Attached is a letter from Merila & Associates certifying that

the utility construction has been completed in general
' conformance with the plans and specifications and is therefore
ready for the City' s acceptance.
' A condition of approval for this development was that the
developer obtain and dedicate to the City all street, utility and
drainage easements required as a part of this development. The
' City has not received all of the necessary easements and
therefore final acceptance should be conditioned upon the City
receiving these easements prior to formally accepting the utility
improvements. The specific easements referred to is a 20 foot
' utility and drainage easement over the existing storm sewer on
Lot 22, Block 2 Fox Chase which this development connected to.
' Therefore, it is recommended that the City accept the utilities
for Vineland Forest Addition, Project No. 89-27 conditioned on
the developer supplying the City with a mylar set of as-built
plans, a two-year maintenance bond and a 20 foot utility and
drainage easement across Lot 22, Block 2 Fox Chase. Formal
acceptance of the public utilities shall be effective from the
date the City receives the easement documents for drainage and
' utility purposes across Lot 22, Block 2 Fox Chase.

Dear Mr. Warren:
Based on the construction observation performed by BRW, Inc. for the city, the
material testing performed by GME Consultants Inc., -the construction observed
by the owner, and my visual review of the site. following construction it is my
belief that the Vineland Forest project was constructed in general conformance
with the approvid*:prgj.ect •plans and specifications prepared by-ourZf , .under
my direct supervision. ,
I recommend that the city accept the utility and grading portion of the project,
allowing the retainage to be reduced to zero percent (0%) on these line items,
and upon receipt of a warranty bond, from the contractor Machemes Construction
begin the actual warranty period.
Please take action on this matter at your next regularly scheduled city council '
meeting.
