PROPOSED MOTION
"The City Council is recommended to adopt a resolution calling the assessment
hearing for the 2014 Street Improvement Project No. 14 -01 for Monday, April
28, 2014.
City Council approval requires a simple majority vote of those present."
The 2014 project includes the
reconstruction of approximately 1.1
miles of streets, replacement of all the
watermain within Minnewashta Shores,
installation of new water main within
Kiowa Trail, sanitary sewer
replacement and repair, and
miscellaneous storm sewer
improvements.
The bid opening is scheduled for
Thursday, March 27, 2014. It is
recommended to call the assessment
hearing in order to keep the project on
schedule.
FUNDING
Special assessments to the benefitting
properties are proposed to pay for 40%
of the street costs associated with this
project. The residents of Kiowa Trail
® Proposed 2014 Street and
Utility Reconstruction Project
't
are proposed to be assessed for 100%
of the watermain installation costs within Kiowa Trail, with the City paying for
the pressure reducing station. The remainder of the project costs will be paid
from the revolving street assessment account and utility funds.

The estimated costs include 10% contingency and 10% indirect costs
Per state statute, the City Council must call the assessment hearing and publish the hearing date
at least two weeks prior to the assessment hearing. Staff will publish the notice in the April 10,
2014 edition of the Chanhassen Villager. This schedule provides just over two weeks time
between the publication date and the assessment hearing.

A RESOLUTION CALLING THE ASSESSMENT HEARING FOR THE
2014 STREET & UTILITY IMPROVEMENT PROJECT NO. 14-01
WHEREAS, Minnesota State Statute 429 regarding special assessments for public
improvement projects requires City Council to officially set the assessment hearing date for capital
improvement projects.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
CHANHASSEN, MINNESOTA:
1. A hearing shall be held on the 28`h day of April, 2014 in the Council Chambers at
City Hall at 7:00 p.m. to pass upon such proposed assessment and at such time and place all persons
owning property affected by such improvement will be given an opportunity to be heard with
reference to such assessment.
2. The city clerk is hereby directed to cause a notice of the hearing on the proposed
assessment to be published once in the official newspaper at least two weeks prior to the hearing, and
shall state in the notice the total cost of the improvement. The clerk shall also cause mailed notice to
be given to the owner of each parcel described in the assessment roll not less than two weeks prior to
the hearings.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole of the assessment on such property, with interest
accrued to the date of payment, to the City of Chanhassen, except that no interest shall be charged if
the entire assessment is paid within 90 days from the adoption of the assessment. The property
owner may at any time thereafter, pay to the City of Chanhassen the entire amount of the assessment
remaining unpaid, with interest accrued to December 31 of the year in which such payment is made.
Such payment must be made before November 15 or interest will be charged through December 31
of the succeeding year.
Passed and adopted by the Chanhassen City Council this 24`" day of March, 2014.

A RESOLUTION ORDERING THE PROJECT, APPROVING THE FEASIBILITY
STUDY, AUTHORIZING PREPARATION OF PLANS AND SPECIFICATIONS AND
APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING AD FOR BIDS FOR
THE 2014 STREET AND UTILITY IMPROVEMENT (KIOWA TRAIL AREA)
PROJECT NO. 14 -01
WHEREAS, on December 9, 2013, the City Council received the feasibility report for the
2014 Street Reconstruction Project and called for the public hearing to be held on January 27, 2014
for the 2014 Street Reconstruction Project (Kiowa Trail Area), and
AND WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing
was given, and the hearing was held thereon on the 27h day of January, 2014. The public hearing
was closed. Action was taken to table the motion until the February 24, 2014 City Council meeting
at which all persons desiring to be heard will be given an opportunity to be heard thereon.
NOW, THEREFORE, BE IT RESOLVED by the Chanhassen City Council:
Such improvement is necessary, cost - effective, and feasible as detailed in the feasibility
report.
2. Such improvement is hereby ordered as proposed in the Council resolution adopted
February 24, 2014.
3. Approve the feasibility study, authorize preparation of the plans and specifications, and
approve the plans and specifications, a copy of which can be reviewed at the office of the City
Engineer, for the 2014 Street Reconstruction (Kiowa Trail Area) Project No. 14 -01.
4. The city clerk shall prepare and cause to be inserted in the official city newspaper and
QuestCDN, an advertisement for bids upon the making of such improvement under such approved
plans and specifications. The ad shall be published at least three times, shall specify the work to be
done, shall state that bids will be opened and that the responsibility of the bidders will be
considered by the Council at 7:00 PM on Monday, April 28, 2014, for the 2014 Street
Reconstruction (Kiowa Trail Area) Project No. 14 -01, in the Council Chambers of the City Hall.
Any bidder whose responsibility is questioned during consideration of the bid will be given an
opportunity to address the Council on the issue of responsibility. No bids will be considered unless
sealed and filed with the clerk and accompanied by a bid security payable to the clerk for 5% of the
amount of such bid.
