TO Gary Warren , City Engineer ;� lg .„ FROM: Dave Hempel , Sr. Engineering Technician DATE: October 2, 1989 nig5._ _ SUBJ: Request to Vacate a Portion of CSAH 14 Right-of-Way File No. 89-9 Vacation Attached is a letter from Mr. Bill Weckman, Assistant Carver ' County Engineer, requesting that the City vacate its interest over a portion of CSAH 14 street right-of-way, specifically along the area of Lots 1 and 2, Block 1 , Deerbrook. The vacation is requested because of concerns with the existing Williams Pipe Line. The County has agreed with Williams Pipe Line Company to reduce the current 50-foot wide right-of-way to a 45 foot wide right-of-way. Since CSAH 14 is actually under County and State jurisdiction and is not needed for City roadway or utility pur- poses , it is therefore recommended that the City Council approve a resolution vacating the City ' s interest over said parcels of Lots 1 and 2, Block 1, Deerbrook. CHASKA,MINNESOTA 55318 September 1, 1989 COUNTY OF CAINEQ Mr. Gary Warren City of Chanhassen 690 Coulter Drive P 0 Box 147 Chanhassen, MN 55317 RE: Vacation of a Portion of the CSAH 14 Right of Way Dear Gary: When the Deerbrook Subdivision was platted, the plat included a C.S.A.H. No. 14 right of way which was 50 feet south of the proposed new centerline of CSAH 14. Platting the right of way to the 50 foot width from centerline placed the petroleum products pipeline owned by Williams Pipe Line within the road right of way. The County has had numerous discussions with Williams Pipe Line concerning this problem. As a result of these discussions the County has agreed to reduce the right of way width in the area of Lots 1 and 2 in the Deerbrook Subdivision to 45 feet from the roadway centerline. Since the area was platted under the City's subdivision ordinance, vacation of a portion of the right of way will require a resolution for vacation from the City. Attached for your review and submittal to the City Council is a resolution from Carver County which vacates the County's interest in this portion of right of way along with a request for the City to do the same. Please review this information and, if acceptable, could you please request the City Council to pass a resolution vacating the interests of the City on the property described?
