I Attached is a very complete report prepared by the City ' s land
use consultant, Fred Hoisington, concerning the review of alter-
natives for the alignment of Trunk Highway 101 between the new
I proposed Trunk Highway 212 and existing Trunk Highway 5 . The
report includes input received from the public information
meeting held April 17 , 1989 , at which over 23 people attended.
1 It was also a convenient matrix comparison for the alternatives
within the report.
As noted, Alternative 1 has surfaced as the preferred alter-
1 native. When initially reviewing this situation with the pro-
posed layouts submitted by MnDOT for the TH 212 corridor, it was
anticipated that, as a minimum, the TH 212 traffic should be
I taken off of the existing TH 101 roadway to provide some buffer
to the existing lakeshore properties. As the alternatives were
reviewed, it became quite obvious that the further to the east
that the TH 101 alignment was moved with each alternative, the
I less impact there was for the Lake Susan properties; however, the
more impact was presented to the properties to the east, such as
on Tigua Circle and West 86th Street. Inputting the results of
I the land use potential for each of the alternates, and the roadway
geometrics as it relates to the TH 212 layout, further reinforced
the fact that Alternative 1 struck the best compromise in
Igeometrics, land use and property owner concerns.
It is therefore the recommendation of this office that
Alternative 1 be selected as the preferred alternative for the
I alignment of Trunk Highway 101 between proposed Trunk Highway 212
and the southerly extension of Market Boulevard. The City
Attorney has prepared an official mapping ordinance which will be
Ipresented to the Council at the May 8, 1989 meeting. Adoption of

this ordinance will allow the City to commence with official
mapping of this preferred alternative which will then allow the
City to protect the corridor as well as release those properties 1
currently being held hostage by this indecisiveness on the TH 101
alignment. In accordance with the proposed ordinance, the offi-
cial mapping of the corridor will be presented to the Planning 1
Commission at its May 17 , 1989 meeting. The City Council there-
fore should establish a public hearing for this item scheduled
for the May 22 , 1989 City Council meeting. 1
In summary, the action requested of the City Council is to
approve the preferred alternative for Trunk Highway 101 ( staff is
recommending Alternative 1 ) and call a public hearing for May 22 , 1
1989 .

Subject: Selection of Preferred Trunk Highway 101 Alignment

' BACKGROUND
The Hoisington Group Inc./BRW Team was commissioned by the City of
Chanhassen to undertake a study of alternative alignments for TII 101 and
Land Use throughout the Highway 101/5 corridor from the east Carver
County line to proposed TH 212. This memo, however, deals only with the
preliminary alignment decisions that must to be made for TII 101 as they
will impact the Official Mapping of TH 212.
The purpose, then, of this interim step, which will ultimately include an
overall land use plan for the corridor, is to establish the most appropriate
' alignment for TH 101 between Highways 5 and proposed 212 considering
the multitude of factors that bear on such decision.
We have met with each of the principal corridor landowners including Al
Klinglehutz, Keith Bartz, Jim Curry and Pat Hoffman representing the Ward
' interests. We have met several times with City Planner Steve Hanson and
Planning Consultant Mark Koegler to be sure that alignment and land use
proposals are consistent with the evolving Comprehensive Plan. We
' presented the alternatives to the Planning Commission on April 5 at which
time an informal poll of the members indicated unanimous support for
Alternative 1. In addition, we conducted a public information meeting on
April 17, 1989. We presented and received comments on four alternative
alignments for TH 101. A summary of that meeting and a list of those in
' attendance is attached.
ALTERNATIVE DESCRIPTIONS
IFor all of the alternatives, the northerl y and southerly termini are the
same. The givens are Market Boulevard on the north end which will be
' constructed in 1989 to the south line of the Rosemount, Inc. entrance. The
south end ties directly into the south leg of TH 101 at Lyman Boulevard

thereby eliminating the present "s" curve which utilizes Lyman Boulevard
I
as part of TH 101. All of the alignments have these termini in common.
While the overall purpose of the study is to formulate land use '
recommendations throughout the corridor, the intent of the land use
presently shown on each of the plans is to evaluate potential and flexibility
not to ask for land use approval. Land use must necessarily be a I
consideration in establishing an appropriate and compatible alignment.
It is important to note that TH 101 will not be constructed for many years. I
It will probably done in conjunction with the development of TH 212. The
reason for doing this study now is to be sure that the TH 212/101

interchange, which must be Officially Mapped in the near future, will be
compatible with the alignment of TH 101 and the City's plans.
Alternative 1 I
Alternative 1 includes a relatively minor detachment of future TH 101 I
from present TH 101 and establishes a tier of single-family lots between
these two roads. It bisects the several affected properties in an efficient
manner and creates useable parcels of reasonable shape for future
development purposes. While it represents a greater environmental
impact than Alternative 4, it has a lesser impact on wetland areas than
either Alternatives 2 or 3. It will also allow for the immediate Official
Mapping of TH 212 because it calls for no redesign of the TH 212/101
interchange as it is presently proposed by MnDOT. It is one of two I
alternatives that is preferred by the affected neighbors and it is the only
alternative, other than Alternative 4, that is agreeable to the affected

landowners.
Alternative 2
Alternative 2 represents the easterly most alignment with rather sweeping
curves and the severest of wetland encroachments. It creates some very I
peculiarly shaped parcels while placing the roadway close to the residents
on Tigua Lane. It is an alternative that is not preferred either by
I
landowners or the neighbors and it would require some modification of the
interchange and delay the Official Mapping process for TH 212.

Alternative 3
Alternative 3 is a middle ground that takes the horse barn that was
originally owned by Keith Bartz and is now owned by Andy Freseth. It
provides the least direct access to downtown Chanhassen and represents
the most significant change in the TH 212/101 interchange. There are also
questions about the feasibility of the interchange and its spacing from the
interchange that is proposed for County Road 17. It is an alternative that
is generally acceptable to the neighbors because it takes a middle
alignment but it is not supported by affected landowners.
Alternative 4
Alternative 4 essentially represents the continuing utilization of TH 101
except for its relocation at TH 212. It leaves the roadway immediately
adjacent to the Lake Susan residences and is the least attractive from a
traffic standpoint in that it would have direct driveway entrances to TH
101. All of the other alternatives would have accesses only at public
streets. Obviously, Alternative 4 is the least expensive since it would be
constructed as an undivided highway and would not require the amount of
right-of-way (R-O-W) that other alternatives would. Alternatives 1, 2 and
3 would each require 150 feet of R-O-W to accommodate a divided
roadway with a median.
Attached is a matrix which illustrates our evaluation based on ten criteria.
This evaluation suggests that Alternative 1 should be the preferred
alternative.
RECOMMENDATION
The Consultant Team recommends that the City select Alternative 1 as the
preferred TH 101 Alignment and that it proceed to undertake the Official
Mapping of that alignment during the month of May, 1989.

Subject: Summary of the TH 101 Public Information Meeting
Held on April 17, 1989
Date: 4- 18-89
Gary Warren gave an overview of the study purpose to the 25
persons in attendance and introduced Fred Hoisington, Planning
Consultant, and Howard Preston, Traffic Engineer. Gary then turned
the meeting over to Fred to present the alternative plans.
Upon completion of the presentation, Mr. Hoisington invited
questions and comments indicating that part of the Consultant
Team's evaluation includes an assessment of neighborhood
preferences. The following comments were made during the course
of the session.
1. Alternatives 2 and 3 are generally not in keeping with what TH
101 is intended to be which is a major roadway connection
through the City of Chanhassen. The comment was directed at the
rather circuitous alignment of Alternative 2 in particular.
2. "Alternative 4 would be a disaster." The reference here was made
to the proximity of the roadway to the present Lake Susan
residences.
3. A comment was made that the forecasted traffic volumes on TH
101 (11-15,000 ADT in year 2005) were low.
4. A question was asked regarding the increase in traffic volumes
that would result from the interchange at TH 212. The concern
was that the addition of the interchange would appreciably
increase traffic volumes on TH 101.
5. A question was asked regarding how certain the TH 212
intersection was and whether it was in fact part of MnDOT's plans.
I explained that nothing is certain but that indications from the
Metropolitan Council are that a TH 212 interchange at TH 101 will
be approved.
6. Jim Curry expressed a preference for Alternative 1.
7. Another comment was made that it would be nice to have the
roadway further to the east than Alternative 1 but that the
person commenting would have concerns about moving those
traffic volumes closer to the residences on Tigua Lane. The
inference was that Alternative 1 is a reasonably good compromise
since the comment came from a Lake Susan resident.
8. Another comment was made that either Alternative 1 or 3 would
be acceptable to those in attendance at the Public Information
Meeting.
9. The Consultant was asked to review again the advantages and
disadvantages of Alternatives 1 and 3 as a means to help the
group come to some agreement on an alternative. Both Fred
Hoisington and Howard Preston explained respective land use and
traffic advantages and disadvantages of these two alternatives.
Several other questions were asked regarding the proposed extention
of Tigua Lane to the future TH 101 as per Alternatives 2 and 3. One
person also asked if they might be able to divide their property to
create an additional lot.
After considerbly more discussion, and there being no further
comments or statements of preference, Mr. Hoisington summarized
the meeting by indicating that it appeared that the results of the
Public Information Meeting would suggest neighbor support for
either Alternative 1 or 3 and that the extreme Alternatives 2 and 4
would not be acceptable to those present.

CARVER AND HENNEPIN COUNTIES, MINNESOTA
AN ORDINANCE AMENDING CHAPTER 15 OF THE CITY CODE
RELATING TO OFFICIAL MAPS AND THEIR EFFECT AND
PROVIDING PROCEDURES IN CONNECTION THEREWITH
THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
Section 1. Chapter 15 of the Chanhassen City Code is
amended by adding Article III to read as follows:
15-20 Purpose. Land that is needed for future street purposes
and as sites for other necessary public facilities and services is
frequently diverted to non-public uses which could have been
located on other lands without hardship or inconvenience to the
owners. When this happens, public uses of land may be denied or
may be obtained only at prohibitive cost or at the expense of
dislocating the owners and occupants of the land. Identification
on an official map of land needed for future public uses permits
both the public and private property owners to adjust their
building plans equitably and conveniently before investments are
made which will make such adjustments difficult to accomplish. It
is the purpose of this ordinance to provide a uniform procedure
for the proper use of official maps as authorized by the Minnesota
Municipal Planning Act, Minnesota Statutes, Sections 462 . 351 to
462 .36.
15-21 Official Map Defined. "Official map" as used in this
ordinance means a map adopted in accordance with this ordinance
showing existing streets, proposed future streets, and the area
needed for widening of existing streets of the City. An official
map may also show the location of existing and future land and
facilities within the City. An official map may cover the entire
City or any portion of the City.
15-22 Initiation of Proceedings. Proceedings for adoption,
amendment, or repeal of an official map or any part thereof may be
initiated by (1) a recommendation of the Planning Commission; or
(2) action by the City Council on its own initiative,
recommendation of an advisory commission, or request of an outside
governmental body.
15-23 Sketch Maps and Reports. Every proposal or request for an
official map or its amendment or repeal, however initiated, shall
be accompanied by a sketch map or plat showing the lands proposed
to be included and the public purpose to be served.
15-24 Reference to Planning Commission. Except when proceedings
have been initiated by recommendation of the Planning Commission,

every proposed official map or change in a map shall be referred
to the Planning Commission for advice and recommendation thereon,
and such recommendation shall be submitted to the City Council
within forty-five (45) days after reference to the Planning
Commission along with the report of the Commission on the effect
of the proposal on the comprehensive plan of the City. If no
recommendation is received by the Council from the Planning
Commission within forty-five (45) days after reference of the
proposal to the Commission by the Council, the Council may take
such action as it may deem proper upon the proposal without
further action by the Planning Commission.
15-25 Notice and Hearing.
A. Notice. Upon receiving the recommendation of the
Planning Commission or after forty-five (45) days from the
submission of the proposal to the Planning Commission without a
recommendation from the Commission, the Council may call a public
hearing on the proposal. A notice of the time, place, and purpose
of the hearing and a description of property to be included in the
mapped streets and public grounds shall be published in the
official newspaper at least ten (10) days prior to the date of the
hearing. At least ten (10) days prior to the hearing the Clerk may
also mail a copy of the notice to each owner of land situated
within or abutting any street or other public ground shown on the
official map. For purposes of this notice the owners shall be
determined by the records of the County Auditor and the notice
shall be addressed to the last known address as shown by the
Auditor's records. Failure to serve any such notice shall not
invalidate the proceedings.
B. Hearing. At the time and place specified in the
notice, the Council shall hear evidence and arguments concerning
the proposal. The hearing may be continued from time to time
without further notice. The Council may direct the Planning
Commission to conduct a hearing and following the hearing to
report its recommendation to the Council.
15-26 Preparation and Piling of Maps. The official map or maps
shall be prepared in sufficient detail to permit the establishment
of future acquisition lines on the ground. In unplatted areas a
minimum of a centerline survey shall be made prior to the
preparation of the final draft of the official map. After
enactment of any ordinance adopting an official map or amending or
repealing a previous official map ordinance, a certified copy of
the official map or section to which the ordinance relates
together with an attached copy of the ordinance shall be filed
with the County Recorder.
15-27 Effect. After an official map has been adopted and filed,
the issuance of building permits by the City shall be subject to
the provisions of this ordinance. The City shall deny every
application for a permit to construct a new building or structure
or expand an existing building or structure within any area

designated on the official map for street or other public
purposes. Whenever any street or highway is widened or improved
or any new street is opened, or any interest in lands for other
public purposes is acquired by the City, the City is not required
in such proceedings to pay for any building or structure placed
without a permit or in violation of conditions of a permit within
the limits of the mapped street or outside of any building line
that may have been established upon the existing street or within
any area thus identified for public purposes. The adoption of an
official map does not give the City any right, title, or interest
in areas identified for public purposes thereon, but the adoption
of the map does authorize the City to acquire such interest
without paying compensation for buildings or structures erected in
such areas without a permit or in violation of the conditions of a
permit.
15-28 Appeals. Whenever a building permit is denied pursuant to
this ordinance, the Board of Appeals and Adjustments shall, upon
appeal filed with it by the owner of the land, grant a permit for
building in an area designated on the official map for a street or
other public purpose in any case in which the Board finds, upon
the evidence and the arguments presented to it, (a) that the
entire property of the appellant of which the area designated for
public purposes forms a part cannot yield a reasonable return to
the owner unless such a permit is granted, or (b) that balancing
the interest of the City in preserving the integrity of the
official map and of the comprehensive City plan and the interest
of the property owner in the use of his property and in the
benefits of ownership, the grant of such permit is required by
considerations of justice and equity. The Board of Appeals and
Adjustments shall hold a public hearing upon the appeal after
notice of the hearing has been published in the official newspaper
once at least ten (10) days before the hearing. If the Board
authorizes issuance of a permit, it shall specify the exact
location, ground area, height, and other details as to the extent
and character of the building for which the permit is granted. If
the Board authorizes issuance of a permit, the Council or other
Board or Commission having jurisdiction shall have six (6) months
from the date of the decision of the Board to institute
proceedings to acquire such land or interest therein, and if no
such proceedings are started within that time, the City shall
issue the permit if the application otherwise conforms to local
ordinances.
15-29 Publication and Filing. The City Clerk is hereby
authorized and directed to publish this ordinance in accordance
with law and to file a certified copy of this ordinance in the
office of the Carver County Recorder.
Section 2. This ordinance shall become effective
immediately upon its passage and publication.
