Dear Mr. Melchert:
Gary Warren from the City of Chanhassen has advised me that the
Pollution Control Agency is now requiring six inches of black dirt to
be dispersed about the NordicTrack site as a precondition to the
spreading of the contaminated soil. Because clean up will now involve
the hauling of materials to the NordicTrack site, the City now would
like to remove the contaminated soil completely from said site. To
that end, I request that your client issue a letter to the City of
Chanhassen to the attention of Mr. Gary Warren wherein your client
authorizes the City to come out to the NordicTrack property to remove
the contaminated soil. For your information, the City has yet to
receive any written authorization from NordicTrack with respect to
the clean up.
I would, at this point, recommend that we set a specific closing
date for this transaction. If your schedule permits, let us
tentatively plan to close this transaction on Wednesday, June 20,
1990, at 9 : 00 a .m. at the City of Chanhassen. At such time the City
will deliver a warranty deed to your client and the balance of the
purchase price can be adjusted and paid to the City.
I assume that you will contact me upon receipt of this letter to
discuss particulars .

The Board of Managers of the Riley-Purgatory-Bluff Creek
Watershed District discussed the Council's staff report submitted to
the Environmental Committee on February 7, 1990. The comments of
your staff regarding the District's 509 Plan are not reflective of
information submitted to the Council by the Watershed District.
The Managers have been seeking approval of their 509 Plan for
over a year and we are wating for action by the State Board of Water
and Soil Resources and the Minnesota Department of Natural
Resources. These agencies are aware of your comments regarding the
District's 509 Plan which were similar to those made on the Nine
- Mile Creek Watershed District 509 Plan. The Managers received a
copy of the letter by the Chairman of the Nine Mile District and
agree with many of the observations of the Nine Mile Managers. The
cost of 509 Plan preparation and approval and the fact that State
Agencies resolve the differences with Met Council conclusions lead
to the decision to expedite the hearings by the State agencies.
•
The Riley-Purgatory-Bluff Creek Managers have ;worked to
improve stream and lake water quality. We recently contracted to
complete a project for control of non-point source pollution. The
District undertook this pilot non-point source cooperative project
with the Minnesota Pollution Control Agency and U.S. Environmental
Protection Agency in order to develop a model program for reduction
of nutrient levels and thereby improve of the water quality of the

fill, alter, and/or disturb more than one acre of land in surface
area. The District reviews approximately 80 projects each year.
Each site is inspected to ensure compliance with the conditions of
the Districts' permit.
Be assured of our desire to cooperate with and communicate

Council to discuss our procedure.

Your application dated May 22, 1990, for treatment of 400 cubic yards of
petroleum contaminated soil from the above site is hereby approved by staff of
the Minnesota Pollution Control Agency (MPCA) subject to the following conditions.
1. Soils will be treated by C.S. McCrossan. Air Quality Permit No. 785-A-86-0T-1.
2. Protection from run-on, infiltration and run-off shall be provided for
contaminated soils stored prior to treatment.
3. Soil treatment will be completed by June 30, 1990.
4. MPCA staff must be notified of the proposed date of the soil treatment prior
to the actual treatment date. Please notify both the MPCA Regional
• Specialist, if appropriate, and Bob Dullinger of the proposed treatment date.
5. Treated soils shall be incorporated into asphalt.
Within 30 days of soil treatment, MPCA staff shall be provided with a site
summary including the MPCA Site ID number, date soil treatment was completed,
the volume of contaminated soil processed, post-burn analyses, and final
disposition of the processed soil.
Failure to comply with the conditions of this approval may result in enforcement
actions against either the generator of the contaminated soil or the facility
operators or both. This approval is based on the MPCA staff's understanding
that up to 4,000 cubic yards of contaminated soil is needed to conduct a test
burn and that the contaminated soil referenced above will be used for that
purpose only.

On Friday May 18, 1990 the second annual Public Safety Days
was held at the Minneapolis Convention Center. There were very
many displays from various law enforcement and public safety
agencies throughout the area. Chanhassen Public Safety had a
booth displaying crime prevention and building inspection
information.
Deputy Rod Peddycoart assisted `£SOs Deb Rand and Bob Zydowsky
in operating this booth during the function. His enthusiasum was
not overlooked and he looked very sharp and presented himself well
to the public. It was a pleasure to see Carver County represented
by both Chanhassen Public Safety and the Carver County Sheriff ' s
Department .
Please extend by sincere appreciation to Deputy Rod Peddycoart
for his time and efforts to help make this function a resounding
success. In addition, I want to thank you and your department
for making the resources available to us to provide for a
successful second annual Public Safety Days at the Minneapolis

Recently I completed a traffic accident study for the City of
Chanhassen. During the time that I worked on the study I received
assistance from Bob Zydowsky, one of your Community Service Officers.
I wish to commend Bob for his eagerness to help and his encouragement.
Much of what Bob did dealt with tedious statistical research. He
dutifully stuck to the task. His work was detailed and accurate.
I commend Bob not only on his approach to this study but on his
constant optomistic outlook. He exudes positive ambitious energy not
only when working on the traffic study but in his general duties and
contact with the Sheriff's Deputies. The can do approach that Bob
takes in his work is refreshing to work with.

As promised, please find attached the staff report and permit -
relating to the disposal of contaminated soils which are
currently stored on the Hanus property. As you are aware, the
revised Excavating, Mining, Filling .,and Grading Permit (Ordinance
No. 128) allows staff to administratively approve permits
involving less than 1 ,000 cubic yards of material. Staff is
cooperating to expedite the proper disposal of this material. As
stated in the attached staff report, we have summarized our
conditions for approval which are to be met by the applicant. If
these conditions are met, we -anticipate issuing a permit for
disposal of this material on Wednesday, May 30, 1990.

Staff is comfortable with the applicant's proposal and will
obtain security as noted to insure the applicant's compliance.
Staff had promised that on this particular item Council would be
made aware prior to issuance of the permit. If there are any

SUBJ: Request For Grading Permit - Sever Peterson
Grading Permit File 90-4
The City has received a request for a grading permit from Mr.
Sever Peterson, resident at 1600 Pioneer Trail. Mr. Peterson is
proposing to "land apply" and farm approximately 800 cubic yards
of contaminated soils. These soils are contaminated with gaso-
line from leaky storage tanks that were recently excavated from
9245 Lake Riley Boulevard (Rudy Remus property) . The con-
taminated soils have been temporary stock piled on the Hanus pro-
perty until an exceptable disposal site has been found.
•
The applicant is proposing to spread the contaminated soils in
a four inch layer over approximately 1.8 acres of farm land
immediately north of the applicant's house. The terrain is
generally farm land with seven to eight percent slopes. The site
drains easterly into a ditch which emptys Onto a lowland and
proceeds into Bluff Creek. Site As approximately 600 feet from
the lowlands and 1000 ,feet; #rom Bluff ,Creek..,. Due to the slopes in
proximity of the ditch which eventually emptys into Sluff Creek,
it is recommended that the proposed site be relocated 'westerly
away from the ditch5tsee Attachment #1) . This „wf31 allow the
drainage to "sheet" drain in A few ,directions -versus con-
centrating towards the drainagelikch which would require
erosion control. t' I'
According to Ms. Janet Berryhill of the Pollution Control Agency
(PCA) , the soils in this area are favorable to such an applica-
tion. The applicant will be required to periodically (monthly)
turn the soils to assist in evaporating the contaminents from the
soil. The process takes approximately two to three months for
gasoline to evaporate and return the soils to an acceptable
level.

Recommended Conditions
1. The applicant shall relocate the disposal area further west
away from the ditch.
2. The applicant shall apply and comply with all conditions set
forth by the Minnesota Pollution Control Agency for said soil
rehabilitation process.
3. The applicant shall provide security in the amount of $5,000
to ensure proper testing and handling of said soils.
4. The applicant shall pay grading permit fees per the Uniform
Building• Code (UBC) .
5. The applicant shall stake off the area until contaminents are
disbursed.
6. The City shall receive, in writing, confirmation from the PCA
and or testing firm when soils have been stabilized.
7. The applicant shall produce copy a of the PCA permit before
moving soils.
8. No planting will be allowed until the soils have reached an
acceptable level (per PCA) .

GRADING PERMIT
• PERMIT dated , 1990, issued by the CITY
OF CHANHASSEN, a Minnesota municipal corporation ("City") , to
Sever Peterson, (the "Developer") .
1. Request for Plat Approval. The Developer has asked
the City to approve a grading permit in conjunction with the pro-
posed plat for Not Applicable (referred to in this permit
as the 'plat" ) . The land is legally described as:
2. Conditions of Approval. The City hereby approves
the permit on condition that the Developer abide by its terms
and furnish the security required by it.
3. Plans. The plat shall be graded in accordance with
the following plans. The plans shall not be attached to this
permit. If the plans vary from the written terms of this permit, '
the written terms shall control. The plans are:
Plan A--Grading Plan (Attachment 11)
4. Time of Performance. The Developer shall complete
the grading by September 30, 1990. The Developer may, however,
request an extension of time from the City. If an extension is
granted, it shall be conditioned upon updating the security
posted by the Developer to reflect cost increases and the
extended completion date. •
5. Erosion Control. Plan A shall be implemented by the
Developer and inspected and approved by the City. The City may
impose additional erosion control requirements if they would be
beneficial. All areas disturbed by the excavation and back-
filling operations shall be reseeded forthwith after the comple-
tion of the work in that area. Except as otherwise provided in
the erosion control plan, seed shall be rye grass or other fast-
growing seed suitable to the existing soil to provide a temporary
ground cover as rapidly as possible. All seeded areas shall be
mulched and disc anchored as necessary for seed retention.
The parties recognize that time is of the essence in controlling
erosion. If the Developer does not comply with the erosion
control plan and schedule or supplementary instructions received
from the City, the City may take such action as it deems
appropriate to control erosion. The City will endeavor to notify
the Developer in advance of any proposed action, but failure of
the City to do so will not affect the Developer's and City's
rights or obligations hereunder. If the Developer does not reim-
burse the City for any cost the City incurred for such work
within thirty (30) days, the City may draw down the letter of
credit to pay any costs.
6. Clean up. The Developer shall daily clean dirt and
debris from streets that has resulted from construction work by
the Developer, its agents or assigns.
.ATTACHMENT #2
7. Security. To guarantee compliance with the terms of
this permit, the Developer shall furnish the City with a cash
escrow or irrevocable letter of credit from a bank ( "security")
for $5,000.00. The bank and form of the letter of credit shall
be subject to the approval of the City Administrator. The letter
of credit shall be for a term ending December 31, 1990.
8. Responsibility for Costs.
A. Except as otherwise specified herein, the
Developer shall pay all costs incurred by it or the City in con-
junction with the grading and erosion control, including but not
limited to inspection expenses incurred in connection with appro-
val and acceptance of the permit.
B. The Developer shall hold the City and its of-
ficers and employees harmless from claims made by itself and
third parties for damages sustained or costs incurred resulting
from permit approval and work done in conjunction with it. The
Developer shall indemnify the City and its officers and employees
for all costs, damages, or expenses which the City may pay or
incur in consequence of such claims, including attorney's fees.
C. The Developer shall reimburse the City for costs
incurred in the enforcement of this permit, including engineering
and attorney's fees.
D. The Developer shall pay in full all bills sub-
mitted to it by the City for obligations incurred under this per-
mit within thirty (30) days after receipt. If the bills are not
paid on time, the City may halt all work and construction.
9. Developer's Default. In the event of default by the
Developer as to any of the work to be performed by it hereunder,
the City may, at its option, perform the work and the Developer
shall promptly reimburse the City for any expense incurred by the
City, provided the Developer is first given notice of the work in
default, not less than four (4) days in advance. This permit is
a license for the City to act, and it shall not be necessary for
the City to seek a court order for permission to enter the land.
When the City does any such work, the City may, in addition to
its other remedies, assess the cost in whole or in part.
10. Notice. The applicant must notify the City Engineer
in writing a minimum of 48 hours prior to construction.
11. Watershed District Permit. The applicant shall
obtain and comply with the conditions of the Watershed District
permit, especially as it relates to seeding and restoration of
vegetative cover. •
12. Other Special Conditions.
A. The applicant shall relocate the disposal area
further west away from the ditch.

Dear Jack,
Councilmember Dimler passed on a copy of a letter to her from
you regarding the operation of jet skis on Lotus Lake. She asked
that I contact you and let you know that we are keeping abreast
of the jet ski situation on Lotus Lake and various communities
that are passing laws regarding jet ski operation. As such, I
am sending correspondence that I have had with Georgette Sosin
regarding this very issue. Included in the correspondence are
several articles from various newspapers regarding community
reaction to this controversial issue.
While we attempt to gather information on the jet ski issue from
these various sources , we will readily monitor the access at
South Lotus Lake. I have personally responded to the area with
Deputy Gary Bangsten of the Carver County Sheriff ' s Water Patrol .
Together we should ensure that the jet skis operate in a safe
• and legal manor regarding all applicable state and local
regulations . In addition, I have had correspondence with Park
and Recreation Coordinator Lori Sietsema asking that signs be
posted indicating that jet skis must adhere to the same rules
and regulations that all watercraft must adhere to on Lotus Lake.
Please let met know if there is anything else that we can do, and
rest assured that Councilmember Dimler and the entire City
Council is well aware of the situation.

RE: Jurissen Mining
Gentlemen:
This is to confirm the agreement between the City of
Chanhassen and Bruce Jurissen regarding mining on his property in
Chanhassen. All mining activity will cease no later than the
close of business Wednesday, May 23, 1990. Mining may not proceed
after that unless and until a conditional use permit is issued by
the City of Chanhassen. The City will work with Mr. Jurissen to
expedite processing the conditional use permit application as
quickly as possible consistent with ordinance requirements.

Congressman Jim Oberstar, Minnesota Eighth Congressional District, will
be our guest at a breakfast reception Monday, June 11th at the Flagship
Athletic Club. Congressman Oberstar is a senior member of the House
Public Works and Transportation Committee and serves as Chair for the
Aviation Subcommittee.
The Eighth Congressional District includes the cities of Duluth, Cloquet,
Chisholm, Hibbing, Grand Rapids, International Falls and Brainerd. Much
of the Iron Range is included within this District. Congressman Oberstar
is familiar with the needs and problems of rural America and is most
interested and supportive of our Corridor's need for TH 212 and greater
economic development in outstate Minnesota.
The Aviation Subcommittee is the first stop for aviation-related legislation
in the House. Oberstar's chairmanship of the panel affords him a significant
amount of control over which bills are brought before the subcommittee,
and a great deal of influence over what legislation is passed on to the
next steps in the process, the full Public Works and Transportation Committee
and the floor of the House of Representatives.
As Chairman of the Aviation Subcommittee, Jim has had to deal with a
wide range of issues affecting the well-being of the airline industry
and the safety of the traveling public. These issues include: How safe
are the nation's airlines? What rights do passengers have? How do we
deal with crowded airports and overworked air traffic controllers? Many
of these concerns have direct applicability to the concerns of our communities.
The St. Paul Pioneer Press Dispatch made the following comments about
Congressman Oberstar in October, 1988: "He is a seasoned, bright and
influential Congressman who believes strongly in the obligation of government
to help the poor. Such a voice is needed in Washington." It is a real
credit'to Jim Oberstar to receive recognition of this nature.
The June 11th meeting will provide greater opportunity to review the
highway and airport issues facing our communities. Please join us in
welcoming Jim Oberstar at the Flagship.

A public hearing on the TH 212 invironmental Impact Statement is scheduled
for Wednesday, June 6, 1990, 7:00 p.m. at Chanhassen Elementary School
(7600 Laredo Drive), Chanhassen, MN. An "Open House" will be held prior
to the hearing from 5:00 p.m. to 7:00 p.m. at the same location to provide
an opportunity for review of the DEIS/4(f) and related engineering and
environmental studies.
Representation from the Southwest Coalition in support of the TH 212
project is requested at the public hearing.
