Approve Fees for Non-Compliance with Water Meter Program

Approve the attached ordinance approving a $1 OO/month surcharge for properties
that fail to. comply with the City's Water Meter Program.
DISCUSSION
The City ofChanhassen Water Meter Program is underway to upgrade several
older meters in the City and to install radio read capability throughout the City.
As meters age, they no longer accurately measure low flow usages. The new
meters will allow the City to bill for all of the water used. In addition, the radio
read feature will reduce the staff demands for water meter reads.
US Filter, the City's contractor for this project, has informed the City that their
past experience in other cities has been that 5-10% of the population will not
respond to the contractor solicitations. The City will contact these people
following the 3rd notice by US Filter to have the installation done using City
personnel, however, it is anticipated that a handful of people will still fail to
comply.
As with the Surnp Purnp Program,City Staff is recommending a $100/month
surcharge be added to the utility bill for those properties that fail to comply with
the program. While this surcharge is intended as an incentive to comply, it has
the added benefit of covering aIlY City costs associated with water loss through a
slow meter and staff time to read the meter.

AN ORDINANCE AMENDING CHAPTER 19
OF THE CHANHASSEN CITY CODE
CONCERNING WATER METERS
THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
SECTION 1. Section 19-24 of the Chanhassen City Code is amended by adding
subparagraph (d) to read:
Radio read meters. Installation of a radio read capacity water meters shall
be required on all structures served by the municipal water system. If a property
owner does not authorize entry onto the property to allow installation of the meter, a
$100 per month surcharge will be applied on the water bill for the property. If a
property owner fails to allow proper service of or tampers with either the meter or
radio transmitter thereby interfering with proper meter reading and utility billing, a
$100 per month surcharge shall be applied and the water usage shall be estimated
based on past usage. In addition to the surcharge, the property will be responsible
for payment of any usage in excess of the estimated usage. The property owner
may appeal the surcharge in writing. Such written appeal must include an
explanation and/or justification for the failure to comply. Such appeal shall be
directed to the City Engineer. The appeal will be reviewed by the City Engineer and
forwarded to the City Council with a recommendation for action.
SECTION 2. This ordinance shall be effective immediately following the passage of
the ordinance.
