I We have advised you in the past that Eckankar would be open to discuss the sale of up to 25 acres to the City for a community center or a middle school/community center at a fair market value price. When the application for a Conditional Use Permit for the Eckankar Church was I filed, you suggested that discussions with respect to City acquisition of Eckankar land be deferred until after the Conditional Use Permit had been acted on so that no one would feel that the two issues had I been linked in any way. We think this the best course of action and suggest that any further discussions with respect to City acquisition of a portion of the Eckankar property for a community center or a middle school/community center be deferred until the Conditional Use IPermit is approved. With respect to the second item in your letter of March 1, 1989 , ' please advise the City Council that the entire Eckankar property is not for sale. Eckankar has invested substantial amounts of time and money preparing to construct a church on its property and intends to Iproceed to do so. The recom- mendation of Mr. Ronald Nargang, Director - Division of Waters, Minnesota Department of Natural Resources, was to seriously con- sider entering this summer with water use control measures. I would like to recommend that we discuss the possibility of ' starting out with an odd/even watering system, or similar control measure, at our March 20, 1989 Public Safety Department meeting. Public Safet y Director ' DATE: March 16 , 1989 SUBJ: Supplemental Equipment for Blazer Vehicle Because of the recent use of the blue Blazer for emergency ser- vice by our department, I recommend that the following be added to this vehicle: 1 . The scanning radio unit presently in Gary Warren' s truck. 2 . Amber strobe lights to the rear. 3 . Red strobe lights to the front. 4. Magnetic mount red beacon. ' 5 . Siren. ' Tuesday night this vehicle was used during the severe storm, including being used at the fatal accident at Highway 5 and County Road 117. Our Blazer was on the highway in conditions that contributed to this fatal accident and exemplifies the necessity ' for adequate lighting and radio communications . As an additional note, CSO Bob Zydowsky responded along with four State Troopers, four rescue vehicles, and three Carver County Sheriff units. I believe this clearly exemplifies the need for adequate rescue response units. During the storm, I was ' also out in extremely hazardous conditions with minimally- acceptable equipment. I can think of no better example than Tuesday night of situations in which Chanhassen Public Safety must be prepared to work with other emergency response agencies, ' and should be better prepared with properly-equipped vehicles . 1 / I ' PUBLIC SAFETY DEPARTMENT MINUTES MARCH 13 , 1989 ' Present: Jim Chaffee Absent: Bob Zydowsky Steve Kirchman Carl Barke ' Ron Julkowski Mark Littfin Deb Rand Dale Gregory Scott Harr ' OLD BUSINESS Westside Baptist Church: Steve Kirchman indicates that Westside Baptist has complied with all requirements and he has issued them a clean bill of health. Lakeview Hills : Roger Knutson will be meeting with Steve ' Kirchman and Scott Harr concerning the legal remedies available regarding code compliance. We are seeking legal help to acce- lerate the completion of foam removal and roofing repairs . Exposed foam is in violation of code and must either be removed or covered. Lakeview Hills claims that it will cost them approximately $18, 000 to cover it. Steve Kirchman also indicated that he received a call about bad water at Lakeview Hills ' Apartments. Building Numbers : In addition to the Chanhassen Inn and City ' Hall, Scott Harr will be putting Ches Mar Farm on his list. NEW BUSINESS Fire Department Burns: The Fire Department is requesting that when signing a contract to burn a structure, that a clause be filled out requiring the contractor to fill in the hole after the ' Fire Department has burned the building. In addition, Mark Littfin will be looking at our contract system regarding house burns . NO SMOKING: The addition to City Hall and the addition and remo- deling to the Fire Department will be made tobacco-free. This means that there will be no smoking of any kind throughout the entire additions . Open House: An open house will be planned for the new addition to City Hall inviting numerous people to attend. The State Patrol has indicated their desire to assist in the open house and the Fire Department will be coordinating an open house likewise. ' Chan View Mark Littfin will be working with the Chan View Apartments in the upcoming weeks in an effort to bring them up to code compliance. Mark Littfin also indicated that the City of Chanhassen ordinance requiring the central monitorization of sprinkler systems is more specific and restrictive than state law. I PUBLIC SAFETY DEPARTMENT MINUTES MARCH 13 , 1989 PAGE 2 Crime Prevention: Scott Harr indicated his pleasure at the recent crime prevention articles and material that has been coming out in the paper. Sprinkling Restrictions: During our recent Governor' s Conference on disaster preparedness and natural disaster planning, the 1988 drought was discussed in depth. At this time, the State of Minnesota is in a severe drought condition as compared to other years . While it may seem that we have had more than a normal amount of snow, in reality we have had less moisture content in this snow and we are still in dire need of above normal rainfall in the spring. Just with normal rainfall this spring, would not bring the state out of drought conditions . For this reason, the state climatologist and the DNR are recommending tight controls on sprinkling and have suggested limitations on new sod in lawns . Scott Harr, Gary Warren and Jim Chaffee will be getting together to discuss this problem. Severe Weather/Tornadoes : During the recent conference we also discussed severe weather to include tornadoes and straight-line winds. It was suggested that the National Severe Storms Research Center in Texas has completely changed the spotter training course for public safety officials . Scott will be looking into gaining access to the updated spotter information to include slides and possible video. The formal complaint process for violation of building code is in the works . Steve Kirchman will be doing an inspection today to see if they are complying with the codes on ' their other buildings . Westside Baptist: Apparently Pastor Pike has completed all the ' requirements mandated by code and Steve Kirchman will be checking into it this week. inspection Department Help: Mike Wegler is back with Public Works completing the snow removal from the big snow that recently fell . Ron Julkowski and Steve Kirchman stated that they will be able to keep up with it so far it appears for this week. Carl ' Barke , however , stated that he is as behind as ever and still is getting complaints . We discussed going before Council at the Council meeting on April 10 to request additional help for the inspection department. We have been getting inquiries about the ' positions from interested parties. NEW BUSINESS Appendix E: It was our understanding that they will be allowing no commercial development in the non-sewered and watered areas in ' the City. Ron Julkowski , however, stated that there is an 8, 000 square foot warehouse proposed along Highway 212 outside the MUSA line. This brings up questions again about the necessity for sprinkling outside the MUSA line. I will be meeting with Steve Hanson to discuss this issue. Inspection Vehicle: Bob Zydowsky indicated that the 4-wheel drive inspection vehicle was worth its weight in gold during the recent snow storm. He indicated that the Sheriff ' s Department had requested that he patrol in the 4-wheel drive unit to assist their units in getting to hard-to-get areas . ' OBSERVATIONS: ' 1 . Chanhassen City Hall - Materials on site include: wood handrails, wood doors . ' 2 . Chanhassen Fire Station - Materials on site include: brick, steel studs, gypsum board, and roofing insulation. 3 . Chanhassen City Hall - They have moved the sprinkler piping in the lower level at the bay window. The courtyard entrance doors have been installed. ' 4 . Chanhassen City Hall - Painted areas such as door frames and walls are being damaged by the acoustical tile ceiling, door, carpet and vinyl base installation. DISCREPANCIES NOTED: N/A ITEMS DISCUSSED: 1 . The cedar board samples for the exterior and interior soffits at the Fire Station have been taken to Jack for review. The sample matching the job specifications was 11 chosen. 2 . The dimensions and location of the skylight soffit and ceiling cove at the window were discussed with Jack, Jenifer, Bud and Interior Specialties . It was decided to keep the ceiling even with the existing overhang. This will flush out with the new door and window frames and it will slip under the existing rowlock course above the existing windows . I He indicated that his major concern was for parking and access to that parking regarding both amount and location. He went on to explain that his clientele required convenient parking, relatively Inear the door and that the proposed site plan did not meet his needs. He indicated that committments have been made by CHADDA 1 throughout the process that the Riviera would have a minimum of 70 spaces. He indicated that he was supposed to have approximately 30 1 cars in the Retail West parking lot but that he actually has only about 8 and that those are used primarily by the Chinese Restaurant employees. He explained that the 11 on the east side of the building Iand the relatively few spaces northerly of the Riviera are inadequate and he strongly disagrees with the plan as it is presently conceived. I He again reiterated that the understanding he had with CHADDA has Inot been fulfilled and that he would not have sufficient parking to support his restaurant. IIBrad continually suggested that perhaps the Riviera's parking is adequate as proposed by the plan but I explained that 1 had Iexpressed a concern for the parking difficiency for the Riviera and that something needed to be done to resolve the problem. Jim Lasher then sketched an alternative on the proposed site plan which ITom appeared, at least in part, to agree with. What we concluded was that Jim would continue to do a little more work and that we I would meet again on Monday, March 13 at 9:30 a.m. to review alternatives which would provide the Riviera with more parking. Brad Johnson indicated that he would communicate with the owners of ' that development the need to discourage employee parking in those areas that should be utilized or protected for customer useage. We also talked some about the potential for an expansion of the Riviera ' and Tom indicated that he intended to start in the near future with a facade improvement but that he was not intending to expand the building due to the requirement that sprinklers be provided for the ' entire building, no matter the size of the expansion. While we did not discuss it at the meeting, it would seem to me that he could recover the cost of sprinklers and at the same time have a better facility through special assessment reductions and that the expansion might be warranted no matter the fire code requirements. ' Generally, Don, the meeting went very well. Y y . ou could tell that Torn Krueger was very irritated with Brad Johnson but we left him with ' the feeling that the City would intervene on his behalf and try to resolve his parking problem. I think he was very appreciative of the opportunity to sit with us. 1 If the plan is to be further modified to reflect Tom's needs, we will need to go back to the Planning Commission and City Council for a site plan amendment. ' The speed limit along this stretch of Kerber Boulevard is a posted 40 miles per hour. In addition, your vehicle was reported going through the stop sign at Kerber Boulevard and West 78th Street. Please understand that this letter carries no legal sanctions ; however, we receive many complaints about speeding vehicles along Kerber Boulevard and we try to respond to them all. Our utmost concerns for safety and we do the best we can to help people understand the speed limits on the various roadways in town. A seatbelt safety film was shown to the students as well as a special appearance by television's famous crash dummies , Vince and 11 Larry. 911 also helped in giving this program. Attached to this report is a Carver County Herald picture and article about the Seatbelt Awareness Program. I received one call for assistance from Chaska Elementary School. This matter involved a student who was stealing from fellow classmates . Mr. Ewert, Chaska Elementary School Principal , and I handled this situation within the school. CHASKA MIDDLE SCHOOL , I presented Baby-Sitting Safety Programs to the Sixth Grade Home Economics classes . A video was shown which was supplemented by a discussion on common household accidents and childhood emergencies. I received eight calls for assistance from the Chaska Middle School, which included the following: I investigated the reported theft of tennis- shoes . A high school student was referred to Court Services on the Diversion Program. The shoes were recovered and returned to the owner. I investigated two child abuse cases . The cases were referred to Carver County Social Services for follow-up. I investigated the report of a suspicious person who was found hiding in a girl 's restroom. The person was identified as a male student from the high school. I contacted the high school student' s dean and also the boy' s guardian about this problem. I assisted middle school Special Education staff twice in dealing with a ' student who was both disruptive and assaultive to students and staff. I made a report on this incident and I also contacted Carver County Social Services to assist the school in gaining a proper placement for this student. I investigated a report concerning a student with a chronic truancy , problem. I located the student at a friend's house. I referred this friend to Court Services for Contributing to the Delinquency of a Minor. The discipline for the truant student was handled within the school . ' I investigated a locker theft. The student responsible for the theft was identified and the matter was handled within the school . IICHASKA SENIOR HIGH SCHOOL II presented a five day program, "Targets" , to students in the Family Life-Styles class . "Targets" is a program directed toward providing prevention information to students on suicide, chemical abuse, peer pressure, physical violence, sexual abuse and dating violence/acquaintance Irape. I showed videos to the students which was supplemented by guest speakers from the Southern Valley Alliance for Battered Women and the Carver County Program for Victims of Sexual Assault. ' I received eight calls for assistance from the high school and one call from the Co-Op Program. These calls include the following: II took a theft report from a student who reported the theft of his jacket from his locker. At this time the case is inactive. ' I investigated a fight between two high school students . These two male students have been in numerous fights during the school year. I referred both students to Court Services for Disorderly Conduct. IA student reported to me that he had been kicked out of his home over disagreements with his family. I met with the student and his family and, I was able to get the boy back into his home. IIA high school student reported that she was being harassed by several other students . I met with all the students to resolve this situation. IA confidential informant gave me information regarding the selling of drugs at the high school . This information was passed on to the Southwest Metro Drug Task Force. II - A child abuse case was reported and I referred it to the Carver County Sheriff's Office and Carver County Social Services for follow-up. This Icase was referred to the Sheriff ' s Office because it occurred outside of Chaska. I investigated a false fire alarm at the high school. At this time, the case is inactive. I investigated a fight/assault report between two students . This Isituation was handled within the school . I investigated the theft of lunch tickets from the business office at the Co-Op. The case is inactive at this time. GENERAL INFORMATION IIn January, I attended meetings of the Carver County Multi-Diciplinary Child Abuse Team and Community Education Advisory Council. II chaperoned three sporting events at the high school . At the end of January, I attended the Juvenile Officer's Institute. This IInstitute program focused on dysfunctional families and its role in juvenile delinquency. The procedure is set forth in Section 20-29 of the City Code. The decision of the Board of Adjustment is final subject to appeal if the Board' s decision is unanimous. If the Board' s decision is split, the decision serves as a recommendation to the City Council which then makes the final decision. ' Any person "aggrieved by any decision of the Board" may appeal the decision to the City Council. A City Council member may be an aggrieved person. Since split decisions by the Board are automatically sent to the City Council for decision, only unanimous decisions by the Board would be appealed. An appeal to the City Council is made by "filing an appeal with the zoning ' administrator within ten (10 ) days of the Board' s decision. " The "zoning administrator" is the City Manager. The City Council must then conduct a hearing preceded by mailed and published notice. When a split decision of the Board comes before the Council a majority vote of the City Council decides the issue. If the City Council deadlocks, e.g. a 2-2 vote with one member absent or abstaining, the variance would be rejected. If, however, the variance request reaches the Council because of an appeal from the Board' s decision, a deadlock by the City Council means the ' decision of the Board stands. At the hearing the board shall hear such persons as wish to be heard, either in person or by attorney or agent.Notice of such hearing shall be mailed not less than ten(10)days before the date of hearing to the person who filed the appeal or application for variance, and, in the case of an application for variance,to each owner of property situated ' wholly or partially within five hundred (500) feet of the property to which the variance application relates. The names and addresses of such owners shall be determined by the zoning administrator from records provided by the applicant. ' (c) Decisions of the board. The board shall be empowered to decide appeals and grant variances only when the decision of the board is by a unanimous vote. A simple majority vote or split vote by the board shall serve only as a recommendation to the city council, who shall then make the final determination on the appeal or variance request within thirty (30) days after receipt of the board's action. The board shall act upon all appeals and variance requests ' within fifteen(15)days after the date of the close of the required hearing. (d) Appeal from decisions of board. Any person aggrieved by any decision of the board, including the applicant or any person owning property or residing within five hundred (500) ' feet of the property to which a variance application relates, may appeal such decision to the city council by filing an appeal with the zoning administrator within ten (10) days after the date of the board's decision. The procedure governing appeals to the board shall also govern ' appeals to the city council. (e) Council action. By majority vote, the city council may reverse, affirm or modify, ' wholly or partly, the decision appealed from the board, and to that end the city council shall have all the powers of the board. The kg,le ceui .) proposed letting dates for Highway 5 are most encouraging and indicate I that our combined efforts are producing results and contributing to adequate and safe highway systems in the southwest area. It is particularly noteworthy to see new TH 212 on MnDOT's status I report with a proposed letting date of January 1993. This trunk highway is becoming a reality and we now need to assure design funding availability in early 1990. Minnesota Good Roads had their Washington Fly-In March 1 - 3. The II meetings there were excellent, and we are receiving very strong support for TH212 from the Minnesota Congressional delegation. More specifically, Bill Frenzel and Vin Weber are strongly supportive, Jim Oberstar has I offered his personal assistance, Wendy Anderson provided personal introductions to Bruce Vento and Martin Sabo offices, and Dave Durenberger and Rudy Boschwitz and their capable staff are working with us. Our coalition is securing greater support from outstate Minnesota. Easy access to the metropolitan area is important to all communities along 212. We will be receiving support from communities west of Glencoe including Brownton, Stewart, Buffalo Lake, Hector, Bird Island, Olivia, II Renville, Sacred Heart, Granite Falls, and Monevideo. This funding should be committed in early 1990 for the highway to be under construction in 1992 or 1993. The Environmental Impact Statement for all segments is scheduled for completion in November, 1989. A design commitment for all segments of TH 212 needs to be secured and each segment needs to be programmed for construction. Design Funding Objectives: Segment i - Commitment desired in early 1990 Segment II - Commitment desired in 1991 Segment III - To be established Segment IV - To be established TH 212 Programming Commitments Program funding commitments for the first segment is $9 , 000,000 in 1993 . This commitment needs to be increased from $9,000,000 to $34,000,000. Urge release of Aviation Trust Fund balance -- Airports and airways are becoming gridlocked. Release I of funds would help reduce congestion through moderniza- tion of the air traffic control system and improvement of airports . This would have a direct benefit to the public through reduced delays and improved safety. 4. Need for Mass Transit Account equity I -- Revenue for the Mass Transit Account within the Federal Highway Trust Fund is provided by one cent of the federal motor fuel tax. Although collected from all over the country, Mass Transit Account taxes are spent almost exclusively on commuter rail transit systems in just a few large urban areas. Funds should be distributed more widely for urban transportation needs in all states . NOTE: Minnesota historically has received only l3. 5 for every dollar contributed to the Mass Transit Account. 5 .
