For the request to be further considered, Council directed that the properties in close vicinity to the construction site, in particular around Lake Susan, be notified I of this request and given an opportunity to express their opi- nions on this matter. As noted in the attached correspondence from Opus Corporation, flyers were hand delivered on June 30 , I 1989 to the residents on West Lake Court, Lake Susan Hills Drive, Chanhassen Hills Drive, Great Plains Boulevard and the Lutheran Church of the Living Christ. The attachments include a detail I list of the property addresses and also a copy of the flyer distributed by Opus. I maintain , as in my previous staff report (attached) , that this I is a legitimate request which should be favorably considered by the Council. It is impossible to tell at this point in time what the neighborhood' s response will be to this request. Needless to I say, opinions from all of us will be speculative in nature since the actual impact cannot be known until the activity begins. The fact that this request is for a limited 10-day period and the II fact that the permission can be withdrawn at any time, leads me to feel comfortable that Opus should be allowed to work the extended work hours as requested. Due to this season's frequent rains, a considerable amount of construction time was lost. In order to meet the scheduled ICompletion date, we will need to work longer flours, 5:00 a.m. to 2:00 a.m. , when weather permits. Because of the nighttime hours, a limited Iamount of equipment will be used during the second shift. Apparently the wet spring has resulted in a Ithree ( 3 ) week construction delay. Opus is therefore requesting that the City allow them to work two shifts with their large grading equipment commencing at 5 : 00 a.m. ' and continuing until 2 : 00 a.m. the following morning. They pro- pose that a limited amount of equipment will be used during the second shift. Opus projects that they would need to work the Isecond shift for the next two weeks . I believe the request is reasonable and would be in the best I interests of the City to cooperate with the applicant in this regard in light of the magnitude of the project and the impor- tance of this endeavor to the City of Chanhassen . The City may find itself in a similar predicament with our Lake Drive/TH 101 ' I realignment project if weather does not cooperate. I believe the site is buffered enough such that the nighttime lighting should not be too obtrusive. I would anticipate that there will be some I noise impacts to the Hidden Valley, Chanhassen Hills and Lake Susan Hills West neighborhoods; however, I do not believe this would be intolerable for this two-week period. It is therefore recommended that extended work hours from 5 : 00 a.m. to 2: 00 a.m. ' daily (Sundays excluded) be approved as requested by Opus Corporation for grading and underground utility work on the Rosemount site with the understanding that the City reserves the I right to withdraw this authorization if , in the opinion of the City , an untolerable nuisance results from these extended work hours . Be it further conditioned that during the period of ' extended work hours there will be no off-site construction traf- fic through residential neighborhoods . IDear Gary: II Per your request I 've enclosed a copy of our Bar Chart project schedule. Please note that all of our rough grading and underground utility work was to be completed by May 19th. As of May 19th we have been rained out and unable to work 8 out of 31 working days (approximately 1 out of 4 Idays) . Once rained on the site' s soils rapidly become sticky and greasy, requiring approximately two days to dry out before normal operations can be resumed. Despite working Saturdays and several I Sundays we are still approximately three weeks behind schedule. If we are allowed to work from 5:00 a.m. until 2:00 a.m. we feel we can be back on schedule within a week to ten days. III trust you find the above information helpful . This facility is scheduled to be operational late in 1989. Due ' to the recent rains, a considerable amount of construction time was lost. In order to maintain the scheduled completion date, our approach is to work longer hours when weather permits. To effectively work two shifts with our large grading equipment, it is necessary y to work from 5:00 a.m. until 2:00 a.m. Please note that, because of the night time hours, a limited amount of equipment will be used during the second shift. Opus has requested permission of the City of Chanhassen authorities to work these hours. These activities, during this short 9 period of time, may cause some inconvenience to residents near this area.
