BOX 147 • CHANHASSEN, MINNESOTA 55317 I �, (612) 937-1900 IMEMORANDUM i "., .._. ---_-.-_— TO: Don Ashworth , City Manager •. :Ozi _,`3- -- I FROM: Gary Warren, City Engineer �\ _. ` , DATE: June 20 , 1989 a Ji9 ISUBJ: Consider Vacation of a Portion of Frontier Trail Right-of-way Donald King Property 1 File No. 89-6 Vacation Through the platting process for Chanhassen Vista 3rd Addition and Sunrise Hills 2nd Addition, the right-of-way alignment of I Frontier Trail has changed creating a triangular parcel of right- of-way no longer needed by the City ( see Attachment #1) . This parcel abuts the Donald King residence at 7200 Kiowa Circle . Mr. I King was interested in seeing that this triangular parcel be pro- perly maintained and therefore has requeste the City to consider vacating the right-of-way in this area. I It was initially intended that this vacation could be approved; however, at a late moment it was identified that the City water- main exists under this right-of-way area, Therefore, although 1 the City does not need the right-of-way , for' roadway purposes, the City still needs to maintain this right-of-way for utility ease- ment purposes . It therefore, unfortunately, is recommended that I this vacation request be denied based on the grounds that the City still needs to retain easement access ford its watermain utility. I Although this right-of-way will still appear on the City and County maps, I believe it should be the City ' s position to strongly encourage Mr. King to view this triangular parcel of I right-of-way as his own and that he be permitted and encouraged to maintain this property as if it were his own, similar to other properties where the City has easement rights but yet the pro- pperty owner is responsible for maintaining the general area.
