Re-initiate Feasibility Study - Phase I
IIThe project which was initiated in 1987 is now, I believe , ready
to proceed forward. As noted in the attachment, the
I right-in/right-out entry condition access has recently been
approved by the County for the Burdick and James property. As
with a number of our more complex downtown improvement projects ,
I time has been somdwhat of an ally in allowing some of the unknown
aspects of the project, such as the interface with Trunk Highway 5
improvements and storm water retention on the Eckankar property,
to be solidified.
When the City Council decides to make a public improvement, it
must, by statute , within one year of adopting the resolution
I ordering the improvement, let the contract for all or part of the
work. In this regard, a public hearing was held on August 22 ,
1988 on the Supplemental Report No. 1 to the original feasibility
I study and the project was ordered at that time . Since one year
has lapsed without contract letting, it is necessary to re-
initiate the project and also to update the plans and specifica-
tions in light of the County Board' s recent action to permit the
I right-in/right-out connection to County Road 17 as petitioned by
the Burdick and James properties. The attached memorandum pre-
pared by BRW updates the project costs for this project.
I Likewise, the attached assessment roll which was presented in the
1987 feasibility study is reasonably accurate at this time by
applying a 10% inflation factor to the figures as mentioned in
the BRW memorandum. The roll has been highlighted to indicated
IIthe Phase I properties .
Super-elevation design constraints at the TH 5/County Road 17
I crossing may result in MnDOT actually constructing the portion of
County Road 17 improvements between TH 5 and the detachment
intersection. This is currently being coordinated with them and
Iwill be worked into the plans and specifications as appropriate.

As such the City should anticipate some cooperative participation
on the part of MnDOT in the funding of this aspect of the road-
way.
A benefit of this should be that while inflation has
increased our construction dollars from the original 1987 estima-
tes, MnDOT' s anticipated cost participation on this project could
now potentially offset these increases. '
The construction schedule at this time that would appear to make
the most sense (cents , too ) is to complete the plans and specifi-
cations
this fall such that the project can be bid during the
more favorable winter bidding climate. The project would then be
ready for construction as soon as weather permits in the spring
of 1990 and completed in 1990 for all intents and purposes.
With this information and after the close of the public hearing,
it is the recommendation of this office that the City Council re-
initiate
the feasibility study for Improvement Project No. 87-2,
Phase I, and order the improvement project by authorizing the
updating of the plans and specifications to incorporate the
right-in/right-out connection to the Burdick and James property,
and to coordinate the construction documents with MnDOT' s
involvement on the County Road 17/TH 5 aspects of this project.

IIDear Gary,
As a result of the apparent decision to reconsider and allow a right-in, right-
out entrance drive from CSAH 17 (Powers Boulevard) to old West 78th Street
' (instead of a cul-de-sac) , and because it has been about one year since this
project was last initiated, the project costs should be reexamined, and the
feasibility study and project reinitiated.
IThe original feasibility study for this project was completed in July of 1987.
The original feasibility study considered and was based upon a right-in, right--
out private drive from Powers Boulevard to the old West 78th Street when the new
IWest 78th Street detachment was constructed. Subsequent to this study, a
Supplemental Report #1 was issued, which addressed alternative considerations.
As a result of recent decisions, the original feasibility study should be
I "reaccepted" or "reinitiated" for this project.
I believe that the primary content of that report remains Germain and effective
Ito the project. However, I would like to reclarify past decisions, and update
the project costs to reflect applicable changes since that study was completed
in 1987.
IIssues I would like to reconfirm or clarify are as follows:
#1 Two storm sewer alternatives were presented in that study. Alternative A
I which drains to the Eckankar property, was the selected alternative. In
our )pinion, this remains the best alternative, the project has been
designed in this fashion, and other decisions have been made which support
Ithis alternative.
#2 The private drive which was the primary focus of contention was originally
II intended as a 24-foot wide drive. This has since been modified to include
a 28-foot wide drive at the direction of Carver County.

#3 Subsequent to the original feasibility study, design activities have been ,
initiated for TH 5. As a part of those activities, modified designs have
been considered for the TH 5/Powers Boulevard intersection. (In particular
to accommodate the right-in, right-out to the private drive.) It is our
understanding that we will continue to work with Mn/DOT to complete a con-
sistent design in this area, and to further define the limits of work for
this project and the TH 5 reconstruction project by Mn/DOT. '
#4 Subsequent to the original feasibility study, an additional requirement for
storm water ponding has been placed upon this project. We are currently
examining alternative storm water pond locations for discharge of local
runoff prior to discharge into the Eckankar ponding area. Additional costs
can be expected as a result of this requirement for additional ponding.
#5 Subsequent to the original feasibility study, the need to extend the limits
of construction further north on Powers Boulevard were identified. This
change has resulted in modified project costs. ,
#6 Phase I construction is now being considered for 1990 rather than 1988, as
considered in the original feasibility study. We have updated the project
costs to account for inflation, etc.
Reinitiatlon of the project should be made based upon the original feasibility
study dated July 1987. The clarifications outlined above, and the modified pro-
ject costs for Phase I are outlined below:

' As outlined in the original feasibility study, the project was to be financed by
General Obligation (or Tax Increment Funds) and special assessments. We esti-
mate that costs Incurred above the original feasibility study for the reasons
' outlined above are all primarily general obligation costs, and will not be a
significant part of the special assessments. The assessment role, as provided
in the original feasibility study and the subsequent public hearings, remains
applicable with the following exception:
' #1 As outlined in Clarification #6 above, the project costs were increased by
ten percent to reflect 1990 versus 1988 construction. Therefore,
' assessment amounts, as listed in the original assessment role should be
increased by a corresponding rate, although there may be a compensating
effect depending upon Mn/DOT participation on the County Road 17 portion of
' the project.
In conclusion, I would like to clarify two other issues.
' First, this reinitiation addresses only Phase I of the original feasibility
study, which includes all improvements lying north of TH 5. Improvements lying
south of TN 5 which were a part of Phase II , are not addressed in this
' reinitiation.
Secondly, that the project costs and assessable amounts are a function of the
' final bidding process, and land acquisition costs and final assessments will
reflect actual costs determined during the assessment hearing at the conclusion
of the project.

WHEREAS, Carver County is authorized under Minnesota Statute 160 to control access to
County Roads, and
WHEREAS, the City of Chanhassen has proposed a relocation of the 78th Street entrance
onto CSAH 17(Powers Blvd.)from its present location to a point approximately ,
340 feet north of its present location, and
WHEREAS, B.C."Jim"Burdick and T.F.James Company have submitted a joint application,
made a part hereof,for a"right in-right out"private access at the existing 78th
Street entrance onto CSAH 17 (Powers Blvd.), and
WHEREAS, Carver County did act on a 1988 request from the City of Chanhassen to take
the appropriate action to either permit or deny a private access at the existing
78th Street entrance onto CSAH 17(Powers Blvd.)as documented by Carver
County Board of Commissioners Resolution No. 20-88, made a part hereof,
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners in and for the
County of Carver, Minnesota,that said County Board Resolution No. 20-88 is
hereby rescinded, and
BE IT FURTHER RESOLVED, that the Carver County Board of Commissioners hereby
approves the said "right in - right out" private access requested jointly by B.C.
"Jim" Burdick and T.F. James Company at the existing 78th Street entrance
onto CSAH 17(Powers Blvd.),as detailed in the permit application for the same, '
subject to the following provisions being incorporated into and made a part of
the private access permit:

Inc. memorandum to the City of Chanhassen shall be the maximum
' permitted traffic movements during any one hour of any one day at said
access. Carver County hereby retains the right to close or modify said
access in any way Carver County deems appropriate if said maximum
' permitted traffic movements are exceeded.

BE IT FURTHER RESOLVED, that the County Public Works Department be and hereby is
authorized and directed to issue said "right in - right out" private access subject to this
resolution being incorporated as a part thereof.
