EXECUTIVE SUMMARY
The developer, the City of Chanhassen, is requesting preliminary and final plat
approval to create two lots for a development known as Schneider Park 2nd
Addition. The proposed development consists of city hall, part of City Center Park,
the proposed library and City Center Commons. As a condition of plat approval,
the City is required to vacate an existing drainage and utility easement along with
City Center Drive (formerly known as Center Street and Coulter Boulevard),
Chan View and some of Kerber Boulevard and West 78th Street right-of-way.
The development site is 7.4 acres. The site is accessed via Kerber Boukvard and
Market Boulevard.
BACKGROUND
The existing drainage and utility easement and right-of-way were dedicated to the
City as part of the Schneider Park plat in 1980. The easement, which runs
north/south through the site, contains an existing sanitary sewer and watermain
line.
DISCUSSION
The city is proposing the replatting of Schneider Park Addition to create two lots
from the current five lots and a portion of the parcel around the existing city hall.
The proposed Chanhassen Library is going to be built directly over the location of
the existing drainage and utility easement. The building project will necessitate
the construction of new utility lines along the east side of the building. Once the
existing sewer and water lines are moved, there will be no need for the City to
retain the existing drainage and utility easement. The new sewer line and
watermain will be constructed within a new easement.
The right-of-way vacation is necessary to "clean up" the new plat. New right-of-
way is being dedicated to replace the vacated portion.

RECOMMENDATION
City Council action includes approval of two separate motions. Staff recommends that the City
Council adopt the following motions:
''The Chanhassen City Council approves a resolution vacating an existing drainage and utility
easement and right-of-way as shown on the Schneider Park 2nd Addition final plat, subject to the
following condition:
1. Legal descriptions of the areas to, be vacated must be supplied to the City for recording.
And,
''The Chanhassen City Council approves the preliminary plat and a resolution for the fmal plat for
Schneider Park 2nd Addition, as shown on plans prepared by Brandt Engineering and Surveying,
subject to the following conditions:
I. Revise the plans to state ''East line of the SW % of the SW %, Sec. 12, T. 116, R. 23".
2. Move the property line between Lots I and 2, Block 1, eleven (11) feet to the south to allow
for maximum flexibility for possible future additions or building on Lot 1.
3. The plat shall be revised to change the street name to Kerber Boulevard and show the
vacated street in the middle of the plat as City Center Drive.
4. The drainage and utility easement shall be labeled on the plat."
PLANNING COMMISSION UPDATE
The Planning Commission held a public hearing on May 7,2002, to review the proposed
development. The Planning Commission voted unanimously (six for and none against) to
recommend approval of the proposed subdivision subject to the conditions of the staff report.

WHEREAS, the City of Chanhassen has requested a subdivision of the property located
at 7700 Market Boulevard into two lots of 189,668 square feet and 130,891 square feet; and
WHEREAS, the proposed subdivision complies with all requirements of the Chanhassen
City Code; and
WHEREAS, the Chanhassen Planning Commission held a public hearing on May 7,
2002, and found the plan consistent with the Chanhassen Comprehensive Plan and Chanhassen
Zoning Ordinance and recommended approval of the subdivision,
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby

SUMMARY OF REQUEST: The city is proposing the replatting of Schneider Park Addition to create

LEVEL OF CITY DISCRETION IN DECISION-MAKING:
The City's discretion in approving or denying a preliminary plat is limited to whether or not the proposed
plat meets the standards outlined in the Subdivision Regulations and Zoning Ordinance. If it meets these
standards, the City must approve the preliminary plat. This is a quasi-judicial decision.

PROPOSALISUMMARY
The city is requesting preliminary plat approval replatting Schneider Park Addition into two lots. In
addition portions of public right-of-way for market Boulevard, West 78th Street and Kerber Boulevard as
well as a portion of unplatted property in City Center Park north of city hall will be incorporated into the
subdivision. The site contains approximately 7.4 acres of land zoned Office Institutional. The reason for
the replatting is to accommodate the proposed Chanhassen Library as well as the pedestrian plaza and
parking facilities surrounding it.
Public infrastructure is available to the site. Any grading or utility work will be undertaken as part of the
development of the new library.
BACKGROUND
On May 19, 1980, the City Council approved the platting, rezoning, site plan, and public improvement
project necessary to initiate the construction of the city hall and library. On March 25, 1988, the City
Council approved a 6,411 square foot expansion to city hall for the western side of the building. On
May 6,1996, City Council approved an 11,000 expansion to city hall, adding the area occupied by the
Building Division and Public Safety personnel as well as the level below it and the elevator, bringing the
building to its current configuration.
In November 2000, the Library referendum was approved by a margin of 70 percent for and 30 percent
opposed to the issuance of up to $6,000,000.00 in bonds for the construction of a library in Chanhassen.
The new library will be located on Lot 2, Block 1, Schneider Park 2nd Addition.
STREETS/ACCESS
Access to the sites will be from Market Boulevard and Kerber Boulevard. Portions of Kerber Boulevard,
West 78th Street and Market Boulevard will be platted with the subdivision. An extensive pedestrian
system will be incorporated around the library.
The plat shall be revised to change the street name to Kerber Boulevard and show the vacated street in the
middle of the plat as City Center Drive, formerly Coulter Boulevard.
LANDSCAPINGffREE PRESERVATION
Landscaping for the site has been done as part of the West 78th Street improvement, as part of the city hall
and city center park development. The balance of the landscaping will be done with the Library project and
community plaza.
GRADINGIDRAINAGE/UTILITIES/STREETS
All of the above issues are being addressed with the review of the proposed library building and site
improvements.

FINDINGS OF FACT
AND RECOMMENDATION
INRE:
Application of the City of Chanhassen for a Subdivision replatting Schneider Park Addition and an
unplatted parcel in to two lots.
On May 7,2002, the Chanhassen Planning Commission met at its regularly scheduled meeting to
consider the application of the City of Chanhassen for preliminary plat approval of property. The
Planning Commission conducted a public hearing on the proposed subdivision preceded by published
and mailed notice. The Planning Commission heard testimony from all interested persons wishing to
speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Office and Institutional District, 01.
2. The property is guided in the Land Use Plan for Public/Semi-Public uses.
3. The legal description of the property is: Lots 1 and 2, Block 1, and Lots 1,2 and 3, Block 2,
Schneider Park Addition and the Westerly 565.30 +/- feet by 204.99 feet of that part of the
Southwest Quarter of the Southwest Quarter of Section 12, Township 116 North, Range 23
West lying 660 south of the North line of the Southwest Quarter of the Southwest Quarter of

(7) The proposed subdivision is not premature. A subdivision is premature if any of the
following exists:
a. Lack of adequate storm water drainage.
b. Lack of adequate roads.
c. Lack of adequate sanitary sewer systems.
d. Lack of adequate off-site public improvements or support systems.

NOTICE: You are invited to attend a public hearing about a proposal in your area. The applicant, City of
Chanhassen, is requesting preliminary plat approval replatting Schneider Park Addition into two lots and
public right-of-way on approximately 7.4 acres zoned Office Institutional and located at 7700 Market
Boulevard, Schneider Park 2nd Addition.
What Happens at the Meeting: The purpose of this public hearing is to inform you about the applicant's
request and to obtain input from the neighborhood about this project. During the meeting, the Chair will lead
the public hearing through the following steps:
1. Staff will give an overview of the proposed project.
2. The applicant will present plans on the project.
3. Comments are received from the public.
4. Public hearing is closed and the Commission discusses the project.
Questions and Comments: If you want to see the plans before the meeting, please stop by City Hall during
office hours, 8:00 a.m. to 4:30 p.m., Monday through Friday. If you wish to talk to someone about this project,

City Review Procedure
Subdivisions, Planned Unit Developments, Site Plan Reviews, Conditional and Interim
Uses, Wetland Alterations, Rezonings, Comprehensive Plan Amendments, Code
Amendments require a public hearing before the Planning Commission. City
ordinances require all property within 500 feet of the subject site to be notified of the
application in writing. Any interested party is invited to attend the meeting.
The staff prepares a report on the subject application. This report includes all pertinent
information and a recommendation. These reports are available by request. At the
Planning Commission meeting, staff will give a verbal overview of the report and a
recommendation. The item will be opened for the public to speak about the proposal
as a part of the hearing process. The Commission will close the public hearing and
discuss the item and make a recommendation to the City Council. The City Council
may reverse, affirm or modify wholly or partly the Planning Commission's
recommendation. Rezonings, land use and code amendments take a simple majority
vote of the City Council except rezonings and land use amendments from residential to
commercial/industrial.
Minnesota State Statute 519.99 requires all applications to be processed within 60 days
unless the applicant waives this standard. Some applications due to their complexity
may take several months to complete. Any person wishing to follow an item through
the process should check with the Planning Department regarding its status and
scheduling for the City Council meeting.
A neighborhood spokesperson/representative is encouraged to provide a contact for
the city. Often developers are encouraged to meet with the neighborhood regarding
their proposal. Staff is also available to review the project with any interested
person(s).
Because the Planning Commission holds the public hearing, the City Council does not.
Minutes are taken and any correspondence regarding the application will be included in
the report to the City Council. If you wish to have something to be included in the
report, please contact the Planning Staff person named on the notification.
