Based on the study results, we are planning to use the center lane as a two-way left turn lane and the outside lanes for through traffic. This II is to be an interim configuration that will be in place until T.H 7 in this location is reconstructed several years from now. I This proposal does create two areas of concern for us: 1) lack of shoulder on the north side for emergency parking, and 2) the lack of right turn lanes for intersecting roads on the north side. However, we 1 concluded that these deficiencies can be tolerated after the overall benefits were considered. Because the winter months are approaching, we are proposing that these 1 changes take place during the late spring or early summer months of 1990. This will allow drivers to adapt to the changes under the best weather conditions possible. We have taken a number of important steps in our effort to continue, and formalize,this dialogue. In addition to our series of breakfasts, we have developed the RTB's first newsletter, the Messenger, which will offer information on our programs as well as provide you, as a local government official, with an opportunity to reflect some of your concerns. I have created a Department of Community Relations and appointed Mike Kuehn to be Community Relations Coordinator. It will be his responsibility to facilitate communication directly between the chair's office,the board, and local government. We are currently involved in negotiations with the regional cable television system to broadcast our board meetings so that issues discussed during RTB meetings can be observed at a time convenient to the public. You should have already received the first in a regular series of RTB Chair's Advisories that will attempt to highlight in greater detail some of the issues that have come before the Regional Transit Board. As I shared with you at the breakfast, in cooperation with the Association of Metropolitan ' Municipalities (AMM),we are in the process of establishing a Chair's Advisory Committee. I have offered AMM the opportunity to define both the structure and membership of this committee to respond to issues of geographic imbalance on the RTB. To assure the participants that the committee has a valid purpose and presence, I have promised AMM that any item requested by vote by this body will appear on a future RTB agenda, thereby ensuring the committee's permanent and continuous access to the Regional Transit Board. As I indicated at our breakfast meeting, my earlier government service was as an assistant to a city council and a county board. I am familiar with the feelings of alienation that too often occur between local and metropolitan governments. It is my intent as chair of the Regional Transit Board to demonstrate that our efforts are complementary and supportive to those of your community as we work together to provide for the transit needs of our mutual constituency. The letter states that you are in the process of making amendments to your budget so that a check in the amount of 1 $5,700 can be sent to the City for the purpose of funding the Chanhassen recycling program through 1989. You further state that before the actual check will be sent, you would like to clarify the specific action of the Carver County Board so that 1 future misunderstandings or problems can be avoided. The motion to approve the funding for the $5,700 was contingent upon Chanhassen developing an internal funding mechanism to pay for I the program in 1990 and that the County expects a firm comittment from the City to the recycling program for the entire year of 1990. IOn November 20, 1989, the City Council `approved the first reading of an ordinance requiring all licensed haulers in Chanhassen to collect recyclables on a weekly basis. The second and final I reading of the ordinance will be reviewed by the City council on December 4, 1989, and will go into effect 90 days after publica- tion, approximately March, 1990. This action and past action by I the City shows a firm commitment by the City to continue to pro- vide recycling programs to the residents of Chanhassen through 1990 and beyond. V IAlthough the ordinance amendment requires that the collection of recyclables be the responsibility of haulers within Chanhassen, the City of Chanhassen will still be responsible for funding 1 public education, recycling containers, special pick-ups, etc. The recycling program that Chanhassen is providing fulfills Carver County' s obligation to provide at least one/month curbside 1 pickup of recyclables by October October, 1990. As we both have seen, the cost of one/month curbside pickup can cost as much as every other week pickup. By having Chanhassen provide the recycling program, Carver County is being saved a substantial 1 I Mr. Mike Lein November 27, 1989 Page 2 amount of money. In fact, until the new program can be imple- mented in March, 1990, the City will have to expend $24,300. 1 With this in mind, Chanhassen will continue to work with you to receive funding from Carver County for 1990 and future years. Please keep me in touch as it becomes more definite as to how y ' much money Carver County will be receiving as part of the SCORE Legislation and how much will be distributed to cities in Carver County. 1 I hope this letter clarifies the City's intent to continue a recycling program through 1990 and beyond and hope you can now process the check for $5,700. Although it is Shorewood 's problem, the Lilac Lane hill has already been the scene of two auto spin—outs and a bus sliding I into Mill Street / Powers Blvd. None of the vehicles involved were "local " ; they had accessed Lilac via Teton and were not former owners or easement holders of "Teton" . This effort is being made to call attention to the ever II growing crisis of illegal drug use within our communities. The City of Chanhassen is participating in this national effort to call attention to the fact that cities and towns are on the front lines of the drug war. The battle will either be von or lost on the streets of hometown America. II Mayor Chmiel has asked that since this period of concentrated activity will begin on a weekend, it is his hope that the leaders of our churches will use II their first meeting in December to preach to their congregations about the importance of this dual message. . .the scourge of drugs and the importance of community wide personal commitment to-fight back. Please ask your congregation to become involved in our continuing efforts to II educate the public about the terrible problem illegal drugs present, especially to our youth, and to help in our enforcement -efforts to eradicate totally the II propagation of illegal drug use. Several activities are scheduled during the week to include a ribbon cutting ceremony at noon on December 4, 1989, to take place at the Chanhassen Elementary II School in conjunction with the Chanhassen Elementary School fifth grade class. The first seminar dealt with the issues of time management, organization, communication, and self-reliance . Practical new planning and people skills were demonstrated enabling II us to deal more effectively with interruptions and tame the "paper blizzard" (which is highly prevalent in this office ! ) . Many of the steps discussed were familiar to us, but it was Ihelpful to review it . The Upset Citizen seminar was an upbeat, informative, role I playing session which gave us many options to explore . The techniques of good listening habits, positive body language, and proper voice control were. stressed and we will incorporate these in daily public contacts. IWe felt that both seminars had a lot of important and helpful suggestions that will be useful in our position. A structural framework will be constructed using 2x10 or 3x12 treated materials. The decking will be 2x6 treated wood and will be screwed in place. After completion of the structural and decking materials, skirt board will place around the entire structure to hide the decking end grains and all of the structural pieces. These skirt boards will provide a finished appearance to the structure. The total cost to complete the platform is $9,700.00. This includes all materials and labor and equipment to construct the platform. The contractor has the sole right to determine safe ice conditions necessary to support the heavy equipment. The Department of Natural Resources letter states that you have voluntarily agreed to remove the fill material placed below the ordinary high water elevation of Lotus Lake and that the restoration shall be completed by May 1, 1990. , The City has been waiting for the Department of Natural Resources to determine exactly what extent of fill needed to be removed to 11 satisfy their requirements prior to proceeding with your wetland alteration permit application on file with the City. Since the DNR has made their final ,determination nee are now able to proceed with your application. The City needs a survey submitted from all three parties showing the area of fill, the ordinary high water mark and the area-of fill that will.be -removed as required by the DNR. Although the violation of -the DNR regulations has been resolved, the action is still in violation of the City' s Wetland Ordinance and you are still required to go through the Wetland Alteration Permit process. I contacted you and you indicated that the use of the trailers is a temporary action for a short period of time due to peak business loads. You further indicated that the trucks would be kept as far to the rear of the site as possible and further that you would cease the activity if complaints were received. Matters of General Public Interest Mr. Donald Atkins discussed the Bell Oaks Project where restoration and site grading has not been completed. Mr. Atkins identified other areas requiring investigation to insure completion of site restoration. The Engineer was directed to report regarding the need for corrective action. Correspondence, Publications and Reports The following items of correspondence were noted: A communication from the architectural and engineering firm of Israelson, Reese & Ellingson Associates, Inc. , providing background information regarding experience in water management areas. A communication from the State President of the Minnesota Association of Watershed Districts and the Chairman of the Board of Water and Soil Resources asking for a report on accounting and annual audits. The request was referred to the Attorney for response. A communication from the United States Department of ' Agriculture, Soil Conservation Service, forwarding the Water Resources Project status report as of October 19, 1989. The report was referred to the Attorney for review. Permit Applications The following grading and land alteration and utility 1 installation permit applications, and the Minnesota Department of w , Natural Resources Work in Public Waters permit applications were processed by the Managers . A. Permit 89-67: Rome Office Building; Chanhassen Business Park; site grading and utility installation and grading and land alteration permit: City of Chanhassen. The Engineer reviewed the utility installation and grading and land alteration plans and recommended permit conditions. Following discussion, it was moved by Scribner, seconded by Peterson, that the permit be issued in accordance with the Engineer 's recommendation. Upon vote, the motion carried. B. MDNR Chapter 105 Work in Protected Waters Permit Application: installation of sand blanket at 9235 Lake Riley Blvd. : City of Chanhassen. The Engineer discussed the recommendations regarding the ' Chanhassen project to improve the lakeshore of Lake Riley by , removing accumulated silt and debris. Following discussion, it was moved by Cardinal, seconded by Scribner, to forward the District 's recommendations to the Minnesota Department of •• Natural Resources. Upon vote, the motion carried. Following action on the permit, a discussion occurred regarding the project agreement with the City of Chanhassen. The Attorney reported that the request that the City of Chanhassen agree to provide permanent maintenance of the siltation had not been acted upon. The Attorney was directed to contact Chanhassen and the property owner, Mrs. Joy Tanner, and report on the status of the project at the next meeting. C. Permit 89-68: Utility installation; Shadow Wood grading and land alteration permit: City of Chaska. The Engineer reviewed the utility and grading ,and land alteration plans and recommended permit conditions. Mr. Peter Knaeble was present on behalf of the applicant. He discussed the agreement reached with regard to the location of the ponding basin and the outlet structure. Following discussion, it was moved by Cardinal, second by Scribner, to permit the issuance in accordance with the Engineer's recommendations. Upon vote, the motion carried. D. Permit Extension 89-33: 98th and Normandale; Development grading and land alteration permit: City of Bloomington. The Engineer reported on the status of the project and the concerns with regard to site restoration. The project had been delayed and discussions would take place with officials of the City of Bloomington regarding the work to be completed. The Engineer reported that the applicant had requested an extension of the permit, to enable the work to be completed before the end of the fall season. The purpose of the analysis was, of course, to determine the advisability of using insurance for the City's future issues. Our method of analysis calculated first the interest cost had the issues sold on an uninsured basis as "Baa" rated securities. From this total interest cost we then deducted the actual interest cost the City paid on the three issues sold on an insured basis. The calculation determined the gross interest cost reduction. From the gross interest cost savings we then deducted the insurance premium paid by the City to determine the net interest cost savings resulting from the insurance. Table I below summarizes the results of this analysis. Table 1 Chanhassen, Minnesota Insured Rates vs. "Baa" Rates Total Estimated Interest Cost as "Baa" Issues (Including Larger Discount) $4,440,905.42 Total Actual Interest Cost of 3 Insured Issues (Including Actual Discount) 0,252,821.66) Total Savings for Insured Issues $ 188,083.76 Less: Insurance Premium (City-Paid) (43,333.96) Net Savings for Insured Issues $ 144,749.80 NOTE: Interest rate calculation for the "Baa"-rated interest rate scale is based on a comparable sale held at approximately the same time as the City of Chanhassen sale. This analysis shows that the City achieved net interest cost savings after deduction of the insurance premium of approximately $145,000. Over time, as the reviews have become increasingly- sophisticated, the variety of requirements placed upon individual lots has increased. These requirements have or may include: II - specific grading and drainage plans - - minimum house elevations to prevent flooding II erosion protection - specific tree preservation requirements, and location and design of driveways.. IIWhile these conditions. have been approved during the platting procedure we find that enforcement of them has been inconsistent. We believe this is due to several factors. In has not had the staff resources to do an adequates opbst o, foe city up. The requirements were not effectively conveyedtothellow- developer/builder and city inspectors. And, finally, a fundamental problem has been the lack of an effectivesenforce- ment mechanism. Through administrative changes we believe we have addressed the first two problems . We now have sufficient staff to undertake the work and the Planning Department has arranged with Public Safety to sign off on all building permits and certificates of occupancy. This allows us to go back through the files so that each specific requirement can be recorded on the building permit and to theoretically insure that the requirements are met prior to issuance of a certificate of occupancy. The Planning Department will take responsibility for insuring that the conditions of approval are researched prior to the issuance of any building permits. The applicant for the per- mit will be required to sign a statement listing the con- ditions . A copy of the statement is attached. 4. The site will be inspected prior to issuance of a certificate of occupancy to insure compliance with conditions of appro- val. This inspection will be handled in conjunction with normal inspections handled by Public Safety staff. In most cases, special visits by Planning Staff should not be required. If for some reasons, such as weather, improvements are not completed by the time a certificate of occupancy is requested, it can be released pending the builder providing a suitable financial guarantee with a date certain for completion. If improvements are not completed, the funds could be used by the city to complete the work. The builder will have been informed of this requirement at the time the original permit was issued. Financial guarantees of this sort are not uncommon. In fact, many communities require an "up-front" cash escrow with each building permit. We are only proposing to require them if impro- vements are not completed by the time a certificate of occupancy is requested. If the City Council desires that an escrow be automatically required, staff should be directed to do so. City staff surveyed several communities to gain an understanding of what their policies were in this area. These are illustrated in the following table. They use existing R Mr. Don Ashworth December 11, 1989 Page 5 security. Yet, on final enforcement, it is the builder who is Y � responsible for making the escrow payment. I understand the II logic of the developer having completed all of his requirements and being gone before the builder starts grading the lot, running in sewer and water services, excavating for the home, etc. Any II of these latter work functions would probably produce casualty to any developer installed tree. However, it does appear to be a double standard. Builders need to know that this is a respon- Isibility that they will end up having to meet. Approval is recommended with the condition that staff be instructed to determine how this regulation can be adopted for Iall new residential construction. All disturbed areas must be seeded or sodded to prevent erosion. 2. Unless already on the site, at least one tree must be planted on private property in the front yard setback of each lot. The tree must be deciduous at least 2 1/2" in diameter at the time of installation. 3. Erosion control must be maintained throughout the construction period and until new vegetation is established. 4. All public streets must be maintained in a clean condition. 5. Drainage and grading must be completed in compliance with approved plans. 6. Additional requirements relating to tree preservation, landscaping drainage, ' placement and elevation of the home and related issues may be imposed. These requirements are conditions of approval as granted by the City Council. It is your obligation to maintain erosion control, tree preservation, drainage, and condition of public streets during construction of the home. ' SPECIAL CONDITIONS: 1 ' Failure to comply with these requirements could result in the issuance of a stop work order. Certificates of Occupancy will not be issued until all conditions have been complied with. If the conditions cannot be met prior to requesting a CO due to weather or other circumstances, financial guarantees satisfactory to the City must be provided prior to release of the CO. The amount of the guaran- tee will be established by City staff. Financial guarantees for seed/sod and the tree is $750.00 I have read this notice and fully understand its requirements.
