Paul Oehme, City EngineerlDir. of Public Works\('( TO: FROM: Matt Saam, Assistant City Engineer Mf DATE: March 30, 2005 , _ O~· Vacation of Public Easements within the Pinehurst Plat/ Vacation File No. 05-01 SUBJ: REQUEST (Simple Majority Vote Required) Staff has received a request from Ploweshares Development, the developer of the Pinehurst subdivision, to vacate all existing public drainage and utility easements within the Pinehurst development. BACKGROUND The existing public drainage and utility easements were granted to the City as a part of the Old Slocum Tree Farm plat in 1987. The Pinehurst plat was approved by the City Council on March 14, 2005. DISCUSSION The underlying parcels of the Pinehurst property were originally platted as a part of the Old Slocum Tree Farm plat. As with all plats, standard drainage and utility easements along the lot lines were granted to the City. With the recent subdivision ofthe property into the Pinehurst plat, new drainage and utility easements have been dedicated to the City. In order to remove the old easement encumbrances on the new Pinehurst lots, the developer has requested that the City vacate the old easements. Staff has no objection to this since new easements have been granted. RECOMMENDATION Staff recommends that the City Council adopt the following motion: "The Chanhassen City Council approves a resolution vacating the existing public drainage and utility easements as defined on the attached vacation description.
