Dejong, Finance Director l¡t¡j) DATE: October 5, 2000 SUBJECT: Assessment Contract with Carver County The Carver County Assessor has sent us a new contract for a two year period. The item cost has remained the same as the prior contract at $7.50 per parcel. I recommend that the city council pass a resolution authorizing the City Manager to enter into the contract for another two year period. The Assessor also included information regarding transferring the duties of the ·local board of equalization duties to the county board. This is a two-year agreement, as they have been in the past. The per parcel cost remains the same at $7.50 per parcel. ¡fyou want to continue your association with the Assessor's Office as you have in the past, please pass a resolution addressing this choice, sign the agreement, and return to our office by December 1,2000. Also enclosed is your 2000 assessment billing performed by this office as per your joint agreement which is payable to Carver County by November 15, 2000. Also enclosed is a copy of the LOCAL BOARD DUTIES TRANSFERRED TO COUNTY for your information. Any town board may transfer their duties and functions as a local board to the county board as stated within the paragraph. WHEREAS, the Town desires to enter into an agreement with the County·to provide for the assessment of property in said Town by the County Assessor's Office; and WHEREAS, the County desires to cooperate with the Town in that regard; and WHEREAS, M.S. 273.072 and M.S. 471.59 permit such an agreement for joint assessment; NOW, THEREFORE, in consideration of the mutual covenants contained herein, it is agreed as follows: 1) That the Town, which is situated in the County of Carver and which constitutes a separate assessment district, shall have its property within Carver County assessed by the Carver County Assessor for the assessment dates January 2, 2001 and January 2, 2002. All work necessary to the establishment of the estimated market value for each Carver County parcel in the Town shall be performed by the Carver County Assessor or by one or more of the licensed assessors under his/her direction and supervision. 2) It is hereby agreed that the Town and all of its officers, agents and employees shall render full cooperation and assistance to the County to facilitate the provision of the services contemplated hereby. 3) The Town shall pay to the County for the assessment of property within Carver County the sum of Seven and 50/100 dollars ($7.50) per valuation (for the assessment of January 2, 2001 and January 2, 2002) existing or created before the closing of the relative assessment year. 4) Full payment of all claims submitted by the County Assessor for relative assessment dates shall be received by the County no later than November 15th of the respective years. 5) The County agrees that in each year of this Agreement it shall, by its County Assessor or one or more of his/her deputies, view and determine the market value of at least twenty-five percent (25%) of the parcels within this taxing jurisdiction. It is further agreed that the County shall have on file documentation of those parcels physically inspected for each year of this agreement. 6) Data Privacy. Pursuant to Minn. Stat. Chap. 13, the parties agree to maintain and protect data received or to which they have access. No private or confidential data developed, maintained or received by the Town under this agreement may be released to the public by the Town. The Town agrees to indemnify and hold the County, its agents and employees, harmless from any and all claims or causes of action arising from or in any manner attributable to any violation of the Minnesota Government Data Practices Act by Town or its agents, assigns, or employees, including legal fees and expenses incurred to enforce this provision of this agreement. 7) Mutual Indemnification. Unless otherwise addressed in this Agreement, each party shall be liable for its own acts to the extent provided by law and hereby agrees to indemnify, hold harmless and defend the other, its officers and employees against any and all liability, loss, costs, damages, expenses, claim or actions, including attorneys fees which the other, its officers and employees may hereafter sustain, incur or be required to pay, arising out of or by reason of any act or omission of the party, its agents or employees, in the execution, performance, or failure to adequately perform its obligations under this Agreement. 8) It is understood by the parties that, pursuant to M.S. 273.072, this contract for Joint Assessment must be approved by the Commissioner of Revenue, State of Minnesota. - IN WITNESS WHEREOF, the CITY OF CHANHASSEN has caused this Agreement to be executed by its ChairpersonlMayor and its Town Clerk by the authority of its governing body by a duly adopted resolution on this the day of ,200_.. For Commissioner of Revenue DATE: 10/99 SECTION: 4110 PAGE: 4 The board of review or the board of equalization must complete its work and adjourn within 20 days from the time of convening stated in the notice of the clerk, unless a longer period is approved by the Commissioner of Revenue. No action taken after that date is valid. All complaints about an assessment or classification, made after the meeting of the board must be heard and determined by the county board of equalization. A nonresident may, at any time, before the meeting of the board of review file written objections to an assessment or classification with the county assessor. The objections must be presented to the board of review at its meeting by the county assessor for its consideration. (M.S. 274.01) LOCAL BOARD DUTIES TRANSFERRED TO COUNTY The town board of any town or the governing body of any home rule charter or statutory city may transfer its powers and duties under subdivision 1 to the county board, and no longer perform the function of a local board. Before the town board or the governing body of a city transfers the powers and duties to the county board, the town board or city's governing body shall give public notice of the meeting at which the proposal for transfer is to be considered. The public notice shall follow the procedure contained in section 471.705, subdivision lc, paragraph (b). A transfer of duties as permitted under this subdivision must be communicated to the county assessor, in \\Titing, before December 1 of any year to be effective for the following year's assessment. This transfer of duties to the county may either be permanent or for a specified number of years, provided that the transfer cannot be for less than three years. Its length must be stated in writing. A town or city may renew its option to transfer. The option to transfer duties under this subdivision is only available to a town or city whose assessment is done by the county. (M.S. 274.01, subd 3) ALTERNATIVE REVIEW OPTION The county shall notify taxpayers in the tOv.,l1 or city, whose town or city board elected to transfer its local or city board of review powers and duties to the county, that their attendance at the local board ofreview is no longer a prerequisite to tìling in tax court. However, prior to the time of the county board of equalization, the county shall make available to those taxpayers a procedure for a review of its assessments, including, but not limited to, open book meetings. This alternative review process shall take place in April or May.
