I As a part of the feasibility study effort, significant time has been spent with MnDOT concerning the redesign of this crossing. Initially, it was hoped that a single crossing could accomnodate this tough intersection; however, MnDOT's pre- ferences, which we have complied with, now dictate that two crossings will be 1 required, one to accommodate West 78th Street and the other main crossing to accommodate the remaining roadways in this area as shown on the attached maps. 1 As is typical, the Soo Line Railroad has objected to the modification of this crossing. The same response was given on the Market Boulevard crossing which the City has recently had installed and the Great Plains Boulevard modifica- 1 tions. The nature of the process from the Railroad's standpoint is that any crossing increases the Railroad's liability in contrast to not having a crossing at all, and therefore the accepted avenue for dealing with the public need as provided by the Commissioner of Transportation, is to conduct a public hearing Ito determine whether the grade crossing should be established. The first step in this process is for the City to formally request, by resolu- 1 tion, MnDOT to conduct a public hearing on the matter. Since this crossing is a vital element to the completion of the City's Trunk Highway 101 realignment plans as provided in the November, 1988 feasibility study, and in light of the ' lengthly timeline involved in completing this process, it is therefore recan- mended that the City Council approve the attached resolution as prepared by the City Attorney's office petitioning the Commissioner of Transportation to conduct a public hearing to determine whether public grade crossings should be established IIon Trunk Highway 101 at the West 78th Street frontage road and Dakota Avenue. C'P'. ._-----i--- --- _1-1/j- ___ _____-__-____/ 1,/`- / - � - �/ \\\ tea � ., i A / �1 i 1 t I..M_ � � I -. // 1, 070.Ce• • MA CM \ k 1 J CITY OF CHANHASSEN ' CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION 4 'DATE: RESOLUTION NO: MOTION BY: SECONDED BY: ' A RESOLUTION PETITIONING THE COMMISSIONER OF THE MINNESOTA DEPARTMENT OF TRANSPORTATION TO CONDUCT A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC GRADE CROSSINGS SHOULD BE ESTABLISHED ON TH 101 AND THE WEST 78TH STREET FRONTAGE ROAD WHICH WOULD TRAVERSE THE RIGHT OF WAY AND TRACK OF THE SOO LINE RAILROAD COMPANY IN CHANHASSEN, MINNESOTA WHEREAS, a critical element of the Downtown Redevelopment Plan , was the relocation of TH 101 from the current downtown corridor to Dakota Avenue. As a result of meetings with the public, City staff and MNDOT, it was concluded that the Dakota Avenue route was the best alternative; and WHEREAS, the land use/transportation study commissioned by the City dated August 1, 1986 and the subsequent Broadened Study Area Plan recognized a need for a railroad crossing if TH 101 was ' relocated to Dakota Avenue; and WHEREAS, the Dakota Avenue reallignment and crossing is the alternative deemed most acceptable by MNDOT; and ' WHEREAS, a Feasibility Study was conducted for the project, and the City has concluded the improvements are feasible; and ' WHEREAS, the construction of the roadways and railroad grade crossings are programed for 1991 construction season; and i e' WHEREAS, the Soo Line Railroad Company has objected to the ' installations for reasons of cost and liability, and negotiations to date have been inconclusive; and ' WHEREAS, the Feasibility Study included the capital improvement costs for construction of the grade crossings. ' NOW, THEREFORE, BE IT RESOLVED by the Chanhassen City Council as follows: 1. The City hereby requests that the Commissioner of the ' Minnesota Department of Transportation conduct a public hearing to determine whether public grade crossings should be established on ' TH 101 and the West 78th Street frontage road which would traverse the right-of-way and track of the Soo Line Railroad Company in ' Chanhassen, Minnesota. ' 2 . The City Manager and City Attorney are hereby directed to initiate the hearing process, and to represent the City at the hearing.
