PROPOSAL
The applicant currently resides on 1.8 acres of property zoned
residential single family located on the south side of Lake Susan.
The applicant is proposing to subdivide the 1.8 acres into two lots
of 1. 1 acres (parcel with residence) and .7 acres (vacant parcel) .
The applicant's home is located on the lot adjacent to Lake Susan
and the newly created lot will be located south of the residence
and will not have lake frontage.
STREETS '
The subject property and three other adjacent properties are
serviced from TH 101 by a 20 ft. ingress/egress easement crossing '
over property owned by Al Klingelhutz (Attachment #1) . There is an
existing private drive servicing the four residences along the 20
ft. road easement from Highway 101. The Zoning Ordinance allows
private driveways to service up to four lots. The existing 20 ft.
easement is currently serving the maximum four lots allowed. The
applicant is proposing to provide an additional 20 ft. easement
from TH 101 to the Al Klingelhutz property which would then connect
with an existing 33 ft. ingress/egress easement (Attachment #2) .
The driveway servicing the newly created lot would be serviced by
the 33 ft. easement which currently does not contain any other
private driveways. Although the applicant is providing the new
private drive easement accessing TH 101, staff is recommending that
the existing 20 ft. easement access point to TH 101 continue to be
used for the new lot since it is too dangerous to provide an
additional access on TH 101.
Staff reviewed the subject and surrounding properties to determine '
if future road right-of-way should be dedicated at this time for if
and when the properties are further subdivided. TH 101 will become
a cul-de-sac in this location when it is realigned with TH 212
construction (Attachment #3) . The existing 33 ft. easement could
potentially be a good location for a future public street to
service the subject and surrounding properties (Al Klingelhutz
property) . Therefore, staff is recommending that the 33 ft.
easement through the subject site be dedicated as right-of-way.
This will reduce the lot area but it will still meet the lot area
requirements. 1
LOT REQUIREMENTS AND UTILITIES
The proposed metes and bounds subdivision creates lots that meet '
the requirements of the Zoning Ordinance as far as lot area and
depth. The requirement for public street frontage is being
resolved with the property being serviced by a private
drive.

' The property has sewer service available, but does not have water
service available. Sewer connection to the new lot must be
provided from the existing sanitary sewer service located within
' the 33 ft. easement (Attachment #4) . The existing private sanitary
sewer service is 6 inches. The zoning code requires the service to
be public with the line enlarged to 8 inches and covered by a
public utility easement. The applicant, or whoever develops Parcel
B, will be responsible for the cost of the replacement of the 6-
inch pipe, extension of the 8-inch pipe, sewer connection charge
and hook-up fees. Water will be provided -by a well on the
' property.
RECOMMENDATION
' Planning staff recommends that the City Council adopt the following
motion:
' "The City Council recommends approval of Metes and Bounds
Subdivision Request #90-13 with the following conditions:
' 1. Parcel B shall use the existing access to TH 101. No
additional access to TH 101 shall be permitted.
2. The applicant shall dedicate the 33 ft. ingress/egress
easement through Parcel B as public right-of-way.
3. A 15-foot sanitary sewer easement extension to the newly
created southerly parcel shall be acquired.
4. The existing 6-inch sanitary sewer shall be replaced with
' 8-inch sewer and be extended west to the proposed
southerly parcel. Future development of this parcel will
require connection to the sanitary sewer.
5. The proposed southerly parcel shall gain access rights
through tithe existing shared driveway easement to the
' point where the existing 33-foot ingress/egress easement.
6. Both of the proposed parcels shall connect to city water
when it becomes available.
' 7. The applicant shall provide the City with necessary
securities to ensure proper installation of the sanitary
' sewer line.

SUBJ: Review of Preliminary Plat to Subdivide 1. 8 Acres into
1 Two Parcels at 8528 Great Plains Boulevard
File No. 90-25 Land Use Review
' The existing parcel contains 1.8 acres abutting the south
shoreline of Lake Susan. The proposed lot split would yield two
parcels with the northerly parcel being 1.1 acres and the
' southerly parcel yielding 0. 7 acres. The terrain for the
property is primarily rolling with vegetated grasses and
established tree stands near the center of the existing property.
There is currently a home on the existing property. This home is
proposed to remain within the newly created boundaries of the
proposed northerly parcel. Access to this existing home is via a
shared driveway from the properties to the east. Sanitary sewer
is available along the northerly portion of the property. It is
apparent from billing records that the existing home has
connected to City sanitary sewer; however, watermain is not
available in the area at this time.
The proposed southerly parcel is currently vacant. Access to this
property could be gained by acquiring proper rights to make use
of a small segment of the referenced shared driveway easement to
the point where a 33-foot ingress and egress easement exists.
' This ingress and egress easement could be used to continue the
access to the southern portion of the property from the east.
' A private six-inch sanitary sewer is located in the vicinity of
the adjacent property immediately east. City ordinance does not
allow more than one connection on a service line. Thus, this
six-inch line (approximately 100 feet) would need to be replaced
with an eight-inch and extended to property line of the proposed
southerly parcel. A 15-foot utility easement will also need to
be acquired to extend this sanitary sewer to the subject parcel

property line. As mentioned previously, watermain is not
available at this time for these proposed parcels. It is
anticipated that City water will not be available to these
properties for another five or six years when the T.H. 101
improvement is constructed. At this time, it is recommended that
the 15-foot sanitary sewer easement extension be acquired and an
eight-inch sanitary sewer be extended from the City sewermain to
the newly created southerly parcel. At such time in the future
when watermain becomes available to this area, these two parcels
will be required to hook up. '
RECOMMENDED CONDITIONS '
1 . A 15-foot sanitary sewer easement extension to the newly
created southerly parcel shall be acquired.
2 . The existing 6-inch sanitary sewer shall be replaced with
eight-inch sewer and be extended west to the proposed
southerly parcel. Future development of this parcel will
require connection to the sanitary sewer.
3 . The proposed southerly parcel shall gain access rights
through the existing shared driveway easement to the point
where the existing 33-foot ingress and egress easement is
located.
4 . Both of the proposed parcels shall connect to City water when
it becomes available.

applicable City Ordinance provisions. Before filing this application, you
should confer with the Planning Department to determine the specific
ordinance and procedural requirements applicable to your application. I
This is to certify that I am making application for the described action by
the City and that I am responsible for complying with all City requirements
with regard to this request. This application should be processed in my name'
and I am the party whom the City should contact regarding any matter
pertaining to this application. I have attached a copy of proof of ownership
(either copy of Owner's Duplicate Certificate of Title, Abstract of Title or II
purchase agreement) , or I am the authorized person to make this application
and the fee owner has also signed this application.
I will keep myself informed of the deadlines for submission of material and I
the progress of this application. I further understand that additional fees
may be charged for consulting fees, feasibility studies, etc. with an
estimate prior to any authorization to proceed with the study. The documents I
