As noted, the City approved the plans for reconstruction on May 9, 1988 (see staff report and minutes) . In Articles 3, 4 and 5 of the proposed agreement, the County agrees to bear all costs for construction and administration of this project. IIThe City is obligated by this contract to assume jurisdiction over the east leg of Foxtord Road when connected to County Road 14 and the new cul-de-sac which 1 will be constructed to serve the Peterson, Brandvold, Zimmerman, Lundeen and Burchett properties along the south side of Pioneer Trail. In addition, the County has asked the City to prohibit driveway access to County Road 14 for any I driveways that do not pre-exist January 1, 1989, and that only public street access and intersections be allowed (see Article 6). The City already has passed a no parking resolution for both sides of Pioneer Trail. This is con- sistent with the collector status of this roadway and is indeed the approach I that the City has utilized in approving plats for Riley Lake Meadows, Lake Riley Woods and Deerbrook, which connect to Pioneer Trail in this area. I therefore believe that these conditions are acceptable. IThe County has recently opened bids on this project and the low bidder, William Mueller and Sons, is at approximately $340,000. It is therefore recannended that the attached construction agreement for CSAH 14 (Pioneer Trail) be approved Iand authorized for execution. Attachments I1. Staff report dated May 4, 1988. 2. This is a Carver County Public Works project with no City financial participation. The project basically involves the removal of the sharp bend in the curve located near the Lake Riley Woods subdivision and vertical pro- file improvements including superelevation. The County ' s esti- mated construction cost at this time is $330 ,000 . This does not include an anticipated $125 ,000 expense for lowering of Williams Pipeline which runs through this area. Staff has worked with the County as the Lake Riley Woods and Riley Lake Meadows subdivisions have abutted this project area. The plans appear in order and provide for the necessary roadway transitions into Foxford Road and Meadowlark Lane. In all likelihood, this project will be constructed in 1989. Much of this timing hinges around Williams Pipeline ' s lowering of their main and the impact of the gas tax on funding for these projects. It is possible that it could start late this season. Staff finds these plans in order and our only concern is the detouring of traffic and the provision of local access to local residents. These items are yet to be worked out and we will remain in close contact with the County to see that these con- cerns are properly addressed. As noted in the attached letter from the County Engineer , the County is also asking the City to consider adoption of the attached no parking resolution for this roadway. The current average daily traffic for the roadway is 2900 vehicles with the future anticipated to be 4640 vehicles. In order to protect the minor arterial route status of this roadway , it is reasonable for the City to discourage parking along this roadway. .1 • ' Don Ashworth May 4, 1988 ' Page 2 It is therefore recommended that the City approve the attached construction plans for County Road 14 improvements by adopting the attached resolution. Further, it is recommended that the roadway be designated for no parking on both sides of Pioneer ' Trail from Trunk Highway 101 to the Hennepin County line at all times. Approval of the plans should be conditioned on the County establishing and enforcing a reasonable detour plan for the pro- ject which emphasizes the southerly routing of traffic through ' Great Plains Boulevard and U. SAP 10-614-02 ' BETWEEN CARVER COUNTY AND THE CITY OF CHANHASSEN ' THIS AGREEMENT , is made by and between the City of Chanhassen , a municipal corporation , organized under the laws of the State of Minnesota (City) , and the County of Carver, Min- ' nesota, a municipal corporation organized under the laws of the State of Minnesota (County) ; ' WITNESSETH : WHEREAS, the County and the City have been involved in discussions relating to the reconstruction of Carver County State Aid ' Highway No. 14 (Pioneer Trail ) from T.H . 101 to the Hen- nepin County Line, and WHEREAS, the County desires changes made to CSAH 14 for the benefit of the County and the City, and WHEREAS, plans for the reconstruction of CSAH 14 were approved by ' the City of Chanhassen on May 9 , 1988, and WHEREAS , the plans for the reconstruction of CSAH 14 include the ' construction of the extension of Foxford Road from the Lake Riley Woods Subdivision onto CSAH 14 and the con- struction of a new cul -de-sac onto CSAH 14 to serve ' property owners whose existing driveways are severed from a direct access onto CSAH 14 due to the realignment of CSAH 14, and ' WHEREAS, it is the desire of both of the parties hereto to enter into a written document regarding the reconstruction of said CSAH 14; NOW,- THEREFORE, Pursuant to Minnesota Statutes 471 . 59 and in con- e sideration of the mutual covenants and promises hereinafter contained , it is agreed by and between the ' City of Chanhassen and the County of Carver as follows: 1 . That this agreement shall apply only to the improve- ments of CSAH 14 (Pioneer Trail ) from T.H . 101 to the Hennepin County Line as per the approved construction plans for Project No. SAP 10-614-02 . 1 ' .1 2 . That the Carver County Engineer shall be the project engineer in charge, and that the County shall in all respects hereafter act as the contracting agent in the improvement of said road above described in ac- cordance with the competitive bidding requirements of Minnesota Statutes 471 . 345 and 375 . 21 . However, said improvement and said authority of the County are sub- ject to review and approval of the City as follows: a. ) The City Engineer must approve any plan changes on the construction of the extension of Foxford Road or the construction of the cul-de-sac. b. ) The County will maintain the project open to in- spection by the City Engineer or his duly authorized representatives. 3. That the County shall acquire at its expense all necessary permanent and temporary right of way and slope easements for the construction of said project. t 4. The County agrees to do all things necessary and bear all costs thereof for the reconstruction of said facility in conformance and accordance with current County State Aid Highway Standards as a two lane un- divided rural section with two-12 foot bituminous paved shoulders. The project shall be numbered SAP 10-614-02 . 5 . Funding the entire project including, but not limited to , all costs of right-of-way acquisition , utility relocations , maintaining and detouring traffic, con- struction , surveying , engineering and administration shall be the sole responsibility of the County . The method of financing the improvement project shall be the prerogative of the County . The City shall have no funding obligations toward the project. 6 . It is further agreed , that in applying its subdivi- sion regulations to development proposals abutting the portion of road included in this agreement, the City will allow direct access to CSAH 14 only via public street intersections. No direct access to in- dividual parcels from CSAH 14 that did not exist prior to January 1 , 1989 , or as a result of this con- struction project, will be permitted by the City. 7 . It is further agreed, that when the construction of Foxford Road and the cul-de-sac is completed , the City of Chanhassen shall assume full jurisdictional responsibility for these newly constructed road sec- tions. ,i ' 8. During the performance of this Agreement, the County agrees to the following : ' No person shall , on the grounds of race , color , religion , age , sex , disability , marital status , public assistance status, criminal record , creed or national origin be excluded from full employment ' rights in , participation in, be denied the benefits of or be otherwise subjected to discrimination under any and all applicable Federal and State laws against ' discrimination. 9 . Each party agrees that any modification of this agreement will be in writing and will be signed by the parties hereto. 10 . Each party understands the reconstruction project is scheduled to commence in and be completed in 1989 . In the event the construction of this project is not completed in 1989 , this contract shall be subject to renegotiation.
