SUBJ: Rejection of Bids
North Side Parking Lot Project No. 87-17
111 It is not often that a recommendation of rejection of bids is
made from this office. This is especially true on projects such
1 as the North Side Parking Lot where a number of construction
entities are dependent on this City project proceeding, such as
the construction of the Medical Arts building and Colonial Plaza
improvements. However, typically in the bidding climate we re-
f ceived 6 to 12 bidders on projects of this nature. As noted in
the attached August 10 letter from BRW, the City has only obtained
one bid for the North Side Parking Lot project, that being
1 Hardrives, Inc . in the amount of $605 ,196 . 55 . As noted, this is
approximately $80 , 400 over the engineer ' s estimate for this project.
I Many factors are considered by contractors when preparing their
bids for submittal. Difficulty of the project, the timing of the
project, the type of project, the company' s current backlog situ-
ation , the time of year and the amount of competition are all
1 important factors weighed by contractors, among other things, in
preparation of their bids and in deciding whether they will even
prepare a bid for submittal at all . The attached memorandum from
I BRW in detail discusses the bid and cost factors on this project.
We are not casting any disparaging words towards Hardrives but we
believe that the bidding climate, having only one bidder , was not
competitive in nature and therefore we have received an inflated
I bid.
This is a difficult time of the year to bid since many contrac-
t tors are not looking for additional work and perhaps are
overlooking a project of this nature. We have had discussions
with many contractors who typically bid work in the City of
I Chanhassen and have reason to believe that if the project is
readvertised , that a more favorable bidding climate and low bid
would be received by the City. We are comfortable in that ‘,'e
also believe the engineer ' s estimate ( $524 , 772 . 67 ) is not

unreasonable for this project.

A consequence in rejecting bids at this time , which is not to
minimize the magnitude of the consequence, is a potential delay
in the initiation of construction for the Medical Arts building
since their financial advisors have chosen to wait until the City
awards the North Side Parking Lot project before they will close
on the Medical Arts project. A further jeopardy resulting from
the delay is that we will be losing approximately four weeks of
construction season which could jeopardize the installation of
concrete curb and gutter and the first lift of bituminous as had
originally been intended. It is our belief, however, that by
repackaging the contract documents to deflect some of the
unnecessary elements of the project to the spring of 1990 , i .e.
Colonial Plaza paving , that we should still be able to accomplish
the Medical Arts aspects of this project as intended. Obviously,
weather will be the final dictator on just how much work is able
to be accomplished this year. '
Be that as it may, the bottom line is that this office is hard-
pressed to make a recommendation for an award with a bid that is
$80 , 400 above the engineer ' s estimate, especially when it is the
only bid received. I believe that it is in the best interest of
the City to reject the bids received August 8 , 1989 for the North
Side Parking Lot project and that staff be directed to readver-
tise this project in an attempt to achieve a more competitive
bid. In the interest of time, staff has already placed the
advertisement for bid to appear in the August 17 edition of the
official newspaper . Bids would then be opened on September 7 ,
1989 and presented to the Council for award at the September 11,
1989 Council meeting .

Dear Gary,
On Tuesday, August 8, 1989, bids were received and opened for the above-
referenced project. Only one bid was received for the project as follows:

1. Hardrives, Inc. $605,196.55
Engineer' s Estimate $524,772.67
The bid of Hardrives, Inc. , is approximately $80,400.00 over our engineer' s
estimate, a difference of fifteen percent.
{ We believe that our estimate is an accurate approximation of the project cost in
a competitive bidding environment with numerous bidders. The Hardrives, Inc.
bid is high in comparison to successful unit prices for similar projects
recently performed in the City of Chanhassen.
The feasibility study which we prepared for their project in February 1989,
budgeted a total of $668,975.00 for North Side Parking Lot Phases I and II ,
including $79,000.00 for facade improvements to the Colonial Center. The total
without considering the facade improvements is $589,975.00. The total Phase I
cost was estimated at $434,925.00 (without facade improvements). The total
Phase II cost was estimated at $155,050.00.
The total bid price for the North Side Parking Lot, Phase I , portion of the bid
package (not including the City offices improvements) is $476,346.80, which is
approximately $42,400.00 over the amount estimated in the feasibility study.
Phase I of the project includes some work which was originally assumed to be
performed under the Phase II stage in the feasibility study. It is estimated

SUPPLEMENTAL INFORMATION
FOR BIDDERS
The project consists of: 1) the construction of the West 78th Street North Side
Parking Lot, and 2) improvements to the City offices site in the City of
' Chanhassen. While a single bid proposal is requested for the entire project,
the bid proposal form has been divided into two separate bid schedules. Bidders
shall submit a separate total bid for each bid schedule, as well as a total pro-
' ject bid on the provided forms. Failure to do so is cause for rejection of the
bid.
Bids shall be evaluated based upon the lowest total project bid exclusive of any
bid alternates. The award of the project shall be to the bidder submitting the
lowest total project bid.
' The City of Chanhassen reserves the right to award this project in its best
interest.
