Purchasing Playgrounds & Picnic Shelter and CIP Budget Amendment
PROPOSED MOTION:
"The Chanhassen City Council approves the purchase of two playgrounds, four
park benches and a Poligon park shelter for Pioneer Pass Park from Flanagan Sales
Inc. and Little Tikes Commercial Playgrounds including supervised neighborhood
installation of the playgrounds in the amount of $95,000; and amend the overall
Pioneer Pass Park project CIP budget from $350,000 to $377,700 to accomplish
these purchases."
Approval requires a simple majority vote of the City Council.
BACKGROUND
On September 13, 2010, the final plat for Pioneer Pass Park was approved, including
an 8.7 -acre neighborhood park. The parkland was acquired using 5.2 acres in park
dedication and the cash purchase of 3.5 acres at a cost of $290,000.

$14,000 was accepted and the work on the backstop and player benches was
completed last fall.

DISCUSSION — 2014 CONSTRUCTION SEASON
Improvements slated for 2014 include the purchase and installation of the two
playgrounds, a covered picnic shelter and associated concrete borders, walks,
playground surfacing and benches. The completion of these items will require an
investment of $120,000. Adding in the remaining expenses associated with planning
and landscape architecture services, engineering, surveying and material testing
brings the total estimated project budget to $396,700. Subtract a $19,000 stormwater
budget payment that covered a portion of costs associated with the park's stormwater
system and the recommended amended total project budget is $377,700. Authorizing
this new budget amount will require a total recommended budget amendment from
the park fund of $27,700.
Six playground companies were invited to participate in the RFP process. Companies
are selected based upon past performance and equipment quality. Upon receipt of the
proposals, a meeting was held on March 18 with the neighborhood, Park and
Recreation Commissioners and staff to select the preferred playground and shelter
design for recommendation to the city council. The neighborhood committee
comprised of approximately 30 neighbors and children selected the playground and
picnic shelter design submitted by Flanagan Sales representing Little Tikes
Commercial Playgrounds and Poligon Shelters. The picnic shelter will be installed by
Flanagan Sales, hic. A neighborhood volunteer playground installation event is
scheduled for June of this year. The quoted price for the playground includes
supervised installation with Flanagan Sales, Inc. providing tools, auger and concrete.
This method of combining professional installers with neighborhood volunteers
utilizing appropriate equipment has proven to be very efficient and rewarding.
RECOMMENDATION
The Park & Recreation Commission reviewed this item on February 25 and
unanimously recommends that the city council approve the purchase of two
playgrounds, four park benches and Poligon park shelter for Pioneer Pass Park from
Flanagan Sales Inc. and Little Tikes Commercial Playgrounds; including supervised
neighborhood installation of the playgrounds in the amount of $95,000 and amend the
overall Pioneer Pass Park project CIP budget from $350,000 to $377,700 to
accomplish these purchases.

safety surfacing under and around the Equipment, in accordance with PPLT's product literature and the most current Consumer Product
Safety Commission Handbook for Public Playground Safety.
2: Default. Remedies & Delinquency Charaes� Customer's failure to pay any invoice when due, or its failure to otherwise comply with the
Terms of this Quote, shall constitute a default under all unsatisfied invoices ( "Event of Default "). Upon an Event of Default, PPLT shall have all
remedies available to it at law or equity, including, without limitation, all remedies afforded a secured creditor under the Uniform Commercial
Code. Customer agrees to assist its repossession of the Equipment and Customer expressly waives all rights to possess the Equipment after
an Event of Default. All remedies are cumulative and not alternative, and no exercise by PPLT of a remedy will prohibit or waive the exercise
of any other remedy. Customer shall pay all reasonable attorneys' fees plus any cost of collection incurred by PPLT in enforcing its rights
hereunder. Subject to any limitations under law, Customer shall pay to PPLT as liquidated damages, and not as a penalty, an amount equal to
1.5% per month of any payment that is delinquent in such month and is not received by PPLT within ten (10) days after the date on which due.

4: Restrictions: Until all amounts due hereunder are paid in full, Customer shall not: (i) permit the Equipment to be levied upon or attached
under any legal process; (it) transfer title to the Equipment or any of Customer's rights therein; or (iii) remove or permit the removal of the
Equipment to any location not specified in this Quote.
5: Purchase Money Security Interest: Customer hereby grants, pledges and assigns to PPLT, and PPLT hereby reserves a purchase money
security interest in, the Equipment in order to secure the payment and performance in full of all Customer's obligations hereunder. Customer
agrees that PPLT may file one or more financing statements, in order to allow it to perfect, acquire and maintain a superior security interest in
the Equipment.
6: Choice of Law and Jurisdiction: All Agreements between Customer and PPLT shall be interpreted, and the parties' obligations shall be
governed, by the laws of the State of Missouri without reference to its choice of law provisions. Customer hereby consents to the personal
jurisdiction of the state and federal courts located in the city and county of St. Louis, Missouri.
7: Title: Risk of Loss: Insurance: PPLT Retains full title to all Equipment until full payment is received by PPLT. Customer assumes all risk of
loss or destruction of or damage to the Equipment by reason of theft, fire, water, or any other cause, and the occurrence of any such casualty
shall not relieve the Customer from its obligations hereunder and under any invoices. Until all amounts due hereunder are paid in full,
Customer shall insure the Equipment against all such losses and casualties.
8: Waiver: Invaliditv: PPLT may waive a default hereunder, or under any invoice or other agreement between Customer and PPLT, or cure such
a default at Customer's expense, but shall have no obligation to do either. No waiver shall be deemed to have taken place unless it is in writing,
signed by PPLT. Any one waiver shall not constitute a waiver of other defaults or the same kind of default at another time, or a forfeiture of any
rights provided to PPLT hereunder or under any invoice. The invalidity of any portion of this Quote shall not affect the force and effect of the
remaining valid portions hereof.
9: Entire Agreement: Amendment: Binding Nature This fully - executed Quote, as supplemented by Change Orders and invoices containing
exact amounts of estimates provided herein, constitutes the complete and exclusive agreement between the parties. A Change Order is a written
instrument signed by the Customer and PPLT stating their agreement as to any amendment in the Terms of this Quote. Customer acknowledges
that Change Orders may result in delays and additional costs. The parties agree that all Change Orders shall include appropriate adjustments in
price and time frames relating to any requested amendments. Upon full execution, this Quote shall be binding upon and inure to the benefit of
the parties and their successors and assigns.
10: Counterparts: Electronic Transmission: This Quote, any invoice, and any other agreement between the parties, may be executed in
counterparts, each of which shall constitute an original. The facsimile or other electronic transmission of any signed original document, and
retransmission of any signed facsimile or other electronic transmission, shall be the same as the transmission of an original. At the request of
either party, the parties will confirm facsimile or other electronically transmitted signatures by signing an original document.

This site is a neighborhood park setting and the playground should offer a variety
of traditional play elements with added attention to aesthetics. Multiple roof
structures must be included on the playground structures. The park and
playgrounds are located immediately adjacent to Bluff Creek Drive. The
playgrounds will be highly visible from the adjoining neighborhoods. Colors and
an overall attractive appearance will be important to the selection committee.
Proposals can be submitted in color schemes selected and recommended by the

The picnic shelter and playground should complement one another in design,
architecture and color. The color of the shelter should match, closely match, or
complement one of the prominent colors utilized on the playground.
Total Project Budget - $95,000 or Less: The selected supplier shall enter into a
form of agreement to supply all products and services specified for $95,000 or less.
Designs must comply with all local, state and federal safety and accessibility
codes and/or guidelines.
All proposals are to be prepared at no cost to the City of Chanhassen. All
submitted materials become the property of the City of Chanhassen.
FORM OF RESPONSE
Written Response: Written responses to the RFP shall include two complete
plans and specifications listing all components for the structure. A three -
dimensional representation of each play structure in a 24 x 36 -inch format and
a top view plan are desired. The designs must include a transfer station and

accessible play route and accommodate the use of engineered wood fiber
safety surfacing. All proposals must include warranty information. Complete
written responses for each site must be received by 3:30 p.m. on Friday
Marchl4, 2014.
• Electronic Response: An electronic copy of the complete proposal package
including plans, component listing, top view plan, warranty information and
three - dimensional drawing must also be received by 3:30 p.m. on Friday,
Marchl4, 2014. E -mail is preferred.
SELECTION PROCESS
1. City staff will review each written response to ensure conformity with the RFP.
2. Neighborhood playground committee will meet to review proposals.
3. Neighborhood playground committee will recommend a preferred proposal to
the City Council.
