It appears from some of the coorrespondence that has been exchanged between Centex and the respective easement holders (see attached) , that not much progress has been made in the release of the easement rights as required nor has the barri- cade been erected as required. Therefore, unless directed otherwise by the City Council, the City Attorney and I will proceed as directed to effectuate the release of the easement rights of the property owners and complete the construction of the barricade as required. An appropriate draw will be made on Centex's letter of credit to adequately compensate the City for its expenses in completing this condition of the development. Attachments 1. Boyce, In reply to your letter of October 12, 1989, in which your firm offered $750.00 in exchange for a Quit Claim deed releasing our easement rights, Richard and I would like to state the following: 1. There should be no barricade at all. Any traffic generated by the new residents at the top of the hill in Curry farms would be considerably less than that generated for years when the Pat Jensen Stables were located at that end of Teton Lane. It is not reasonable to ask that long-time residents of Teton Lane give up (sell or otherwise) their regular access to their homes and busi' nesses. 2. If , and I hope not, we are f orced• to release our easement, we would request payment of at least $5000. 00 in return. We also request that all payments for all re- leases be identical. I don't think we should have it on the Consent Agenda there. TO me, as long as I pulled it I get to talk first. It seems like a very logical thing to do. I think we ought to go ahead and do it. I'd like to hear why we shouldn't. Mayor C3umiel: Would you like to make your presentation at this time? Please state your name and address. Daniel Cole: My name is Daniel Cole. I'm an attorney with Briggs and Morgan in the St. Paul office here representing Centex Homes. I really an not prepared to take your time this evening to explain why we don't think this is a proper item for the consent agenda. We have delivered a... Councilman Johnson: It's not there anymore so you can explain it. Daniel Cole: Pardon me? Councilman Johnson: It's not on the consent agenda anymore so you don't have to explain why you pulled it. Now why shouldn't we approve it? Daniel Cole: We are here tonight to request that this matter be tabled to allow the staff and the Council to review the information that we have prepared since we were informed on the 20th of the fact that this was going to be on the consent agenda. Mr. Tam Boyce of Centex Homes met on Friday with Don Ashworth to try to understand why this item was placed on the consent agenda -when the staff has known for same period of time that there's been a dispute about this item and to put it on the consent agenda seemed a little premature. We have delivered a letter which we hope people have an opportunity to read and think about the rights of the parties here before deciding this matter. We hope that the letter addresses most of the concerns. Without going into them in great detail, there is a development contract. There are other documents that have gone into this matter involving Teton Lane and same of the highlights of why we don't think the Council should take this action is among others, that we're talking an improvement. That is, finishing a barricade. Improvements are supposed to be completed by November 30, 1989. We're not at November 30, 1989. We don't think there's any default. There needs to be a default before a letter of credit can be called. We don't think there's an contractual obligation on 8 _ 1 City Council Meeting - ptember 25, 1989 ' - behalf of Centex to do what the City is now saying that Centex should do. That is somehow pay some money in connection with the alleged rights of land owners to compensate them for a taking. And we go into substantial detail on that. Thirdly, it was the City who told Centex to stop putting up the barricade. For the City to now call the letter of credit because the barricade isn't up, is somewhat of a paradox, to say the least. We think that this whole item should be reviewed. The idea of cost being incurred in connection with the barricade beyond the cost of physically putting up the barricade was not considered and we yX think that based on that, and if there are going to be costs, that the feasibility study should be reopened to decide whether that's what the City really intended in this matter. We would move at this point that this matter be tabled until the next meeting or whatever meeting the City Council sees fit after staff input to see if there is a way of resolving this. Centex continues to want to work with the City to resolve this situation. We think that there are some alternatives and we don't think that simply calling the letter of credit is going to solve the situation at this time and we'd hope that you would consider our letter. Thank you very much. Mayor Chmiel: You may want to stay there in case there are some responses that I'm sure there's going to be. I guess the only thing that I look at Mr. Cole is that this has been going on for almost 2 years without resolvement. I think it's time that something be grabbed onto and moved with that. At least that's my position. It seems that the letter of credit is going to be out by the end of November. Daniel Cole: I think it's the end of December. I'm not sure. I'd have to look at that but I think it's December 31, 1989. Don Ashworth: It could be. They have to complete the work by November and so I know it goes through that period. Whether or not December. Mayor Chmiel: I stand corrected. From what I was informed, .it was the later part of November and I guess that's really where I'm coming from. It should have been addressed before this period of time. Is there anyone else on the Council? Roger Knutson: I was just going to say. I looked at the letter of credit or a copy of it. It expires the end of December. Mayor Chmiel: It does? Okay. Councilman Johnson: Do we know if there's a condition anywhere'that they get the access issue resolved or that they purchase or whatever. Wasn't that a condition of the approval? Councilman Boyt: What we've got Jay is item (k) in the development contract. It talks about prior to the City signing the final plat, the roadway turn around be provided. Part of the closing off the road was having some place for trucks and other vehicles who were going to be plowing snow, to turn around at the barricade. It was, if I might interrupt for a second, Jay and I were both here the couple of times that this was talked about during the development contract. It was certainly an issue of concern for the neighbors that we not increase traffic and so the developer and the City Council and the neighbors agreed to resolve this by blocking off the road. There was some discussion that evening, 9 • City Council Meeting - September 25, 1989 as you point out, about the turn around and it got specifically put in the development contract. Since then I gather both the City and the developer have found out that it wasn't quite that easy but if you want to know what our intent was, it was to blockade that road. _Q; Daniel Cole: Well we should point out that we, we meaning Centex, has no EP k problem with the concept of blockading or barricading the road certainly on a ?y temporary basis. There is I believe Councilman, and I'd have to look at my notes but I believe that there is a, in the Minutes, a statement that you made indicating that, in 1988, that eventually Teton Lane is going to be a public road so no matter what we do here, we're talking about a temporary situation, and those Minutes are referred to in here. We agreed to barricade the road and that is a part of the development agreement. The feasibility study, which Alternative 4 was blockading the road, does not in any way address anything about cost over and above physically barricading the road. Neither does the development contract and there is a memo in here, which our client received a copy of, I believe from Mr. Warren to Mr. Ashworth which it's here. Indicating that when this was done, it was assumed that this was going to be done with the cooperation of the neighbors. He even mentions there, it says it's now somewhat frustrating that they won't cooperate apparently. All of this is in here. I mean the record is here as to what happened but plain and simple there is no contractual agreement that Centex was going to on it's own do whatever was necessary financially to pay whatever was necessary and we're not agreeing that it's necessary to pay anybody anything but if it was, that Centex took on that responsibility. There's no default on the part of the developer as far as we're concerned. Councilman Johnson: Mr. Mayor? Item (k) . The development contract that Bill was just talking to. SP-4 that you just gave us. The developer shall obtain on behalf of the City a 12 foot x 15 foot roadway easement. Have you done that? Tam Boyce: That's completed. That's right. That's separate. That's done. Daniel Cole: We're looking at (i) . Tam Boyce: We're looking at item (i) where it says barricade the road off. We went off. We agreed to acquire that easement. We did that. Daniel Cole: Item (i) says the developer agrees to upgrade Teton Lane in accordance with the approved feasibility study and plans and specifications at the developer's expense. It is further agreed that the developer shall reimburse the City for it's consultant's expenses and preparation of the Teton Lane feasibility study. If you go to the feasibility study, one of the items is barricading the road. Councilman Boyt: I'm sure that you understand the legal ramifications of all this more clearly than I do. I just, if there's any question about intent, and you raise that question, the intent was that the road would be barricaded. You and the City and the neighbors all accepted that intent and we're now looking at this situation in which week by week more and more people get used to using that as an access and an entrance. It's completing defeating the purpose of what we were trying to do and we need to have, we need to reach that intent. I'm not particularly happy about drawing down your letter of credit. I want to get the road closed and we can't close it because of the easement issues out there. We 10 ' City Council Meeting - "ptember 25, 1989 I +- need to get those resolved. 1r- Daniel Cole: You say the developer, the City and the neighbors all agreed to barricade. We agreed to barricade but if the neighbors are now unwilling to have that happen, then we think other things should be looked at. What we want to make clear is, we're not opposed to barricading the road. What we're saying is, we did not agree to be the ones bearing the sole and the whole cost of 1h x acquiring any sort of easement rights. Councilman Boyt: Well I'd like to make one more point then I'll turn the floor over to anyone else but I would follow the logic in this of a but for argument. We wouldn't have proposed the barricade if not for the development. Therefore, when the development comes in, the responsibility of settling that situation rests on the developer and I'm just saying that that's a logical response. Whether it's legal or not, I wouldn't be able to tell you. Daniel Cole: All I can say is I think there would be some serious dispute with that under contract law. Mayor Chmiel: Your letter of credit, going back to our original statement, does expire in December of 1989. The development contract although does expire in November of 1989. Daniel Cole: As I read the development contract, the improvements have to be in place by November 30th of 1989. Don Ashworth: That's correct. Daniel Cole: It's been almost a year ago that Centex was told to not put up the barricade. Now we can put that barricade up I think fairly quickly if we're told to do so. Councilman Johnson: Do it. Mayor Cbmiel: Not just by one person. Councilman Johnson: Then we'll go to court with the Natoli's and whatever. Mayor Chmiel: Roger, do you have something? Roger Knutson: Just briefly. First I've not read Mr. Cole's letter. I've glanced through it so I can respond to everything it says. I don't think this is a great forum to debate the fine points of what's right and what's wrong as far as the law goes but we do have a warranty deed from Curry Farms that says, they conveyed Teton Lane to us free and clear. It's not subject to any easements. That's what our warranty deed says and then you have the development contract. Again, I don't think this is the right place to argue what the law says. Councilman Johnson: I think we should send this to our City Attorney and tell him to handle it. Mayor Chmiel: Prior to any other. discussions... 11 . , City Council Meeting - Se-`ember 25, 1989 -_ r. Mrs. Natoli: Mr. Mayor? Mayor Chmiel: Yes maam. I have a couple of people in back there that are raising their hands. (5 Mrs. Natoli: We're all raising our hands. f 4, Mayor C oriel: Right and I will recognize those. Mrs. Natoli: I hope you're not going to table this for another year. Mayor Biel: I certainly hope not. Mrs. Natoli: It's been a whole year and it's getting ridiculous. I have a school bus going by. • Mayor Ciniel: Can I have the gentleman who raised his hand previously to cane forward. Would you cane up to the mic and state your name and address please and your position. Randy Carl: My name is Randy Carl. I live at 6391 Teton lane. I realize I've came in on an after the fact situation here. I'm a new homeowner up in that area. The lady mentioned that a school bus is now coming down the road. We were advised by the Minnetonka School District that a bus couldn't cane up that way to pick up the children if it had to turn around. Our children would have to walk a number of blocks to the closest bus stop because of the way the streets are designed so by blocking off Teton Lane, you're going to cause a safety hazard for school children and there are quite a number of very small children in that area that are now in school and other kinds that will be in school as the years go along. I don't know if this has any bearing on whether Centex owes the City any money but the issue of whether the street continues to be blocked off I think would have an impact on the safety of our children. Marc Simcox: My name is Marc Simcox. I live on Lilac Lane at the end of Teton Lane. We've been in the thick of this since the very beginning and I just want to reiterate. I think I talked to just about everybody in the last week that no one has changed their position as to whether Teton Lane should or should not be closed. I like to bring it up again that this is not a suggestion brought up by anyone at all except Centex. Centex Farms is the one that suggested this. They were the ones that suggested this to avoid building a third exit out onto CR 17. Every time that it's ever toward resolution, they've taken a new position and every time that it seemed that it was going to cost than 5 cents, they wanted to back up and start over again and blame the neighbors. Say it's their fault. It's everybody's fault except Centex Farms. The fact is is that they suggested this. They agreed to it. Part of that agreement was to turn over property that apparently they did not have clear title to and they did that. I think that they've stated their position enough times. Everbody's tired of it and just wants to see the whole thing end. No one there has changed their mind yet and that's all I want to say. Florence Natoli: If you ever get this solved I'll never cane to this place again. Mrs. Florence Natoli. Ccay. I went and drove around and there's no reason the bus has to cane. I don't know how the rest of you did but I thought back. I went to 8 grade schools, 1 junior high and 1 high school and the 12 ' City Council Meeting - •ptember 25, 1989 p'` shortest distance I even walked was 3 blocks. Okay. Today I went over and if you enter off of CR 17 caning from Chanhassen, you can go down Devonshire and you can pick up at Preeton Court which is on the corner of Devonshire. You can go over to Welsley Court and then you can leave via the exit onto Lake Lucy Road and it's a nice, a curvy road. It's not like ours where they're going 100 mph. We go have that 30 mph sign now but not too many people pay attention to it so there is no reason for them to say they have to use Teton. They haven't used Teton in a hundred years. It hasn't been a road. It was dead ended right at �X Mr. Mac's place. It was never used for that so to say that these kids are in danger is not true. They can use their bikes that they have to leave on a corner. It's all by itself. It's a nice neighborhood and I'm sure that one of the other neighbors would let them leave their bikes there but that is, when I saw that that really upset me but I've got a whole bunch of notes but I'm not going to go into it. As Marc said, we all agreed a year ago and this has gone on and on and instead of 100 people now as your count had, there's at least 200 to 250 cars going now. And it isn't only cars, it's trucks. A garbage truck went today. It wasn't our garbage truck. We gave the easement to Centex to turn in our driveway so if there was any reason to plow snow or any problem that happened, they could use it. Now across the street is where the fire plug is, the water, and so there's no reason for the Chanhassen people to go all the way up Lilac Lane and came down Teton to go to that fire plug in case a fire. That was the reason for the barrier so it would be used as a fourth place to get the people out in case of trouble. Now these are all the things we went through a whole year ago and I just hope you'll get it solved and get it solved tonight because Centex agreed along with the rest of us, and if they haven't gotten . these easements, it's not my fault. They got mine about 1 week after. We've had ours a whole year and if you're not going to close the road, we want our easement back and we want a fence in the front of our house to keep everybody - out. So that's all I've got to say. Councilman Boyt: I have a possible motion. Mayor Qniel: Anyone else? Okay, Bill. Councilman Boyt: I would move that the City make plans to draw down the letter of credit effective November 31st. If Centex hasn't resolved this situation, that the City then draw down the letter of credit, acquire the easements and block the road. Councilman Johnson: How about December 1st? There is no November 31st. Councilman Boyt: Sure. Oh, you're right. Fine. You've got the holes in the road. We ought to get it blocked off. Councilman Johnson: I'll second that. Don Ashworth: I would like to have same form of a progress checking. In talking with the developer on Friday, he felt that if he were given permission to meet with the owners, that at least he might be in a position of advising the City as to whether he thought he could obtain those easements without same of the burdens that we were looking at. I still think that's a good process. I'm not changing the date but I guess I would like to see this item or the developer be encouraged to continue that meeting schedule that I had set up with him. In other words, within 2 weeks that he be responsible to inform myself of his 13 ' 'City Council Meeting - Se tuber 25, 1989 ) progress and if at any point in time prior to that December 1st date, I feel that he has not been moving forward, that I would have the ability to bring that item back to the City Council to potentially move it up even sooner. � j Councilman Johnson: He's making a good point. He's not breached until November - 57 e30th. If it's November 29th and he gets the easements or whatever he has to .. get, then he's fulfilled his contract? Is that reasonable to say? Daniel Cole: The only comment I'd like to make here is that what we object to in this is that somehow this is all Centex's problem and we do not see it that way. Without the City cooperation in getting involved in this, we don't think that it can be accomplished. It's my understanding that the neighbors, the "neightbors" who had agreed to this, now do not agree. It doesn't take many to not agree. Councilman Johnson: The City has been involved with this. We've been fighting t this. We're sick and tired of this. Okay? There has not been a lot of cooperation. Daniel Cole: So does that mean we have to pay? Is that what is being said? Councilman Johnson: I think you should have been brought on board a long time ago when Centex was here without you saying that they would do this stuff. Now they're bringing in the lawyers saying well we don't have to do it. Daniel Cole: No, no. It's because you're drawing the letter of credit. That's why we're here. Councilman Johnson: Well yeah. That's the way we're trying to force them to do what they've told us they're going to do. Daniel Cole: You should do it by the development agreement however. Mayor Chmiel: Let me, this is not an argumentive position here. We're not in a court of law so consequently I would just...We have heard from Mr. Ashworth presently. Is there any further discussion on that? Councilman Johnson: Can you think of an easy way to modify your motion to provide? What Don wants is a little stronger to where we say we want to see action... Councilman Hoyt: We can have a time table and adequate progress being shown on the time table and that that time table should be planned to have this issued resolved effective November 30th. If it's not, as of December 1, we will act on whatever rights we have under the letter of credit to resolve the issue. Councilman Johnson: Okay. I'll modify my second then. Mayor Chmiel: Okay. Roger, did you hear the modification that we had to the... Roger Knutson: You want periodic updates on progress reports. Mayor Chmiel: Right. All voted in favor and the motion carried. O. APPROVE PURCHASE AGREEMENT FOR SALE OF PORTION OF MURRAY HILL WATER TOWER SITE TO GILBERT AND JILLENE KREIDBERG. Councilwoman Dimler: I pulled item (o) because there is someone in the audience that would like to address that and I wonder should they do it now or go to visitor's presentation? Mayor Chmiel: We can do it right now. Either now or later. Councilwoman Dimler: Okay. Mr. Wayne Fransdal would like to speak to that issue please. Wayne Fr_ansdal: My name is Wayne Fransdal. I live at 6200 Murray Hill Road. First of all I'd like to thank you for moving this from the consent to the discussion agenda. I appreciate the opportunity. My primary concern is with the procedure used for the proposed sale. First of all, was there a public offering or notice of the proposed sale? As far as I know, none of the neighbors north of the property that was proposed for sale weare informed or aware that the property was for sale. Was a study completed over the future use of the property and was the property deemed surplus? Has a public entity, what is the procedure for selling public property or public goods? How is the price determined? If the property is sold, what is the adequate size to be retained and what is it's purpose? In the past, many years ago, I attended Council meetings when the school district has asked the City to discontinue use of their easement on the city property for access to the water tower. Tb use the access from the road. At that time the reason for not using the road was it was a private road. It's now a public road and yet access is still from the school property. The question from the school is, and rightfully so I•would think, is why should we provide access when they're going to sell off their own. Why don't they use their own access from a public road? If the land is sold, are there any restrictions or can there be any restrictions on the future use of the land? Could there be a variance for a home for a small lot? Could it be used or restricted for outlots? Could it be restricted at all? As I said, my primary concern is the procedure. I agree with delegating to the lowest possible level. Let adminstrative people do what they need to do but there should be due process so that everyone has an opportunity, so that everyone knows what the City is doing with the people's resources. Mayor Chmiel: Thank you. 15 f Lori Sietsema November 27, 1989 Park and Recreation Coordinator City of Chanhassen 690 Coulter Drive P.O. Box 147 Chanhassen, Minnesota 55317 Dear Lori, You may remember a few months back when I contacted you concerning petitioning support for the proposed Herman Field neighborhood park in northern Chanhassen. Well, between my numerous other activities, I finally managed to visit about 30 homes in my immediate neighborhood. In all but two cases, the citizens eagerly supported the attached petition. The two who didn't, supported a park in general, but were not sure about specific amenities. Attached are two copies of the petition and signatures. Please use this petition as a vote of confidence that our neighborhood does indeed want the park. Also, please present It to the City Council or those responsible to get our park construction going early next spring. Residents of Chanhassen, Minnesota Interested in Herman Field Neighborhood Park Petition Dated October & November 1989 WHEREAS, Herman Reid is a thirteen acre park donated by the Herman Family to the City of Chanhassen with the stipulation that it should be used for park purposes; and WHEREAS, $35,000.00 was dedicated for the park in 1978 ; and WHEREAS, the City of Chanhassen has designed a number of park plans for the development of Herman Field since that time; and WHEREAS, action to develop the site has been delayed due to controversy over the access; and WHEREAS, even with simple interest of 8% compounded annually, $35,000.00 allocated in 1978 would have accrued to nearly $65,000.00 today; and WHEREAS, the concerned residents of this area bordered by Highway 7 to the North, Highway 41 to the East, Lake Minnewashta Regional Park fence/non- accessable areas to the South, and the West, really have no similar recreational amenities without crossing busy Highways 7 or 41; and WHEREAS, the survey conducted by these neighborhood residents in June of 1989 indicated a high use rate (66 % indicated both spouses would use the park, 57% indicated that they had children who would use the park); and WHEREAS, demographics shows a reasonably broad distribution of ages of neighboring residents, including a significant number of young children who would use the park as safer alternative than playing in the street; and NOW THEREFORE BE IT RESOLVED that we, the concerned dtizens of.the neighboring area of Herman Field, request that the City proceed with the construction of the modified plan B approved at the August 29, 1989 Park and Recreation Commission meeting without further delay; and BE IT Further RESOLVED that we request $30,000.00 be budgeted in the City's fiscal year 1990 for development and construction a second phase of the park, which would include paved biking trails, paved biking access from Forest Avenue, a tennis court, a ball field back-stop, and a picnic shelter. The letter states that you are in the process of making amendments to your budget so that a check in the amount of $5,700 can be sent to the City for the purpose of funding the Chanhassen recycling program through 1989. You further state that before the actual check will be sent, you would like to clarify the specific action of the Carver County Board so that future misunderstandings or problems can be avoided. The motion to approve the funding for the $5,700 was contingent upon Chanhassen developing an internal funding mechanism to pay for the program in 1990 and that the County expects a firm comittment from the City to the recycling program for the entire year of 1990. On November 20, 1989, the City Council approved the first reading of an ordinance requiring all licensed haulers in Chanhassen to collect recyclables on a weekly basis. The second and final reading of the ordinance will be reviewed by the City council on December 4, 1989, and will .go into effect190 days after publica- tion, approximately March,- 1990. ° 'this action and past action by the City shows a firm commitment`by the City•to continue to pro- vide recycling programs to the residents of Chanhassen ttirough 1990 and beyond. ` Although the ordinance amendment requires that the collection of recyclables be the responsibility of haulers within Chanhassen, the City of Chanhassen will still be responsible for funding public education, recycling containers, special pick-ups, etc. The recycling program that Chanhassen is providing fulfills Carver County' s obligation to provide at least one/month curbside pickup of recyclables by October October, 1990. As we both have seen, the cost of one/month curbside pickup can cost as much as every other week pickup. By having Chanhassen provide the recycling program, Carver County is being saved a substantial Mr. Mike Lein ri November 27, 1989 Page 2 amount of money. In fact, until the new program can be imple- mented in March, 1990, the City will have to expend $24,300. With this in mind, Chanhassen will continue to work with you to receive funding from Carver County for 1990 and future years. Please keep me in touch as it becomes more definite as to how much money Carver County will be receiving as part of the SCORE Legislation and how much will be distributed to cities in Carver County. I hope this letter clarifies the City's intent to continue a recycling program through 1990 and beyond and hope you can now process the check for $5,700. Jim reminded everyone that hours are 8:00 to 4:30 unless special circumstances arise. Dumpsters: It was observed that the dumpsters at City Hall con- tinue to be overflowing, with garbage blowing about the neigh- - borhood. Also, there is garbage in the dumpster area along sides of City Hall , but the dumpsters are yet to be moved. This con- cern will be forwarded to Todd Gerhardt. Heat: Carl will be assisting in finding a remedy for the furnace problems at the Fire Department, as well as the temperature problem with Jean Meuwissen's office. New Inspector: The status of this was discussed, hopefully with an offer being rendered shortly. Fire Department News: Mark Littfin asked about fire alarm per- mits, and this will be checked with Deputy Peddycoart to see whether the County and City permit system includes fire alarms. Mark asked whether Lori or Carol could give a phone lecture at an upcoming fire department meeting, and he will get with them on this. She also asked whether sand could be obtained for the back door outside ramp, and Kirchman will be taking care of this, along with getting a shovel and window scrapers. Building Permit Procedures: Steve questioned whether a "24-hour policy" should be implemented so that applicants would be aware that they may not be able to get immediate inspections. WHO CAN ISSUE CITATIONS? Any Public Safety staff member. II . FOR WHAT VIOLATIONS CAN CITATIONS BE ISSUED? Chanhassen City Code makes any code violation a criminal misdemeanor. A misdemeanor is punishable by a maximum $700.00 fine and/ or 90 days in jail. A court appearance is required, and it would be our request that the court require that the viola- tion be remedied. III . HOW ARE CITATIONS DELIVERED? Constitutional' due process requires the defendant to actually receive the citation. Therefore, personal service of the citation, with an acknowledging signature from the defendant is ideal. While first class mail may also suffice, When we send citations by mail, they will be sent certified mail so that we have a record of receipt. The issuing Public Safety staff member may personally give the`defendantkhe citation, or our CSO's or a Deputy can_aiso iv+A,,th IV. WHAT INFORMATION IS REQUIRED ON THE TAG? All applicable and available data should be provided on the =nation including full name (first, middle, °)iast) ' address, birthdate and driver 's license number (if possible) . If we do not have this data on file, one of the support service personnel can request an alphabetical chkck from the Department of Public Safety to acquire this data. Also include the date and time of the violation, the location, and the specific violation (for a city ordinance, circle municipality, and site the City Code section and briefly state it) . For the issuing officer, write Chanhassen Public Safety, and your name (you can include your Chanhassen radio number for the number spot) . Citations ... Page Two otr- V. DO THEY HAVE TO SIGN IT? No, as long as ve can prove they received the citation. VI. WHAT ABOUT SETTING A COURT DATE? County Court dates are set on each Monday at 9:00 a.m. You should usually assign a date about two weeks away. VII. WHO GETS THE COPIES? The defendant gets the hard copy; ve keep the bright yellow copy; and the remaining copies are sent to Carver County Court (these should be given to Carol Dunsmore to be sent to Court, and she will usually give these to a CSO or deputy for delivery) . VIII.WHO HAS TO SHOW UP AT COURT? Only the defendant needs to appear for the first appearance (this is called an arraign- sent, at which time the defendant merely pleads guilty or not guilty; however, it may be disposed of by the court at this time) . If there are extenuating circumstances, you may request that our City Attorney appear on our behalf. Our City Attorney's office does not routinely attend arraign- ments, but will do so if ve so request. IX. WHAT FINE WILL THE COURT IMPOSE? While the court has the option of imposing a fine and/or Jail time, the fact of the matter is that mere code violations are seldom viewed with great interest by the judges. Therefore, a small fine and an order to remedy this situation is the most likely outcome . If, however, there are extenuating circumstances, severe safety implications, etc, you will want to consider having the City Attorney present. A problem that always needs to be considered is that the Judge viii not understand the circumstances, or even the necessity for that particular code section, and may dismiss it, which they: do have the power to do. Therefore, sufficient reports are an absolute must! X. WHAT REPORTS ARE NECESSARY? If ve are going to go to the extreme situation of issuing a criminal citation to someone, ve owe it to them to have developed a sufficient paper trail so that it is clear that they knew there was a problem, and refused to respond. Particularly if you request the City Attorney to appear at the arraignment, and certainly if the matter is scheduled for trial, you will need to provide detailed reports, copies of the lay, etc. You should include your subjective comments as well, which may well include the attitude of the party, the efforts you took to solicit voluntary compliance, and why it is important that this particular code section be enforced. XI. DO THESE EVER GO TO TRIAL? Only on rare occasion. These types of violations could conceivably go to a jury trial, but usually a plea bargain is reached beforehand. If, however, a matter does go to trial, you should be sure to meet with Jim Chaffee and/or myself, as well as the City Attorney beforehand, to prepare for the case. Citations Page Three XII . This memo was prompted by a letter received from the County Attorney regarding illegal tobacco sales to minors. Realizing that certain pseudo pornographic magazines and certainly alcohol sales also undermine the moral fabric of our; ity's youth, Don Ashworth expanded on the County Attorney's letter to include a`].cohol and illicit magazines. We have since received an opinion from our City Attorney Roger Knutson who indicates that all three of these issues are piisently controlled under state law. There are 50 different ways in which the above objectives could be similarly met, i .e. .the form being of post card size and having the rules printed on such and then being required to be signed by the employee/dated/etc. As I think about it, I think this latter idea has more merits than the first suggestion. In any case, I think that the objectives from the County/Sheriff are admirable; that the scope of the program should be expanded; and that, to be effective, procedures need to be tightened so as to make the owner fully responsible for any acts committed by employees. If he has properly insured that the managers have submitted signed cards acknowledging their responsiblities as managers, the owner's liability could be limited. Similarly, the manager's liability would be limited if they can demonstrate that they have properly instructed employees and that signed cards to such effect are on file. If at the end of that process our upstanding young adult still proceeds with carrying out an ille- gal sale, then I think we both agree he should be prosecuted. However, until such time as those procedures are in place, I will continue to believe that the Holiday' s/Kenny' s will take a more lackadaisical view regarding any notices sent to them. Since you are responsible for the issuance of tobacco sales licenses in your jurisdiction, it is particularly important that you are aware of recent legal and policy developments in Carver County. First, the Minnesota legislature has enacted a bill which amends Minnesota Statute 609.685 by adding a new subdivision: "Whoever sells tobacco to a person under the age of eighteen years is guilty of a gross misdemeanor". A gross misdemeanor is punishable by up to a fine"of $3,000 or one year in jail. "Tobacco" is broadly defined to include cigarettes, cigars, loose tobacco, snuff and chewing tobacco. Carver County law enforcement agencies are responsible for enforcing this law. Please apprise those who hold tobacco licenses in your area of this new law. It would be wise for tobacco license holders to review their tobacco sales policies. For example, any and all employees who have occasion to sell tobacco should be informed of the new law. Cigarette machines should be placed where supervision is practicable. While these machines may present enforcement problems, it is anticipated that cooperation will help frustrate juvenile access. Depending on the factual circumstances, it is possible that the gross misdemeanor penalty may apply to an employee who actually sold the product and/or owner or manager of the establishment. The Carver County Attorney's Office has the further responsibility to notify city and township clerks of gross misdemeanor violations. Since the City licenses the sale of alcohol and tobacco, we could amend the City Code to require signed statements from license holders and their employees. We do not and cannot license the sale of magazines. The sale of "illicit" magazines to minors is prohibited by Minn. Stat. § 617.293. Since we cannot license magazine sales, we cannot require sellers to sign a statement as a condition of making sales. Since the sale of alcohol, tobacco and "illicit" magazines to minors is already a crime, ordinance amendments are probably not necessary. The problem areas are education and enforcement. I suggest that the City send or hand deliver letters to sellers of these products explaining the law, recommending that all employees be informed of it, and informing them that the law will be enforced. You will note that calls for service for both the police department and the fire department are lower than what they were this time last year. This is partially attributable to the crime prevention efforts put forth by our Crime Prevention officer and the Carver County Sheriff's Department. This is not a trend, however, that I would look to continue. As our population increases, these trends will, out of sheer reality, continue on an upward trend. Calls for ser- vice, I should point out, does not necessarily mean crime. This could be indi- cative of medical calls for service, assists of several different natures, and traffic accidents. Our crime prevention efforts do, however, point to a more gradual increase, rather than a meteoric rise, in coniunctibn with the rise in our population. It was also interesting to note that the Fire Department calls for service are down from what they were last year. Again, this can be attributed to the fire education efforts by the Fire Department and the Fire Inspector Mark Littfin. Also, this is a trend that I would not look to see continuing. As the popula- tion increases, so will our calls for service in response to fires and fire related responses. BUILDING: During September and October the Building Division 'issued'23 and 17 single family permits respectively. As of October 31, the Building Division has issued 252 single family permits. This compares with 286 single family permits issued as of October 31, 1988. Total permit revenue as of October 31, 1989, is $537,881.00. This compares with $393,043.00 as of October 31, 1988. POLICE: During the months of September and October, the Police Division responded to 403 and 397 calls for service respectively. Total calls for ser- vice as of October 31, 1989, were 3,903. This compares with 3,976 through October 31, 1988. FIRE: During the months of September and October, the Fire Department responded to 26 and 29 calls respectively. Total calls responded to for the Fire Depart- ment as of October 31, 1989, were 317. This compares to 319 through the same time frame in 1988. A film called "School Bus Safety and Courtesy" was shown and a school bus safety talk was given by 911 and myself. In addition to the School Bus Safety Program, Kindergarten students at the E.C.C. were given a program about the police as community helpers. I use this program as a way to introduce myself to the students as the School Liaison Officer. In this program the students saw a film about policemen as community helpers and I also gave a short talk. I also performed a magic trick for the students and each student received a sucker with, "I will help Chaska Police lick crime" , printed on the stick. In September I received four calls for assistance from the Chaska Elementary School. The calls included the following: I investigated a report of a High School student who failed to stop for the school patrol stop flags on Engler Blvd. near the high school. A High School student was given a citation for careless driving. I investigated two child abuse cases and they were referred to Carver County Social Services for follow-up with the families. I assisted Mr. Ewert in talking to a student who ims bragging to some of his friends at school that he used marijuana. The student told us that he did not use marijuana and that he was only saying that to impress his friends. I made phone contact with this student's parent. CHASKA MIDDLE SCHOOL A program on suicide prevention was given to the C.A.P.S. Program. Christine Ullom, School Psychologist, assisted me in giving this program to the students. Ms. Ullom and I talked to the students about our roles in suicide prevention and intervention when a student threatens suicide. We also gave the students ideas on how they should handle a situation if one of their friends threatens suicide. School Bus Safety and Meet Officer Norm programs were presented to the Option 5 students at the Middle School. I received six calls for assistance from the Middle School in September. The calls included the following: I investigated four theft cases. Three of the cases are inactive, one case was cleared with a student being issued a juvenile warning notice for theft. I also made phone contact with the student's parents. A middle school parent called me with concerns that her son was being intimidated and harassed by other Middle School students. I met with all the students who were involved to resolve this situation. - I investigated a report of a Middle School student who was making~ deals to sell marijuana and L.S.D. Mr. Werner and I spoke with the student and we learned that the student was not going to sell any drugs but, was merely saying this as a joke. I made phone contact with the student's parents about this problem. I found four students smoking cigarettes, and turned them over to the Principal's Office for discipline. CHASKA SENIOR HIGH SCHOOL I received four calls for assistance from the High School in September. The calls included the following: A High School Dean reported that he had found a student in possession of drug paraphernalia. I referred the student to Court Services. I took a report of a bomb threat that was phoned into the main switchboard. The bomb threat was a hoax and at this time there are no suspects. I investigated two locker thefts and the cases, at this time, are inactive. A High School student's parent contacted me with her concerns that her son refused to live with her any longer. ; I met with the student and his parent; a compromise was reached that the student would live with his father. I found ten students smoking cigarettes at the high school and I turned them over to the Principal's Office for disciplinary action. I also issued tickets to four High School students for Use of Tobacco. I found six students skipping school and they were also turned over to the Principal's Office. Two high school students were referred to court for Minor Consumption of Alcohol. In light of recent media events concerning kidnapping, etc. safety flyers were distributed to both Chanhassen Elementary and St. Hubert's. We did not give flyers to Minnetonka Schools with Chanhassen student enrollment this time as a similar flyer was given to them a few weeks ago. (In mid September) R October 1989 Crime Prevention Report November 15, 1989 Page Two Flyers concerning the Jacob Wetterling kidnapping were distri- buted to City businesses. A couple of residents also took them $o be sent with nationwide mailings from their places of businesses. Everyone was very cooperative and genuinely concerned. This is very refreshing. Saratoga Drive residents received flyers concerning implemen- tation of a Neighborhood Watch program. Approximately 33 crime victim letters were sent during October. Because we have a limited number of electric engravers (for Operation Identification) I began sending interested parties a letter explaining Operation Identification and that there would be a brief delay. Two Honeywell representatives delivered doughnuts to our office on October 4th to thank us for our "good work" . We spent time talking about alarm problems and they offered us any assistance we needed. An invitation to a future security system seminar was also extended to us. (Some good contacts made. ) An impromptu visit to "Early Beginnings Childcare" by Bob and I turned into quite an event. The grand finale was the boys and girls coming out to inspect the truck, complete with lights and sirens going. (A good time was had by all! ) Our Crime Prevention program is beginning to gain momentum.
