IRe: Placement of Contaminated Fill within the City of Chanhassen

ITo Whom It May Concern:
This letter is to indicate the City of Chanhassen' s position on
I the potential dumping of contaminated soils within the City. The
City of Chanhassen will consider issuing a separate grading per-
mit to allow Mr. Mark Senn of the Marcus Corporation to rehabili-
I tate contaminated soils upon private property. A grading permit
for this work will only be considered after the PCA approves of
the methods the applicant proposes in their report.
IUpon PCA approval , the application would be submitted to the
Chanhassen City Council for consideration at its next available
City Council meeting . Although I cannot speak for the City
' Council , I would anticipate they would entertain issuance of a
separate grading permit if the applicant meets and abides by cer-
tain criteria as set forth by City Ordinances, Minnesota
IPollution Control Agency, and any City Council recommendations .

I Dear Governor Perpich:
I I would like to personally solicit your assistance in
removing the obstacles which have caused a six to nine
month delay in the completion of the TH 5 improvement
project in the Southwest Twin Cities suburbs.
I As you recall, it was your initial support in February,
1988, that elevated the priority of the TH 5
I improvements, so that completion could be realized in
1990, prior to the U.S. open.
Rosemount Inc. made a major business decision in
September, 1988, to build a 340,000 sq. ft.
manufacturing facility along TH 5 in Chanhassen. This
facility will house several of our major product lines
I and will employ 1, 000 people at occupancy in early
1990. The availability of access via TH 5 was an
important factor in our decision. I feel the two
I schedule delays, which were made public during the last
six weeks, present serious safety concerns for our
employees and for all Southwest corridor residents who
I utilize TH 5. A portion of the TH 5 project was to
provide signals, turn lanes, etc. at the intersection
of TH 5 and Market Boulevard (the main access to our
new facility) . The delay of the project significantly
I increases the risk of accidents and resultant injury,
at this intersection.
I . I appreciate your efforts on behalf of those who work,
and/or live, in the Southwest Twin City area.

Dear Commissioner:
' We have just become aware of the schedule slippage of the TH 5 improvement
project in the Southwest Twin City suburbs. Rosemount Inc. made a major
decision in late 1988 to build a 340,000 sq. ft. manufacturing facility in Chanhassen,
MN, just south of TH 5. A factor in that decision was the original schedule
committed to by the State for the widening and signalization of TH 5.
One thousand employees will initially occupy the new facility in early 1990 -- this
will put additional pressure on an already inadequate TH 5 road system. While we
are disappointed about any slippage from an inconvenience standpoint, the
' overriding concern with this schedule extension is the safety of our employees, and
other citizens who work, and/or reside in the Southwest Corridor. With the
addition of one thousand employees to TH 5 in the Chanhassen area, traffic signals
' at TH 5 and Market Boulevard with left/right turn lanes are mandatory to allow
safe access to, and egress from, our facility site. Rosemount Inc. experienced a
- similar situation several years ago in soliciting a traffic light at TH 5, and what was
' then West 78th Street. After numerous accidents, someone was fatally injured at
_ this unlighted intersection; only then were traffic lights finally installed. We do not
- --- want to see history repeat itself in Chanhassen.
We solicit your support in putting the. TH 5 improvement project back on schedule.
_ If it is impossible to recover the entire project schedule, we would request
' _ _ - consideration be given to completion of the TH 5/Market Boulevard
- intersection/traffic signals in early 1990 for safety reasons.

edition of the standards, and as such we welcome your comments and solicit your
cooperation in seeing to it that any private or public development work that
' your firm becomes involved with in the City of Chanhassen utilizes this document
as its basis for design.
' We believe this document is long overdue and hopefully will make your job and
ours, from a review standpoint, much easier and timely. We have tried to con-
form this document as much as possible with the current-used standards in the
industry such as the City Engineers Association standard documents and NnDOT.
I am sure there will be corrections and modifications to this document as its
useage progresses, and as such the City intends to provide you with periodic

Condition 12 of site plan approval provides:
' No building permits shall be issued to SuperAmerica until

' development starts on the shopping center.
Since the City has issued building permits for the shopping
center and since excavation has commenced, the developer had the
right to a building permit for the gas station. The term of
approval did not require completion of the shopping center before
the gas station could proceed.

Public Safety Team.
I All vacation time off requests should be routed through Scott
Harr to myself to include , vacation, comp time, and holidays.
As we discussed , these are new positions in the Department of
I Public Safety and there will be a lot of learning for all of
us. Hopefully we will make the best of it and streamline the
educational process as we go along. In that process we will
be developing your job descriptions.

SUBJ: Sidewalk Widths
This is to document a telephone conversation I had with Bob
Peterson of Midwest Paving ( 937-8033 ) concerning the approved
plan for Lake Susan Hills West 1st Addition which shows 5-foot
' concrete walkways. The City recently standardized a 6-foot width
for concrete walks. This is most important where the City would
be maintaining the sidewalk area such as in the downtown area.
' Since the Lake Susan Hills West sidewalks were not constructed
last year, they will have to meet the current 6-foot standard. ' I
therefore informed Bob Peterson that he should install the 6-foot
width concrete walk as planned. It is uncertain at this time
whether the City would be responsible for maintaining rural walk-
ways of this nature.

' Dear Mr. Jasin:
' Attached please find a copy of a letter report prepared by
William R. Engelhardt & Associates for the City relating to the
drainage issue from the Maple Ridge subdivision. As you are
' aware, over the past few weeks City crews have basically
completed regrading of the Maple Ridge retention pond, installea
54 feet of 12-inch diameter culvert and have installed over 40
tons of gravel to raise your driveway to a more serviceable ele-
vation . As I reported to you last week, the skimmer device is
being modified this week to properly retain flow during storm
events .
' The pond slopes will be reseeded soon for the re-establishment of
vegetative cover and this will basically conclude our efforts on
' this issue. As you are aware and as stated in Mr. Engelhardt' s
report, any modifications you intend for your property in this
area need to provide for proper conveyance of drainage from this
culvert through your property to the culvert on the southeast
' corner of your lot. We will be happy to work with you in this
regard if there are any questions you may have. I would concur
with Mr. Engelhardt ' s letter in that if there is a desire on your
behalf to further reroute the discharge water from this area away
from your property, that this would be at your expense.

The problems which Mr . Jasin experienced stem from two ( 2)
sources . One is the pond construction of Maple Ridge
subdivision. This subdivision is immediately North of the Jasin
property and directly adjacent to his driveway . The second
problem is the elevation and location of the Jasin driveway
itself . The driveway is low and crosses the natural drainage way
through his property.
The Maple Ridge subdivision is being corrected at this time.
The work involved is the reconstruction of the ponding area for
this subdivision to conform with the original plans and is 95
percent complete. The discharge pipe from the ponding area will
be connected to a pipe under Mr . Jasin ' s driveway thereby
conveying the pond discharge past his driveway . Additional
problems occur downstream, or South of the Jasin driveway . A
culvert installed by the owners of the property South of the
Jasin driveway has been silted in . Their problem will also be
corrected at the time of the pond reconstruction .
It should be noted that the area through the Jasin property
is a natural drainage way through which runoff is allowed to
flow. This drainage way should be maintained unless alternate
routes for the drainage are provided .
Mr . Jasin has requested that a storm sewer system be
constructed to re-route the pond overflow away from his property .
This could be accomplished by constructing a pipe system East
from the pond to Lake Minnewashta , along the North side of the
Jasin property.

7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
I 8 Section 1. Minnesota Statutes 1988, section 462.358,
9 subdivision 2a, is amended to read:
10 Subd. 2a. [TERMS OF REGULATIONS.] The standards and
' 11 requirements in the regulations may address without limitation:
12 the size, location, grading, and improvement of lots,
' 13 structures, public areas, streets, roads, trails, walkways,
14 curbs and gutters,, water supply, storm drainage, lighting,
15 sewers, electricity, gas, and other utilities; the planning and
16 design of sites; access to solar energy; and the protection and
' 17 conservation of flood plains, shore lands, soils, water,
18 vegetation, energy, air quality, and geologic and ecologic
19 features. The regulations shall require that subdivisions be
' 20 consistent with the municipality's official map if one exists
21 and its zoning ordinance, and may require consistency with other
' w 22 official controls and the comprehensive plan. The regulations
23 may prohibit certain classes or kinds of subdivisions in areas
' 24 where prohibition is consistent with the comprehensive plan and
25 the purposes of this section, particularly the preservation of
26 agricultural lands. The regulations may prohibit, restrict or

1 control development for the purpose of protecting and assuring
' 2 access to direct sunlight for solar energy systems. The
3 regulations may prohibit, restrict, or control surface, above
' 4 surface, or subsurface development for the purpose of protecting
5 subsurface areas for existing or potential mined underground
II 6 space development pursuant to sections 472B.03 to 472B.07, and
7 access thereto. The regulations may prohibit the issuance of
8 building permits for any tracts, lots, or parcels for which
9 required subdivision approval has not been obtained.
10 The regulations may permit the municipality to condition
' 11 its approval on the construction and installation of sewers,
12 streets, electric, gas, drainage, and water facilities, and
' 13 similar utilities and improvements or, in lieu thereof, on the
14 receipt by the municipality of a cash deposit, certified check,
' 15 irrevocable letter of credit, or bond in an amount and with
16 surety and conditions sufficient to assure the municipality that
17 the utilities and improvements will be constructed or installed
18 according to the specifications of the municipality. Sections
19 471.345 and 574.26 do not apply to improvements made by a
' 20 subdivider or a subdivider's contractor.
21 The regulations may permit the municipality to condition
' 22 its approval on compliance with other requirements reasonably
23 related to the provisions of the regulations and to execute
24 development contracts embodying the terms and conditions of
' 25 approval. The municipality may enforce such agreements and
26 conditions by appropriate legal and equitable remedies.
' 27 Sec. 2. (462.3597] (INTERIM USES. ]
28 Subdivision 1. (DEFINITION. ] An "interim use" is a
' 29 temporary use of property until a particular date, until the
30 occurrence of a particular event, or until zoning regulations no
31 longer permit it.
' 32 Subd. 2. (AUTHORITY. ] Zoning regulations may permit the
33 governing body to allow interim uses. The regulations may set
' 34 conditions on interim uses. The governing body may grant
35 permission for an interim use of property if:
' 36 (1) the use conforms to the zoning regulations;

1 (2) the date or event that will terminate the use can be
2 identified with certainty;
3 (3) permission of the use will not impose additional costs
4 on the public if it is necessary for the public to take the
5 property in the future; and
6 (4) the user agrees to any conditions that the governing
I7 body deems appropriate for permission of the use.
8 Any interim use may be terminated by a change in zoning
9 regulations.
10 Subd. 3. [PUBLIC HEARINGS. ] Public hearings on the
11 granting of interim use permits shall be held in the manner
12 provided in section 462.357, subdivision 3.

BACKGROUND: BRW had prepared a layout for the realignment of the north leg .
of TH 101. One of the key elements of the layout was the intersection of
X TH 101, West 78th Street, and the Soo Line railroad tracks. This intersection
I , area is somewhat unusual because of the presence of the skewed angle railroad
I crossing in the center of the street intersection.
n
This particular design feature was included primarily because it was suggested :
I
by Mn/DOT District 5 staff, based on information that a somewhat similar A.
kintersection existed in Moorhead and that the intersection in Moorhead was
operating adequately. In addition, the railroad had informed the City that t
I they would only approve a design that provided no more than one railroad
crossing, the number of railroad crossings that presently exist in the area.
I With these constraints, the design as a
g proposed was recognized to be less than t
perfect but it was considered to be the best possible alternative that
resulted in only one railroad crossing. The design was also considered to be
reasonably safe and was expected to provide a reasonable level of traffic
II operations.

II 1 After development of the layout, it was submitted to Mn/DOT's Office of t
Railroad Administration for review. Following this review a letter was sent t
from Robert Swanson, Director of Railroad Administration, to the City of
Chanhassen which indicated that Mn/DOT could not support this type of railroad li
'* grade crossing, primarily because of safety considerations. 4

As a result of this letter, a meeting was held on April 26, 1989, at Mn/DOT
District 5 to discuss the railroad grade crossing issue. Representatives of
Mn/DOT District 5, Mn/DOT Central Office Design/Traffic/Railroad
Administration, the City of Chanhassen, and BRW attended this meeting.
Following a review of•the original design plus a number of alternatives
' prepared by BRW, it was decided that the layout as proposed and the
alternatives would be submitted to Clem Kachelmyer for review and that
whatever layout Mr. Kachelmyer recommended would be subject to the following
' additional reviews:
1) Curt Gobeli, Mn/DOT's Traffic Signal Engineer, would review the layout to
• ensure that the adjacent street intersections could be adequately
signalized.
2) Mn/DOT's railroad grade crossing diagnostic team would review the layout
' and provide suggestions regarding recommended railroad grade crossing
protection.
' On May 5, 1989, Mr. Kachelmyer completed his review and indicated that he
could not recommend the original design because of safety considerations.
However, he could recommend the alternative that consisted of West 78th Street
crossing TH 101 on a 250-foot radius curve, provided that Mr. Gobeli thought
' that the intersections could be adequately signalized.
SUMMARY: Curt Gobeli had completed his review of the alternative
' designs and indicated the following:
—
o He has serious concerns about the original design regarding the possibility
of the railroad crossing signals restricting the visibility of the traffic
signals.
o Even though the similar intersection in Moorhead seems to be functioning
' adequately, he isn't sure that the same design in Chanhassen would work as
well because of higher traffic volumes , higher train volumes, and higher
train speeds.
' o The alternative design with the 250-foot radius curve on West 78th Street
is a much better design, should provide much better traffic operations
because of the greater separation of the West 78th Street intersection from
' TH 5, and the railroad grade crossing protection would very likely not
result in any visibility problems for the traffic signals.
' o The two railroad crossings that would result if the alternative design is
implemented do not present any railroad preemption problems. A recommended
preemption sequence for this type of design is shown in the Traffic
Control Devices Handbook on page 8-42. In addition, this type of
' preemption can be accomplished with standard traffic signal controllers and
without any special or unusual technology.
' It was concluded that Mr. Gobeli could recommend the alternative design and
that he would document his suggestions and recommendation on the layout and
return it to Alex Poletz.

request back to the Planning Commission with instructions to pre-
pare a revised site plan. The revised site plan should provide
the following information:

2 . Complete inventory of the items that are currently stored

3 . A proposal for which of these items will be located within
the building.
4. Shifting of the proposed building to the west away from the
' easterly lot line.
5. Submission of an elevation plan of the proposed building.
6 . Identification of where the property slopes to the south.
The purpose of the site is to evaluate your proposed building permit
application and revised site plan to determine whether you are in
' compliance with your conditional use permit for a contractor' s yard.
This item has been an issue for the past several years and action
needs to be taken either by yourself or by the City. Therefore, I
am requesting that you provide the revised site plan for the next
' Planning Commission agenda by June 12, 1989 . If a site plan is not
provided by June 12, 1989, then I shall have to refer your con-
ditional use permit back to the City Council for consideration of
' revoking your conditional use permit.

Our neighborhood is concerned about the blind curve on
Sandpiper Trail. Due to the large number of children who
' daily cross, play, bike, rollerskate and run in this
location we feel a "Slow Children at Play" and/or a "Blind
Curve Sign" is needed.
' The suggested location would be between Orchard Lane and
Minnewashta Woods Drive.
' We sincerely hope a sign or signs can be located in such a
way that drivers have time to slow down should a child or
adult be utilizing the roadway.
Please let us know what we can do to expedite the sign
placement process.

IIn response to your concerns regarding the application of Thymet
20G by Halla Nursery, I responded to the area to at least observe
I the odor. I will agree 100 percent that it is a very distasteful
odor. I then contacted Mike Shotliff, Carver County
Environmentalist, and explained what you had told me. Mike was
I successful in contacting the Minnesota Department of Agriculture
and in fact had a field agent respond to Halla Nursery to verify
the problem.
I I was not able to obtain feedback from either Mike Shotliff or
the Minnesota Department of Agriculture on Friday, however, on
Monday, May 22 , 1989, I did receive a call from Glenn MacTaggart
I from the Minnesota Department of Agriculture. Mr. MacTaggart
stated that he did respond to Halla Nursery on Friday and
investigated the complaint. He indicated that his investigation
revealed that Halla had applied the Thymet 20G in accordance with
I
the manufacturers specifications. He also indicated that Halla
is in fact a licensed applicator and that all procedures were met
during the application process.
IMr. MacTaggart did state that they will discuss the possibility
of making Halla obtain a commercial applicators license. He said
II this is an unusual case, however, in that most commercial appli-
cators are the businesses that contract to nurseries to apply the
insecticide. He said in this case it is the business itself that
is doing the application.
IHe also indicated that to his knowledge there is no danger of
ground water contamination from Thymet 20G since it goes up into
I the roots of trees. He did state though that he will attempt to
get more information on the possibility of ground water con-
tamination.

SUBJ: Lake Lucy Road Parking Permits
This memorandum is a follow-up on Eric Rivkin ' s ideas as
expressed in his letter of March 27 , 1989 as well as our staff
meeting outlining how the permit system would be established on
' Lake Lucy Road. Mr. Rivkin 's letter has a number of excellent
points which I do not believe were included in our previous
discussion. The following incorporates decisions made on March
' 28th including suggestions by Mr. Rivkin , i .e. :
Limit Permits and Maintain Statistics: You were to create a
' data base which could be activited by any of our Public
Safety personnel . Information such as name, address, date,
parking period valid for [date (s) ] , purpose, etc. would be in
the data base. Creation of the data base and training people
to use such was estimated by yourself to take a relatively
minor period of time. Upon receipt of a request ( telephone
call/letter ) , such would be entered into the data base and be
' printed on a special form or potentially simply standard City
letterhead. A second copy would also be printed on the offi-
cer ' s log or "Pass-on" slips. The permit would be mailed
' that day and could literally be in effect from the time of
calling through the duration of the permit period. Sending
the permit itself would solely be a form of verification
should the officers ' "Pass-on" logs end up not being passed
on. Additionally, requiring the permit to be sent to the
property owner would provide a sense of importance in con-
tinuing to call when parking was necessary; and
Control and Conditions of the Permit: The macro which will
print the permit should also print a standard conditions sec-
tion which would include parking to be limited to the north
side, no overnight parking, no daytime parking during periods
of snowfall when one inch or more of snow has accumulated or
within 48 hours after such snowfall , etc. ; and

Notification: Upon activating the permit system, a letter
' should be sent to all residents along Lake Lucy Road
notifying them of the necessity to call in for parking per-
mits and the rules of such. Potentially copying a sample
permit would be advisable; and
Reports: Depending on the number of permits being requested,
a report should be developed to advise this office/City
' Council as to the number and type of permits being issued. I
am anticipating that a quarterly report would be sufficient.
' If any of the above differs from our previous meeting regarding
how parking permits would be handled or if any portion of such is
not workable, please advise me as soon as possible.

Your May 4, 1989 letter concerning the T.H. 5 projects has been
' received.
As was stated at the meeting with the S.W. Corridor Coalition, the T.H.
' 5 projects were accelerated in April of 1988 from a November of 1991
construction letting to a June of 1989 letting as a result of efforts by
the Coalition. Mn/DOT did indicate that the June of 1989 letting was
unrealistic based on our expertise of having many years of experience in
' project development and delivery of projects similar to the accelerated
T.H. 5 projects.
' Since April of 1988, a significant amount of the project development
process has been accomplished with appropriate leadership and
responsibility by Mn/DOT personnel. That leadership and effort will
continue to accomplish as much as humanly possible toward the current
' March and June of 1990 lettings. The added effort of bi-weekly meetings
to coordinate the resolution of project issues will be of great
assistance in moving the project towards construction.
' Mn/DOT is very conscious of the national exposure that comes with the
U.S. Open and as much construction as possible will be accomplished with
appropriate steps to be taken for prevention of any embarrassments
during the U.S. Open in June of 1991. It was because of this concern
that the project was originally scheduled for November of 1991.

SUBJ: Quality Health Care vs. Costs - Business Health Institute
Seminar on Wednesday May 10, 1989
1 On Wednesday, May 10 , 1989, I attended the Business Health
Institute Seminar concerning quality health care vs. costs. The
Business Health Institute provided three dynamic speakers to pre-
sent their guidelines requiring quality standards in health care.
There wasn't a lot of information that would pertain to any cost
savings for the City of Chanhassen. I did note, however, that one
1 of the speaker' s description of health as a "value added" benefit
to employment. These five points were: 1) the City is committed
to health management; 2) the emphasis is on education and pre-
vention; 3 ) access to emerging technology is accomodated; 4 )
internal resources are available; 5) the City can use health
management as a competition advantage.
1 I think these five bullets can apply to the City of Chanhassen
and I think that it is evident by the new addition to the fire
station of a racquetball court and exercise area open to City
1 Employees. The second bullet that is stated indicates that an
emphasis is placed on education and prevention. I see the City
using this approach initially in their contract with the Business
1 Health Institute for the fire department. In addition, our
recent seminar on first aid attended by the Public Works
employees would certainly be considered educational, if not pre-
1 ventive.
The third bullet talking about emerging technology suggests that
as the technology becomes available it will be utilized as
1 necessary, i .e. magnetic resonance screening. The fourth bullet,
is where the Public Safety Department plays an intricate roll in
what we do best - Public Safety. We do have the resources
available to assist us in our health decision matters. Finally,

the fifth bullet states that we can use health management as a
' competitive advantage. Although cities are not necessarily con-
sidered competitive in the general sense, we are certainly com-
petitive in a tightening labor pool. If we can be the fore
' runners of health awareness for our employees, we can compete
better in the labor market. Certainly an advantage in health
care awareness is a higher moral, which quite often leads to
higher degree of productivity.

' I spoke with Ms. Laurie Simonson of 8006 Dakota Avenue ( 936-5035 )
today concerning when the Chanhassen Estates roadways are
scheduled for upgrading. I informed her that Council was in the
process this year of considering a feasibility study for Frontier
Trail improvements and the policies which would be established as
a part of that feasibility study would relate directly to
' improve-ments for the Chanhassen Estates roadways . I noted that
the City had done Road Rater evaluation of the roadways in this
area last year in anticipation of upgrading these roadways .
' I informed her that in all likelihood we hope to have a project
initiated for construction in 1990 for improvement of the road-
ways in the Chanhassen Estates area. This obviously would be
dependent on the Council ' s willingness to initiate an improvement
project.
When asked what the local neighbors could do to help get this
' project underway, I informed her that letters or petitions
showing support for these improvements would be helpful. I also
informed her that while a policy has not been set yet for funding
these projects , that I anticipated some portion of the improve-
ment would in all likelihood be assessed back to abutting pro-
perty owners .

' RE: MEMBERSHIP ON AMM LEGISLATIVE POLICY COMMITTEES AND
NOMINATIONS TO THE REGIONAL TRANSIT BOARD
1 . REGIONAL TRANSIT BOARD (RTB) NOMINATIONS.
Recent legislation reorganizing the Regional Transit Board
' provides that of the new eleven member board , eight shall be
appointed by the Metropolitan Council one each from the
various council districts per the enclosed map . Of these
' eight , at least two must be elected county officials and four
must be elected city or town officials . Various
organizations representing counties and cities , including the
AMM are required to provide the Metropolitan Council with at
least two nominations for each position .
This is a significant change from past philosophy. Recent AMM
' policy called for elected official direct participation on
the Regional Transit Board . Legislators, including the
principal authors , were concerned about the dedication and
' commitment of time by elected officials and only after several
strong assurances by AMM staff did they in fact establish an
RTB with a majority of elected officials.
' The new RTB in addition to its previous tasks and duties , has
regional planning and approval authority over LRT. Its
responsibilities will include coordination of all transit,
approval of LRT Grants , study and provision of increased
suburban transit opportunity and overseeing a new LRT planning
advisory group .
' A position on this new board will be challenging and will
require a commitment on the part of those serving to be active
participants. RTB members receive $50 per meeting not to
' exceed $50 per day and parking and travel expenses. The
current board meets twice a month late Monday afternoon with
subcommittee meetings following. However , meeting day , time
and frequency will be at the discretion of the new board . The
AMM board must make nominations to the Metropolitan Council
by the last week of June.

' 1 . METROPOLITAN AGENCIES COMMITTEE
Considers legislative issues and non-legislative issues related
to the Metropolitan Council and Metropolitan Commissions . Tne
Committee monitors the structure and relationship between the
regional entities and local units of government and reviews
amendments to Metropolitan Development Guide Policy Chapters or
' any new chapters developed . In past years , the Committee has
developed policy on land use planning, metropolitan
significance, solid waste management , Met Council selection
' process , etc . It also reviewes the council ' s yearly budget .
2. MUNICIPAL REVENUES COMMITTEE
' Considers any matter concerning revenues , taxes , and city
expenditures . Included are state aid formulas , state aid dollars ,
levy limits , property tax assessments , and fiscal disparities . The
' Committee will be looking very carefully at the effects of the
state aid formula and levy limit modifications as well as the new
net tax capacity rates and the balance of aids/credits between the
' metro and outstate regions .
3. HOUSING AND ECONOMIC DEVELOPMENT
Concerns itself with all issues related to economic development
and housing including subsidized housing , affordable housing ,
and activities of the Metropolitan HRA. Reviews all amendments
to the Metropolitan Council ' s Housing Guide Policy Chapter with
particular emphasis on low and moderate income housing concerns .
Will review legislation dealing with EDA' s , HRA' s , Tax Increment
Financing (TIF) and Development authorities .

Examine issues which have impact on metropolitan area cities
outside the scope of other AMM committees. In the past , this
Committee developed policy on municipal self insurance ,
' municipal consolidation , pensions , cable communications , PELRA
Amendments , Comparable Worth , etc .
' 5. TRANSPORTATION COMMITTEE
Studies all major issues related to transportation and transit
at the metropolitan , state and federal levels. The ten ( 10)
elected officials who represent the AMM on the Transportation
Advisory Board ( TAB) and the eight ( 8) city staff officials
who represent the AMM on the Technical Advisory Committee (TAC )
are encouraged to be members of this Committee along with other
city officials .

Our office is legal counsel for the City of Chanhassen. The
Chanhassen City Manager, Don Ashworth, has instructed me to send
this letter. The City of Chanhassen hereby agrees to undertake
the acquisition by negotiation or through eminent domain
proceedings the following described property in the City of
Chanhassen:
That part of the Southeast Quarter of the Southwest Quarter
of Section 12, Township 116, Range 23, described as follows:
Commencing at a point on the South line of said Section 12,
673 .5 feet West of the South Quarter corner of Section 12;
thence North 33 feet to the actual point of beginning;
thence East parallel with the South line of Section 12,
107. 00 feet; thence North at right angles 100 feet; thence
West parallel with the South line of Section 12, 107. 00

Our study and evaluation made for the limited purpose described in the first
Iparagraph would not necessarily disclose all material weaknesses in the system.
Accordingly, we do not express an opinion on the system of internal accountin g - r
control of the City of Chanhassen taken as a whole. However, our study and
I evaluation disclosed that a substantial portion of certain accounting processes are
performed by a single employee. Ideal conditions call for segregation of duties to
establish a system of internal testing of procedures performed. Additionally, our
evaluation disclosed that the City does not maintain a system of control over fixed
I assets. These conditions are common to cities of this size. Any modification of
internal controls in this area,however, must be viewed from a cost/benefit
perspective.

of the audit tests to be applied in our examination of the December 31, 1988
I financial statements and this report does not affect our report on the financial

statements dated April 14, 1989.
This report is intended solely for the use of the City of Chanhassen and should

The Tax Reform Act of 1986 created qualifications and discrimination provisions for employee
Ibenefit plans under Section 89. The legislation requires: 1) employee notification of essential
features of plans; 2) a "written plan" for which a definition has not yet been provided; and, 3) 11

testing for discrimination between "highly compensated" employees and other employees.

Regulations have been delayed and there is widespread dissatisfaction with the complexity of
Ithe law. Amendments to the law may be forthcoming. We recommend that the City monitor P
compliance with Section 89 provisions.
IForfeiture of Property - Public Safety II

I The 1988 legislature passed laws which allow local police departments to seize property which
is used during a crime associated with controlled substances. There are a variety of rules and
regulations included in Minnesota Statutes Section 609.53 related to circumstances under which
0 I property may be forfeited and procedures regarding disposition of forfeited property. There are
several areas which may impact the financial accounting records of the City, as follows:
1. Certain property may be retained by the law enforcement agency for 0
g y official use by
the agency or prosecuting agency. Under certain circumstances, the City may be

required to add these assets to any fixed assets records which the City retains
including insurance of such property.

2. 70% of the money or proceeds from the sale of the forfeited property may be retained
by the City for use in its operating fund or similar fund for use in law enforcement.
Certain other amounts must be forwarded to the County Attorney or other prosecuting
agency and 10% must be forwarded to the State Treasury for crime victim and
witness account.
We recommend that the City's Finance Department partment coordinate with the Police Department to
determine procedures to properly account for any property forfeited pursuant to the preceding
statute.
SUMMARY
During 1989, we recommend that the City:
• Monitor State actions which directly and indirectly affect the funding of City operations.

• Continue monitoring delinquent tax balances and anticipate the effects on long-term cash
flow projections. (Page 12)
• Consider budgeting for the use of franchise fees only after the amounts are received.
(Page 21)
• Continue efforts to monitor arbitrage compliance. (Page 29)
• Reflect MSA road maintenance costs in the General Fund. (Page 33)
• Continue timely updates of the City's Tax Increment Financing Plan. (Page 34)
• Continue monitoring the balance of the Tax Increment District#1 Fund. (Page 34)
• Close the South Lotus Lake Boat Access Fund. (Page 36)
• Continue monitoring the balance of the Old St. Hubert's Church Fund. (Page 37)
• Review the system of verifying deferred connection charges. (Page 38)
• Monitor the effects of changes in MWCC district structures and continue monitoring
MWCC billings. (Pages 42 to 44)
• Monitor compliance with Section 89 provisions. (Page 46)
• Coordinate Finance and Police Department procedures with regard to seized property.
