ISUBJ: Approve Plans and Specifications for Minnewashta Highlands

IThe attached plans have been prepared by Engelhardt & Associates
and reflect the final development concept approved by the City
I Council for the cul-de-sac to service the Minnewashta Highlands
subdivision . It incorporates sanitary sewer and watermain uti-
lity extension into the subdivision. Utility service for Lot 1,
I however , will be taken from the stubs which exist on Minnewashta
Parkway.
Since this item was last in front of the Council, City Public
I
Works staff have completely re-graded and re-defined the storm-
water drainage retention basin for the Maple Ridge subdivision as
requested by Mr. Borchart and Mr. Jasin, the nearby property
I owners. Similarly, a new outlet control structure has been built
in the retention basin with a flow restricter. In addition,
storm sewer catch basins are to be added to the plans to inter-
I cept storm water runoff from the cul-de-sac with an outlet across
Minnewashta Parkway. With this exception, this set of plans and
specifications are therefore complete and are ready for approval
by the City Council.
IIt is therefore recommended that the City Council approve the
attached plans dated January, 1989 and signed February 3, 1989 ,
I prepared by William R. Engelhardt & Associates for the
Minnewashta Highlands subdivision. -

The attached development contract has been prepared to reflect
the latest development concept submitted under item d(1) of this
agenda. The development contract accurately reflects the con-
ditions of approval for the subdivision. It is therefore recom-
mended for approval and execution.

(Developer Installed Improvements)
MINNEWASHTA HIGHLANDS
SPECIAL PROVISIONS
' AGREEMENT dated , 19 , by and between
the CITY OF CHANHASSEN, a Minnesota municipal corporation (the
"City" ) , and ELLIE SCHWABA and KEVIN C. WINCHELL (the "Developer" ) .
' i. Request for Plat Approval. The Developer has asked
the City to approve a plat for MINNEWASHTA HIGHLANDS (referred to
in this Contract as the "plat") . The land is legally described
on the attached Exhibit "A" .
2. Conditions of Plat Approval. The City hereby
approves the plat on condition that the Developer enter into this
Contract and furnish the security required by it.
3. Development Plans. The plat shall be developed in
' accordance with the following plans. The plans shall not be
attached to this Contract. With the exception of Plan A, the
plans may be prepared, subject to City approval, after entering
' the Contract, but before commencement of any work in the plat.
If the plans vary from the written terms of this Contract, the
written terms shall control. The plans are:
Plan A--Plat prepared by DeMars-Gabriel Land Surveyors, Inc.
Plan B--Grading, Drainage and Landscape Plan dated
January , 1989 , prepared by William R.
Engelhardt & Associates, Inc.
' Plan C--Plans and Specifications for Improvements dated
February 3, 1989 , prepared by William R.
Engelhardt & Associates, Inc.
4. Improvements. The Developer shall install and pay
for the following:
' A. Storm Water Drainage System
B. Streets
C. Concrete Curb and Gutter
D. Street Signs
E. Street Lights
F. Site Grading
G. Underground Utilities (e.g. gas, electric,
' telephone, CATV)
H. Setting of Lot and Block Monuments
I. Surveying and Staking
J. Sanitary Sewer Main
K. Watermain

5. Time of Performance. The Developer shall install
all required improvements by November 30 , 1990 . The Developer
may, however, request an extension of time from the City. If an
extension is granted, it shall be conditioned upon updating the 11 security posted by the Developer to reflect cost increases and
the extended completion date.
6. Security. To guarantee compliance with the terms
of this Contract, payment of special assessments, payment of the
costs of all public improvements and construction of all public
improvements, the Developer shall furnish the City with a letter
of credit from a bank, cash escrow, or equivalent ( "Security" )
for $ 43, 300 .00 The amount of the security was calculated as
110% of the following:
Site Grading $ 4 ,000 .00
Sanitary sewer $ 9 ,585.00
Watermain $ 5 ,582. 00
On-site storm sewer $ 500 .00
Streets $ 11 ,843. 00
Street lights and signs $ 350 .00
Erosion Control $ 700 .00
Engineering, surveying,
and inspection $ 2,600 .00
Landscaping $ 4 ,200 .00
TOTAL COST OF PUBLIC IMPROVEMENTS $ 39,360.00
This breakdown is for historical reference; it is not a restric-
tion on the use of the security. The security shall be subject
to the approval of the City. The security shall be for a term
ending December 31, 1990 . The City may draw down the security,
without notice, for any violation of the terms of the Contract.
If the required public improvements are not completed at least
thirty ( 30 ) days prior to the expiration of the security, the
City may also draw it down. If the security is drawn down, the
draw shall be used to cure the default. With City approval, the
security may be reduced from time to time as financial obliga-
tions
are paid, but in no case shall the security be reduced to a
point less than 10% of the original amount until all improvements
are complete and accepted by the City.
7. Notices. Required notices to the Developer shall
be in writing, and shall be either hand-delivered to the
Developer, its employees or agents, or mailed to the Developer by
registered mail at the following address:

I8. Other Special Conditions.
A. The cul-de-sac shall be constructed to City
istandards for urban roadways.
B. The applicant shall apply for and obtain per-
mits from the Watershed District, Department of Natural Resources
' and other appropriate regulatory agencies and comply with their
conditions of approval.
C. Construction on Minnewashta Parkway shall be
prohibited.
D. Lot 1, Block 1 shall obtain utility service by
I connecting to the existing sanitary sewer and water service stubs
along Minnewashta Parkway. A connection charge of $6 ,369 .64 shall
be paid with the building permit application for Lot 1, Block 1,
which includes all City trunk hook-up charges for this lot.
IE. Utility service to Lots 2 through 5 , Block 1
shall be obtained by connecting to the new sanitary sewer and
II watermain to be constructed in the new cul-de-sac. The City 's
hook-up charges for sewer and water trunks as well as the
Metropolitan service availability charge (S.A.C. ) will be due
I with building permit issuance except for Lot 4 , Block 1 which has
already been paid.
F. An acceptable grading plan shall be provided by
I the Developer for the corrective sight distance grading of Lots 4
and 5 prior to the issuance of building permits.
I G. A 15-inch diameter culvert will be required
underneath the northerly proposed driveway.
H. A grading, drainage and erosion control plan
I for each lot will be required as part of the building permit
application process .
I. All private accesses shall be served by the
internal cul-de-sac. No private accesses shall be allowed onto
Minnewashta Parkway.
IJ. The accessory building on Lot 3 shall be
removed and properly disposed of.
I K. No occupancy certifications will be issued, nor
building utility connections allowed, until such time as the uti-
lity portion of the public improvements have been tested and
I accepted by the City, except for Lot 1, Block 1 as noted in "D"
above.

L. All building construction traffic shall
restrict their access to the subdivision to one access point;
that being the location of the new cul-de-sac connection .
M. Landscaping along the rear of Lots 1 through 3 '
shall be installed immediately after the overall lot grading is
completed.
9. General Conditions. The general conditions of this ,
Contract, approved by the City Council on February 22, 1988 , are
attached as Exhibit "B" and incorporated herein.
