Mr. Roos is on the October 4, 1989 Planning Commission Agenda 1 for site plan review. The applicant has requested a grading per- mit be issued in advance of the site plan approval to complete the site grading before weather conditions turn for the worse. 1 The 3 . 9 acre site is located at the northwest corner of the intersection of Park Road and Park Place. The site consists of grassy meadowlands sloping from west to east. The area naturally drains towards the north and will be perpetuated by the proposed plan . An off-site ponding area that will be utilized was sized to handle the runoff generated from the site. ' Three access points are proposed, two on Park Drive and one on Park Place. Park Drive is a through street that functions as an industrial collector. Park Place is a short cul-de-sac which is 1 scheduled for upgrading next spring. Since Park Drive is a through street that functions as an industrial collector , it is recommended that the easterly access should be deleted. It 1 appears that the site can still be adequately served by the remaining two accesses . The plans propose Type I erosion control along the perimeter of 1 the east and north lot lines . It may also be necessary to extend.. . the erosion control on the south boundary for part of the site. Type I erosion control , i .e. silt fence, will be acceptable at 1 this time; however , if the City feels that this is not sufficient in holding back the erosion , the City will require additional erosion control in the future. i 1 X Gary Warren October 2 , 1989 Page 2 The grading plans are generally acceptable and therefore it is recommended that a grading and erosion control plan for 1450 Park Road dated August 31 , 1989 as prepared by Rehder-Wenzel , Inc. be approved with the following specific conditions being a part of the permit besides the general conditions set forth: 1 . All erosion control measures shall be in place before grading operations begin . 2 . The applicant shall pay the City ' s permit fees as required ' and shall provide the City with a cash escrow or irrevocable letter of credit from a bank in the amount of $7 ,700 before grading commences . The letter of credit shall be for a term ending October 1 , 1990 or until such time as a building per- mit is issued. 3 . The applicant shall receive Watershed District approval prior to commencement of any grading. 4 . Eliminate the eastern curb cut on Park Road and replace it ' with a maneuvering area for use by parked cars . 5 . Reduce the grade on the remaining Park Road access from 10% ' to around 5%. Da#e ICe41 En f L Approved by City Council ' Date 'Project Update from the Director of Planning ( 10-5-89) : The Planning Commission considered the site plan for the Rome Building at their meeting of October 4 , 1989. The Commission agreed with all of staff' s recommendations with the exception of the proposal to delete the eastern curb cut on Park Road. They ultimately recommended that the project be approved with the curb cuts as proposed as long as it was clear that no additional curb cuts would be permitted when the second phase building is pro- posed. The City hereby approves the permit on condition that the Developer abide by its terms Iand furnish the security required by it. 3 . Plans . The plat shall be graded in accordance with the following plans . The plans shall not be attached to this I permit. Time of Performance. The Developer shall complete the grading and erosion control by 4. / , 1989 . The Developer may, however , request an extension of time from the City . If an extension is granted, it shall be conditioned upon I updating the security posted by the Developer to reflect cost increases and the extended completion date . 1 5 . Erosion Control. Plan A shall be implemented by the Developer and inspected and approved by the City . The City may impose additional erosion control requirements if they would be beneficial . All areas disturbed by the excavation and back- ' filling operations shall be reseeded forthwith after the comple- tion of the work in that area . Except as otherwise provided in the erosion control plan , seed shall be rye grass or other fast- I growing seed suitable to the existing soil to provide a temporary ground cover as rapidly as possible. All seeded areas shall be mulched and disc anchored as necessary for seed retention . 1 The parties recognize that time is of the essence in controlling erosion . If the Developer does not comply with the erosion control plan and schedule or supplementary instructions received I from the City , the City may take such action as it deems appropriate to control erosion . The City will endeavor to notify the Developer in advance of any proposed action , but failure of I the City to do so will not affect the Developer ' s and City ' s rights or obligations hereunder . If the Developer does not reim- burse the City for any cost the City incurred for such work , I within thirty ( 30 ) days , the City may draw down the letter of credit to pay any costs. 6 . Clean up. The Developer shall daily clean dirt and I debris from streets that has resulted from construction work by the Developer, its agents or assigns . 1 7. Security. To guarantee compliance with the terms of this permit, the Developer shall furnish the City with a cash escrow or irrevocable letter of credit from a bank ( "security" ) for $ 7,71:)57- The banx and form of the letter of credit shall e subject to the approval of the City Administrator . Except as otherwise specified herein, the Developer shall pay all costs incurred by it or the City in con- junction with the grading and erosion control , including but not limited to inspection expenses incurred in connection with appro- val and acceptance of the permit. B. The Developer shall hold the City and its of- ficers and employees harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from permit approval and work done in conjunction with it. The Developer shall indemnify the City and its officers and employees for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorney ' s fees . C. The Developer shall reimburse the City for costs incurred in the enforcement of this permit , including engineering and attorney ' s fees. D. The Developer shall pay in full all bills sub- mitted to it by the City for oblications incurred under this per- . mit within thirty ( 30 ) days after receipt. If the bills are not paid on time , the City may halt all work and construction. 9 . Developer 's Default. In the event of default by the i Developer as to any of the work to be performed by it hereunder , the City may , at its option , perform the work and the Developer shall promptly reimburse the City for any expense incurred by the City, provided the Developer is first given notice of the work in default , not less than four ( 4 ) days in advance. This permit is a• license for the City to act , and it shall not be necessary for the City to seek a court order for permission to enter the land . When the City does any such work, the City may, in addition to its other remedies , assess the cost in whole or in part. 10 . Notice. The applicant must notify the City Engineer in writing a minimum of 48 hours prior to construction . 11. Watershed District Permit. The applicant shall comply with the conditions of the attached Watershed District permit , especially as it relates to seeding and restoration of vegetative cover . 12 .
