. Probably newer. In fact they are very new. They're within five years. Gary Warren: I would think that we're not adding that much footage to it. I can look at that. Councilman Geving: Would you look at_ it as a potential and came back to us. I know they're new. City Planner DATE: May 12 , 1987 , SUBJ: Final Plat Whitetail Ridge ' The Whitetail Ridge Subdivision was approved by the Planning ' Commission on February 11, 1987 and by the City Council on March 2 , 1987 . A condition of approval was that a drainage easement be provided over Lot 6 to accommodate overland flow from Waldrip' s pond. The drainage easement has not yet been provided and must be submitted as part of the final plat approval. The applicant must also submit the required financial securities and , enter into a development contract with the city. The applicant has indicated that the easterly lot line of Lot 5 shall be shifted 4 feet to the east to accommodate a house pad. The lot line adjustment will not impact the lot area and staff approves of the adjustment. A revised final plat must be sub- mitted. A portion of Lot 6 is within the Lake Lucy Road right-of- way. Removal of this portion of Lake Lucy Road was approved by the city during preliminary plat review and will be formally vacated by the city in the near future. ' RECOMMENDATION Staff recommends approval of Whitetail Ridge final plat dated May ' 7 , 1987, with the following conditions: 1 . Submittal of drainage easement over Lot 6. ' 2 . Back in 1986 and 1987 I worked with Bill Munk, city engineer and Barb Dacey , city planner regarding the future plans to reroute Lake Lucy Road to the southwest. It was determined at that time that old Lake Lucy Road would no longer be needed. The understanding was that the cite would move to vacate this portion to bring this unused land back onto the tax rolls . My numerous calls to staff to begin the pr'ceedings has brought little ac- tion. I know the rapid growth of Chanhassen has severely taxed ' the staffs ability to handle these less pressing concerns . The loss of taxes over the past years is most likely in $1 ,000 .00 's of dollars . At this time I feel it is my civic duty to start the ' process . With that in mind, I respectfully request similar cost reimbursement once the action to vacate the balance of Old Lake Lucy Road is commenced by the city. It would make sense that the list. of certified names I have paid for would be usable for your ' purposes also. From my discussions with the neighbors abutting this portion of road they will take no action. At this time they feel it perfectly acceptable to use this land, changing and ,im- proving it without paying for it . This seems quite unfair considering the city ' s need to balance increased costs . Plus the constant need to provide parks for these new neighborhoods will cause even greater financial needs in the future. Acquiring the park to the SE of Pheasant Hills would be a great compliment to the area .
