Please see the attached memo to me from Jo Ann Olsen dated May 15 , 1989. 1 Violations of the Chanhassen City Code constitute a criminal mis- demeanor, punishable by up to 90 days in jail and/or a $700 fine. The City of Chanhassen could also pursue civil remedies in court as well, prohibiting such use of the aroperty. I hope you will recognize that City staff has delayed taking ' enforcement action until our City Attorney' s office was able to make a determination on this matter. We continue to get complaints from area residents about such use, and our City Attorney now advises that they are taking the stance that the 1 ordinance is enforceable as written. Therefore, I am sending you the formal notification so that such use will cease. I understand from the Carver County Sheriff' s Office that a dock is 1 now installed, with a boat being moored off of the property. I will ask that these be removed immediately. ' In talking with the Assistant City Planner, Jo Ann Olsen, I understand that the alternative you wish to pursue is an appeal through the Planning Commission. Until alternate agreements are reached, I must insist that you comply with the Chanhassen City 1 Code. I understand that this is an emotional issue that has been debated. This occurred as a result of the increased emphasis the Carver County Sheriffs Department is placing on traffic enforcement . ' CREWS TO WIDEN HIGHWAY 5 FROM HERITAGE ROAD TO WALLACE ROAD IN EDEN PRAIRIE Beginning May 15, motorists traveling on Highway 5 in ' Eden Prairie may experience minor traffic delays as crews ' begin a $3.4 million project to widen the highway from Heritage Road to Wallace road . The project will require minimal , non-rush hour lane closures , between 9 AM and 3 PM, during the middle stages of ' construction. There should be no lane closures during rush ' hour , from 6 AM to 9 AM and from 3 PM to 6 PM, and no weekend work. The Minnesota Department of Transportation has divided the construction into five major stages : ' During the first stage, traffic will travel on the ' in-place roadway while crews add an additional lane on both eastbound and westbound Highway 5 from Heritage Road to just west of County Road 4. Crews will also add one lane to eastbound Highway 5 and build frontage roads on both sides ' of the highway from just east of County Road 4 to Wallace Road . ' Traffic will remain on the in-place roadway during the ' second stage while crews add an additional lane to both eastbound and westbound Highway 5 at the intersection of County Road 4 . Most of the lane closures will occur during the third ' stage of construction, also at the intersection of Highway 5 and County Road 4. Traffic will travel on the new eastbound ' and westbound lanes while crews repave the existing roadway. Crews will also add an additional lane in each direction on County Road 4, extending one-quarter mile to the north and one-fifth mile to the south of Highway 5. During stage four, traffic will travel on the two ' eastbound lanes of Highway 5 from just east of County Road 4 to Wallace Road. This will allow crews to build a new - ' westbound lane and remove the Chicago-Northwestern Railroad ' bridge. Traffic will travel on the new eastbound and westbound lanes from Heritage Road to Fuller Road during the fifth stage to allow crews to repave the existing lanes. ' The project will also involve work on traffic signals. Because the intersection of Highway 5 and County Road 4 will be widened , the existing signal will need to be replaced. , Crews will add new signals at the intersection of County Road 4 and Wagner Way, and replace the temporary signal at ' Highway 5 and Wallace Road with a permanent one. The Sheriff ' s Dispatcher gave me the name of Tim Glaros of 940 Saddlebrook Pass, who I subsequently called to find out what the problem was. Mr. Glaros indicated that he had been having ' problems with his new home at 940 Saddlebrook Pass and that when they came on this Saturday morning to pour the garage floor they discovered a problem with the back garage block wall being bowed out and cracked. He indicated that it would be no problem to see a building inspector on Monday morning. Early that afternoon, hoaiever, I did respond to 940 Saddlebrook ' Pass and contacted Mr. Glaros to see if I could verify the problem and help him in some way. He showed me the block wall in question and it was definitely bowed and cracked in several places . ' During the course of our 45 minute long conversation, he also informed me of many other problems experienced with Frontier Builders . Mr. Glaros provided me with a copy of a letter written ' to the President of Frontier Companies on April 3 , 1989 listing 17 problems to be corrected. One of the most glaring examples of poor construction techniques that I noted involved Item 8 where Mr. Glaros showed me a finish nail that had been driven ' through the carpet into the floor in their attempt to correct the squeak. The nail was subsequently sticking up approximately 1/8 to 1/4 inch easily felt by one' s foot. I peeled the carpet fiber ' back and pushed down on the carpet and did expose the head of the finish nail. I also noted on the outside of the house the central air conditioner was falling away from its original loca- tion and was hanging only by the cable and coil going into the house. Mr. Glaros indicated that he has not received any call backs from ' his phone calls to Marshal Oaks , the President of Frontier Companies . i Mr. Don Ashworth May 8 , 1989 Page 2 In addition, he has sent a subsequent letter to Marshal Oaks indicating that he should receive some response and if he does not, he will have to pursue legal remedies to these problems. I made arrangements to have Steve Kirchman the Building Inspector respond to 940 Saddlebrook Pass at 7 : 30 a.m. on May 8, 1989 . Upon his return, he indicated that there are some very definite problems involving the construction and finish of the home and that he will be getting a list to me. In the meantime, I have directed that no more building permits nor certificates of occupancy be issued to Frontier Builders until such time as we can come up with solutions to these problems. Empak: Foundation and shell permit has been issued. We will be working with the Engineering Department in an effort to speed up the process of getting the plans back. Kennels: A healthy discussion centered around whether kennels can be considered an accessory structure or kennels are as defined in ordinance. When the common man thinks of a kennel, they think of the physical structure itself, regardless of how many dogs it has . The way the ordinance defines kennel, a kennel is anytime one has three or more dogs. If the strict interpreta- tion of the ordinance is considered, then anything, a garage, a house, etc. , is a kennel if in fact you have three or more dogs. If then you have a slab of concrete with fence, but only two dogs in it, is-that then a kennel? You can see how a healthy discussion would arise on this issue. Rosemount: Carl Barke stated that Rosemount is calling for daily inspections regarding plumbing. The mud on TH 5 was also discussed and the responsibility for removing it. It was decided that the responsibility should fall onto Rosemount and the question then arose of the safety factor of Rosemount cleaning off mud on a well-travelled and sometimes dangerous highway in that area, TH 5 . Steve Hanson: Goodbyes were conveyed to our short-term but over- worked Planning Director, Steve Hanson. All attendees expressed an interest in knowing Steve' s new address in Denver for when they take a trip to Colorado to go skiing. Mr. Rivkin 's letter has a number of excellent points which I do not believe were included in our previous discussion. The following incorporates decisions made on March 28th including suggestions by sir. Rivkin , i .e. : Limit Permits and Maintain Statistics: You were to create a data base which could be activited by any of our Public ' Safety personnel. Information such as name, address , date, parking period valid for [date (s) ] , purpose, etc. would be in the data base. Creation of the data base and training people to use such was estimated by yourself to take a relatively ' minor period of time. Upon receipt of a request ( telephone call/letter ) , such would be entered into the data base and be printed on a special form or potentially simply standard City 1 letterhead. A second copy would also be printed on the offi- cer ' s log or "Pass-on" slips. The permit would be mailed that day and could literally be in effect from the time of ' calling through the duration of the permit period. Sending the permit itself would solely be a form of verification should the officers ' "Pass-on" logs end up not being passed on . Additionally, requiring the permit to be sent to the property owner would provide a sense of importance in con- tinuing to call when parking was necessary; and ' Control and Conditions of the Permit: The macro which will print the permit should also print a standard conditions sec- tion which would include parking to be limited to the north side, no overnight parking, no daytime parking during periods of snowfall when one inch or more of snow has accumulated or within 48 hours after such snowfall , etc. ; and I am ,, Jim Chaffee May 1, 1989 Page 2 Notification: Upon activating the permit system, a letter should be sent to all residents along Lake Lucy Road notifying them of the necessity to call in for parking per- mits and the rules of such. The width of Lake Lucy Road was NOT designed to accommodate parking, 2 traffic lanes, and safe passage for pedestrians and bikes at the same time. Parked cars should not be permitted at the expense of endangering the lives of anyone. Please don't forget this is a designated trail system, and safety is the prime concern, the convenience of parking treated as secondary and a potential safety hazard. Parking abuses are a ' potential also. Therefore, I recommend that you please consider the following two options. ' One in lieu of permit parking, and the other a set of suggested conditions if permit parking happens to be the only solution. I. In lieu of permit parking (See drawing on page 2) : ' It may take several thousand dollars for the city to establish, implement, and maintain a parking permit system. It has little value for the community on Lake Lucy Road ' compared to the high value that investment in an off-street trail would have for solving the parking and safety problem. Parking doesn't have to be solved at the expense of safety and both could be solved inexpensively if you had a 5 or 6 ft. off-street trail placed over the watermain, allowing a permanent 8 or 10' parking lane on one side of the street. The cost would still be relatively low since the city has to pay for restoration over the watermain anyway, the signs would only have to change once, there would be no change to the road, no added costs to restripe because ' sealcoating and restriping are due anyway, and there would be no recurring costs dealing with parking permits because there needn't be any. I think this would be an excellent compromise, and would serve to show the Council has a compromise solution to offer instead of creating a hazard on the existing road with parked cars. II. If parking permits are the only solution, assuming the state would allow it, I suggest the following conditions that keeps the number of parked cars to a minimum: 1. Limit parking to only one side of the road, maybe even in designated portions so that bikers and motorists can watch out for them. Markings on the road and/or signs can ' indicate these. Parking on both sides would not even allow passage of regular traffic much less some poor biker or pedestrian squeezing through. I suggest parking on the north side since parked cars on the south could block the Tichy's and Morin's line of sight coming out of their steep driveways. 2. Limit the number of potential parked cars by issuing permits only to residents on L.L.Road, maybe those only deemed having a parking problem to begin with (those with space on their property for less than 6 cars) . The city could limit the number of permits granted over a year with temporary permits for more than the limit. 3. No parking in the winter months because of snow removal and safety hazard of parked cars narrowing the traverse for slippery conditions. 4. No overnight parking. ' 5. Do it on a one year trial basis so that abuses and complaints can be recorded, then . see if you want to make this a permanent change or put in the off-street trail later. 1 i r .i 6. No. resident should be assessed or be made to pay directly for changes to the road or signage, unless the design for parking boils down to an individual need. I would like a response to this letter that I want to discuss with the other residents, 1 and in the future, please keep me abreast of developments, so we can respond in a timely way.
