Individual property ' owners were notified of the specific assessments against their property as noted in the attachments. The final assessment rolls are attached and are dated as follows: Project No. 86-11B - September 5, 1990 Project No. 87-17 - August 23, 1990 Project No. 88-22A - August 23, 1990 ' Staff has met with interested parties on specific questions as they arose. As noted in the attachments, one written objection to the assessment roll for Project No. 88-22A has been received from the property owner, Mr. Burdick. The enclosed memorandum from BRW summarizes the assessment methodology as it relates to ' Mr. Burdick's properties and I personally met with Mr. Burdick Thursday afternoon to further explain the logic behind the assessments. No adjustment is recommended for the Burdick parcels . No other objections to the roll have been received as ' of the writing of this staff report. Procedurally, assessments are to be certified to the County no later than October 10, 1990 . In order to provide the statutory 30 days between adoption of the roll and certification of the roll for repayments , these rolls need to be formally adopted at Monday night's meeting. Mr. Ehret of BRW who has the background specifics on these three rolls will be present to address any last-minute concerns which IIare brought up during the public hearing process. At the close II Don Ashworth September 5 , 1990 Page 2 of the hearing, it is necessary for the City Council to adopt the three attached assessment rolls to be certified to the County. It is also necessary for the Council to set the repayment terms for the assessment by resolution and, as such, an 8% interest rate and 10-year payment schedule is recommended consistent with the bond issue . ktm ' Attachments: 1. They were: #1 - Instant Web - represented by Jules Smith 11 #2 - B.C. Burdick We understand that you hate r_:e v}ed a writter objection to the final assess- ments from Mr. Burdick at this time. In an effort to attempt to suemariie the concerns of the property owners, the assessment methodology used, and how it reetes to the concerns of these ' individuals I would like to offer the follcwirg summary. #1. Instant Web Propert The initial project assessment roll had a proposed assessment of $32,665.50 to the property for storm drainage. The concern expressed by Mr. Smith was that they should be given a credit for the portion of the storm sewer system that they previously installed. The final assessment roil being considered by the City Council at their ' September 10, 1990, meeting has a proposed assessment of $17,362.61 for storm drainage. The final roll includes a 50 percent reduction in the assessable amount of storm drainage consistent with City Policy. It does not specifically address a direct reduction (over and above the 50 percent) specifically for Instant Web. We felt that the 50 percent write down represented a significant contribution by the City on behalf of all property owners. It is also a common element to all of the adjacent properties that internal storm drainage improvements or improvements to maintain existing drainage patterns from off-site runoff are made at the cost of the p►`cperty owner. The City may wish to consider the position of Instant Web as it relates to the cost of the previously installed storm sewer, but if consideration is given, it should be on the basis of a credit to the watershed with a TIF contri- bution. The assessment rate and/or properties to be assessed should not be changed from those shown on the assessment roll for this project. #2. B.C. Burdick Properties: The initial project assessment roll had a proposed assessment of $70,211.60 in total against all properties owned by Mr. Burdick. Mr. Burdick objected tc this assessment on the basis of no benefit. The final assessment roll being considered by the City Council at their September 10, 1990, meeting has a total assessable amount of $41,465.99 against all properties owned by Mr. Burdick. The reduction is at- tributable to reduced project costs plus the 50 percent reduction referenced above. Mr. Burdick's property is similar to the Instant Web property in that it is somewhat remote from the primary project area. However, it is upstream of the storm sewer system that was installed and does con- tribute runoff to both the system and Lake Susan. we attempted to carefully separate any properties owned by Mr. Burdick which have been or will be assessed for storm drainage by another project. The properties owned by Mr. Burdick that are proposed for assessment for this project were not assessed for the downtown improve- ments. The initial feasibility study for the West 78th Street detach- ment considered two different storm sewer plans (A & B). Under Storm Plan A drainage from Mr. Burdick's property would ultimately go south under TH 5 through the Lake Drive storm sewer to Lake Susan and would not be a part of the West 78th Street detachment project. Therefore, he would not be assessed for storm drainage for the West 78th Street detachment project. Under Storm Plan B Mr. Burdick's property would be directed to the Ekenkan Pond through the West 78th Street detachment project storm sewer. If Plan B were implemented Mr. Burdick would be assessed for the West 78th Street detachment storm sewer. In authorizing the West 78th Detachment Project in 1987/1988 and subsequently approving grading plans for Burdick Park 2nd Addition, the City Council selected Plan A which directed Mr. Burdick's storm water south through the Lake Drive Project. Therefore, he is not proposed for assessment for the West 78th Street Detachment Project, but he is proposed for assessment for the Lake Drive project. He is correct that on-site ponding is/will be provided; however, his pond does continue to outlet under TH 5, through the Instant Web Property, through the Lake Drive system and into Lake Susan. ' We, therefore,. feel that benefit is received by the Burdick properties from the construction of the downstream system as a part of this project, and the properties listed on the assessment roll should be ' assessed. I. 1 , .... - • - e "-- • 87- 17 - ,- �.1 NOTICE OF ASSESSMENT HEARING CITY OF CHANHASSEN, MINNESOTA NOTICE IS HEREBY GIVEN that the Chanhassen City Council will meet at 7:30 p.m. on Monday, September 10, 1990, at the City Hall Council Chambers to pass upon the proposed assessment for the North Side Public Parking Lot Project No. 87-17. The project includes parking lot, water main, sanitary sewer, storm drainage and landscaping improvements in the downtown area. Said improvements are proposed to be assessed to the property benefitting from the referenced utility and street improvements. More specifically, the affected properties proposed to be assessed are abutting properties lying within the area shown on the map below. The proposed assessment is on file for public inspection in the office of the 11 City-Clerk. The amount proposed for assessment is $900,000.00. Written and oral objections will be considered at the meeting, but the Council may consider any objections to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advisable. An owner may appeal an assessment to the District Court pursuant to Minnesota 1 Statute Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Chanhassen within- thirty (30) days after the adoption of the assessment and filing such notice with the District Court within ten (10) days after service upon the Mayor or City Clerk. No appeal may be taken as to the amount of any assessment adopted unless a WRITTEN NOTICE signed by the affected property owner is filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Residents who are 65 years of age or older, or retired by reason of permanent and total disability, may apply to have payment of the assessment deferred.
