SUBJ: Lyman Boulevard Improvements, Phase II (Audubon Road to Powers
Blvd.)— Project No. 10 -08: Approve Resolution for Advancement of
Municipal State Aid Funds
PROPOSED MOTION
"The City Council approves a resolution for advancement of Municipal State Aid
Funds in the amount of $1,430,866.85 for Lyman Boulevard Improvements, Phase II,
Project No. 10 -08."
City Council approval requires a simple majority vote of the City Council present.
State Aid Cities can request advancement of state aid funds, without interest, if the
municipal state aid account has enough funds in the account to cover the requests.
The advancement of state aid funds for the Lyman Blvd. improvements is to help pay
for the City's portion of the improvements. The City is responsible for 50% of the
project cost not paid for by federal funds based on the Master Agreement for Lyman
Boulevard with Carver County. The City's total project cost share is estimated at
$1,700,000. The total project cost is $7,396,000. There may be additional right -of-
way costs the city will need to help fund since not all the parcel acquisitions have
been settled. The requested advancement takes into consideration some future
settlement costs. The City is also using state aid funds, in the amount of $700,000
this year to help pay for the City's share of the 101 Minnesota River Reconnection
project. The City will have this advancement paid off in three years based on the
current annual allotment. The City can still advance two years of the City's yearly
allotment for future projects if the state aid account has enough funds.

RESOLUTION FOR MUNICIPAL STATE AID FUNDS ADVANCE
FOR LYMAN BOULEVARD IMPROVEMENTS

WHEREAS, the Municipality of Chanhassen implemented a Municipal State Aid Street Project
which requires State Aid funds in excess of those available in its State Aid Construction Account; and
WHEREAS, said municipality will be constructing said project through the use of an advance from
the Municipal State Aid Street Fund to supplement the available funds in their State Aid Construction
Account; and
WHEREAS, the advance is based on the following determination of estimated expenditures:
Account Balance as of date 3/2/14 $ 969,133.15
City Project No. 13 -04 / SAP 194 - 020 -011, 194 - 020 -010 $ 700 000.00
City Project No. 10 -08 / SAP 194 - 020 -009 $ 1,700,000.00
Total Estimated Disbursement $ 2,400,000.00
Advance Amount (amount in excess of acct. balance) $ 1,430,866.85
WHEREAS, repayment of the funds so advanced will be made in accordance with the provisions of
Minnesota Statutes 162.14, Subd. 6 and Minnesota Rules, Chapter 8820.1500, Subp. l Ob; and
WHEREAS, the Municipality acknowledges advance funds are released on a first - come -first -serve
basis and this resolution does not guarantee the availability of funds.
NOW, THEREFORE, BE IT RESOLVED that the City of Chanhassen request that the
Commissioner of Transportation approve this advance for financing approved Municipal State Aid Street
Project of the Municipality of Chanhassen in the amount of $1,430,866.85 and hereby authorize
repayments from subsequent accruals to the Municipal State Aid Street Construction Account of said
Municipality from future year allocations until fully repaid.
Passed and adopted by the Chanhassen City Council this 24"' day of March, 2014.
