In addi- tion, sanitary sewer was extended to the northerly properties on Church Road as shown on the attached figure. The roadway I reconstruction was done at no cost to the City by the MWCC and therefore no assessments were necessary. The sanitary sewer, on the other hand, is to be assessed against the benefitting prop- erty owners. 1 The feasibility study which was accepted by the City Council on May 4, 1987 presented various options for assessing the bene- II fitting properties. With the current land use arrangement and the potential for further subdivision, the unit assessment policy has been recommended. This is especially appropriate recognizing I the Cathcart Park frontage on the west side of the road which is owned by the City of Shorewood. Two units are proposed for assessment against the park property in contrast to using the front footage of this property which would result in a con- IIsiderably higher assessment rate. The attached assessment roll dated October 20, 1989 reflects the I units proposed for assessment and the total assessment amount for the five properties in question. Similarily, the attached account summary presents the total project costs being assessed. I The attached notice of assessment hearing was published in the Chanhassen Villager on October 26, 1989. Individual notices were mailed to the specific property owners on October 20, 1989 as I noted by the attached mailing labels. Mr. Harry Campbell, owner of Parcel No. 25-0050700, has met with staff to confirm that he I I II Don Ashworth November 2, 1989 I Page 2 I indeed has the potential for another buildable lot on his pro- perty. This has been confirmed and the two-unit assessment against this property has been included. No other questions or I comments have been received by this office nor have any written objections to the assessment roll been presented as of the writing of this staff report. I It is therefore recommended that at the close of the public hearing, if there are no unresolved issues , that the City Council adopt the attached assessment roll for Project No. 87-5 dated I October 20, 1989 for certification to the County for payment of taxes beginning in 1990. ' An owner may appeal an assessment to the District Court pur- suant to Minnesota Statute Section 429 . 081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Chanhassen within thirty ( 30 ) days after the adoption of the assessment and filing such notice with the District Court within ten (10 ) days after service upon the Mayor or City Clerk. No appeal may be taken as to the amount of any assessment adopted unless a WRITTEN ' NOTICE signed by the affected property owner is filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Residents who are 65 years of age or older, or retired by reason of permanent and total disability may apply to have payment of the assessment deferred.
