DATE: August 23 , 1989 ISUBJ: FMG Sign Request On July 13 , 1989, the City sent a letter to Fragrance Marketing I Group (FMG) , requesting the removal of two directional signs located off of Market Boulevard. The location of the signs were not permitted by the zoning ordinance and FMG removed the signs I upon receipt of the letter. Staff informed FMG that they could apply for off-premise directionals signs. Off-premise signs are allowed only in situations where access is confusing and traffic safety could be jeopardized or traffic could be inappropriately I routed through residential streets . The size of the sign shall be approved by the City Council and shall contain no advertising. I FMG applied for a sign permit to locate two off-premise direc- tional signs ( Sign #1 - 3 . 7 sq. ft. and Sign #2 - 3 . 1 sq. ft. ) . The off-premise directional signs are proposed to be located at I the southeast corner of Market Boulevard and West 78th Street and along Market Boulevard (Attachment #1 ) . Both off-premise signs are proposed to be located within public right-of-way. Section 20-1265 of the Zoning Ordinance forbids any signs other than I governmental signs to be located on the public right-of-way (Attachment #2) . I FMG is located to the south of Chanhassen Bowl and to the north of an un-named road known as "Bowling Alley Road" (Attachment #3 ) . The applicant is requesting two off-premise signs because I they feel that their address, 571 West 78th Street, is confusing when actually access to their property is off of another. In the past the City has only permitted off-premise directional l signs when access is confusing and when the off-premise sign is not within the right-of-way. Since the proposed off-premise signs would be located within public road right-of-way, staff I must recommend denial of the proposed off-premise signs . The applicant may relocate the off-premise signs out of public right- of-way. The applicant could also pursue having the un-named, street where their business is accessed from to be named and to IIhave their address changed to reflect that street. 1 Mr. Don Ashworth August 23 , 1989 Page 2 RECOMMENDATION 1 Staff recommends the City Council deny the request for an off- premise directional signs as proposed by the applicant because they would be located within public right-of-way. Manager ' s Comment FMG may have a problem besides their sign. It is my recollection that the sale of the building to Gary Kirt, then re-assigned to Bloomberg, was required to redevelop the FMG portion of the building into a non-industrial use. Temporary storage was allowed. I am led to believe that manufacturing is occurring on site. The sign issue could become a moot point. (a) To encourage design excellence, the maximum sign areas for certain businesses, industrial,and directory signs may be increased up to a maximum of ten(10)percent based on the original sign area limitation., (b) Ground profile,free standing and wall signs may be increased as follows: (1) When the sign is constructed of solid wood and uses only earth tone colors. (2) When the sign(except for wall signs)is installed in a landscaped planter. (Ord. No. 80,Art. IX, § 10, 12-15-86) Sec. 20-1262. Uniform Sign Code. The design and construction standards as set forth in Chapter 4 of the 1985 Edition of the Uniform Sign Code as may be amended, are adopted. (Ord. No. 80, Art. IX, § 2(9-2-1), 12-15-86) Sec. 20-1263. Electrical re ' gulations. The installation of electrical signs shall be subject to the National Electrical Code as adopted and amended by the city. Electrical service to such sign shall be underground. (Ord. No. 80, Art. IX, § 2(9-2-2), 12-15-86) !� Cross reference—Technical codes, § 7-16 et seq. Sec. 20-1264. Address sign required. Except for farm buildings, at least one (1) address sign identifying the correct address shall be required on each principal building, accessory building, or mail boxes in all districts. The numbers shall be at least three(3)inches in height. (Ord. No. 80, Art. IX, § 2(9-2-16), 12-15-86) Sec. 20-1265. General location restrictions. (a) No sign or sign structure shall be closer to any lot line than a distance equal to one-half(1/2)the minimum required yard setback. No sign shall be placed within any drainage or utility easement. (b) Signs on adjacent nonresidential property shall be positioned so that the copy not is visible from residential uses or districts along adjoining side and rear yard property lines. (c) No sign other than governmental signs, shall be erected or placed upon any public street, right-of-way or public easement, or project over public property. (Ord. No. 80, Art. IX, § 2(9-2-11, 9-2-15, 9-2-17), 12-15-86) Sec. 20-1266. Maintenance and repair. Signs and sign structures shall be properly maintained and kept in a safe condition. Sign or sign structures which are rotted, unsafe, deteriorated`or defaced shall be repainted, re- paired or replaced by the licensee, owner or agent of the building upon which the sign stands. (Ord.
