This approval included complying with setbacks and providing an amended landscape plan which provides additional landscaping between the daycare faci- lity and the mini-storage warehouse facility including 1 evergreens . The City Council approved the final plat for this project on November 14 , 1988 . At that time staff noted that the improvements for Trunk Highway 5 would require additional I right-of-way along this property and that the daycare facility site plan would need to be amended. 1 The applicants shifted the building to accommodate the needs for Trunk Highway 5 and maintain a 100-foot setback from the creek along the rear of the property. This shift ,resulted in the 10-foot setback along the mini-storage warehouse to be totally Ipaved over for access to parking. This also eliminates the area which was to have increased landscaping. The zoning code provides that setbacks may not be used for parking. The appli- 1 cant is requesting a variance from this to allow for the pavement of a setback. I The Board of Adjustments and Appeals may grant a variance only if it finds all of the following: 1 . That the literal enforcement of this chapter would cause 1 undue hardship and practical difficulty. 2 . That the hardship is caused by special conditions and cir- 1 cumstances which are peculiar to the land and structure involved and which are not characteristic of or applicable to other lands or structures in the same district.
