BOX 147 •• CHANHASSEN, MINNESOTA 55317-- '° -•,3'J (612) 937 1900 ' MEMORANDUM of-754/ TO: Don Ashworth, City Manager FROM: Gary Warren , City Engineer DATE: April 5 , 1989 "— /O-E7`" ' SUBJ: Authorize Execution of Utility Easement, County Road 17 and County Road 18 , City of Chaska ' File No. PW024D The City of Chaska wishes to acquire a permanent and temporary ' easement from the City of Chanhassen at the intersection of County Road 17 and County Road 18 for the construction of a 16-inch watermain . Attached is a copy of the proposed easements ' that the City of Chaska would like to have executed by the City of Chanhassen . ' You will note that the permanent easement is . 03 acres and the temporary easement is . 18 acres . The City of Chaska ' s appraiser has appraised the value of the permanent easement at $330 and the temporary easement at $420 . This appears reasonable. Although ' this location is well outside of the City ' s urban service area, it would be my recommendation to also include in the easement agreement the right of the City of Chanhassen to connect to the ' watermain if conditions would warrant in the future. It is therefore recommended that the attached temporary and per- ' manent easements be granted with the connection condition as noted above. ' Attachments 1 . Temporary and Permanent Easements. ' 2 . Map. 4I EASEMENT ' THIS INDENTURE, Made and entered into this day of 1989, by and between the City of Chanhassen, a municipal corporation organized under the laws of the State of Minnesota, party of the first part, and the City of Chaska , a municipal corporation organized under the laws of the State ' of Minnesota, parties of the second part; WITNESSETH: Said party of the first part, in consideration of the sum of One Dollar ($1 .00) and other good and valuable consideration to it in hand paid by said party of the second part, the receipt and sufficiency whereof is hereby acknowledged, does hereby Grant, Bargain, Quit Claim and Convey unto said party of the second part, its successors and assigns, a perpetual easement for utility purposes over, under and across the following described property, to- wit: A perpetual easement for public utility purposes over, under and ' across the following described property: Commencing at the Center of Section 22, Township 116, Range 23 Carver County, Minnesota running thence South 4.28 chains ; thence West 4.28 chains ; thence North 4.28 chains ; thence East 4.28 chains to the starting point and containing 1 .83 acres of land. Said land is situated in Government Lot 2, Section 22, Township 116, Range 23. Said perpetual easement being described as lying south of the north t 80.00 feet of the above described property and lying between two lines distant 45.00 feet and 55. 00 feet respectively to the west of the centerline of C.S.A.H. No. 17 as described in Book 168 of Deeds, Page 269. First party does further grant to second party, its successors and assigns , a temporary construction easement over, under and across the following described property, to-wit: Together with a temporary construction easement over, under and across the first above described property, said temporary easement being described as lying 35. 00 feet to the west of the above described perpetual easement. Together with a temporary construction easement over, under and ' across the south 25. 00 feet of the north 105.00 feet of the west 140 feet of the above described property. _ -z Said temporary construction easements shall automatically expire by its terms , upon completion of construction or December 31, 1989, whichever occurs first.
