As directed by the City Council, bids were received and opened on
I August 8 , 1989 for Improvement Project No. 87-15A, sidewalk
construction . The City received bids ranging from $18 , 920 to
$27 ,652 . The following is a list of the three lowest bidders:
I1 . Curb Masters , Inc . $18 , 920
2 . Advanced Contractors , Inc . $20 , 900
3 . Kelly Construction $25 ,670
IMy estimate for the project was $21,500 . The low bidder, Curb
Masters , Inc. , is the successful low bidder. Curb Masters ,
I Inc. has not previously worked directly for the City but has been
a subcontractor on several projects in the City. References
reveal that they have satisfactorily completed other projects of
Ithis type.
It is therefore recommended that the City award Improvement
Project No. 87-15A, sidewalk construction, to Curb Masters , Inc.
Iof Stillwater, Minnesota in the amount of $18 ,920 .

As humble as this project m=="'::•ear in magnitude, this is the

I first set of construction documents prepared totally in-house by
the City ' s Engineering staff at no direct cost to the City. As
noted in the attached development contract excerpt, the City was
obligated to reimburse the developer a maximum of $14 , 900 to
I install these trails in the plat, exclusive of grading. The
developer 's construction bid proposal included a line item of
$19 ,080 for installation of the 6-foot wide bituminous trail', or
1 a difference of $4 ,180 . In 1988 the developer constructed

approximately 900 feet of the bituminous trail along Powers
Boulevard between Saddlebrook Pass and Saddlebrook Curve at a
cost of $4 ,050 . In my opinion, this satisfies the extent of his
financial participation on this element consistent with the
development contract with the exception of boulevard sodding
which he is in agreement on . Therefore, the $18 ,920 cost is to
be funded from the City ' s Park Acquisition and Development Fund
( #410 ) as originally intended. Neighbors abutting this
sidewalk/trail will be notified in advance of the construction by
Engineering. Likewise, a notice will be placed in the building
permit file of every unbuilt lot along this sidewalk alignment to
inform property owners and their builders of their obligation to
protect and/or repair this new sidewalk during building construc-
tion .
I therefore concur with Mr. Hempel ' s recommendation for award to '
Curb Masters , Inc . as noted above.

exceeds the benefit to the property. The Developer waives appeal
rights, if any, otherwise available pursuant to M. S .A. § 429. 081 .
IIf the final payment required of the Developer exceeds $70, 000. 00,
Ihowever , the Developer reserves the right to object to any payment
in excess of that amount.
I15. Land Purchase. The City and the Developer , or its
assigns, will enter into a mutually acceptable purchase agreement
Iwhereby the City agrees to purchase the property on the east side
Iof Kerber Boulevard ( "Kerber East" ) outlined in red on Exhibit
"B" . The purchase price is $70, 000. 00. The City shall assume pending
Iassessments on Kerber East. Other real estate taxes shall be prorated
based on the date of closing.
I16. Park Fees. Prior to the issuance of building permits
' for residential construction within the plat , Developer, its succes-
sors or assigns , shall pay to the City the park fee then in force
Ipursuant to Chanhassen City Ordinance and Resolutions .
17. Park Land. Before the City signs the final plat ,
Ithe Developer shall convey to the City by warranty deed the , + 1? aGf
' acres described on Exhibit "C" attached hereto. The City shall
pay the Developer .$S7, 55.0-rgg for the land.
I18. Trails. The Developer shall grade and install trails
in the plat in accordance with Plan B. The City shall reimburse

the Developer its out-of-pocket cost in constructing the trails,
Iexclusive of grading, in an amount not to exceed $14, 900 . 00.
19. Landscaping. The Developer shall plant one ( 1 ) tree
