ISUBJ: Consider Authorizing Condemnation
I Given that staff has identified other alternatives for the City
Council to review during the realignment of TH 101, condemnation
of the New American Homes Shopping Center property is not recom-
mended at this time. The Council should be aware that approval
I of the site plan application will enable the applicant to prepare
the necessary drawings for a building permit application. If the
other alternatives identified cannot be pursued and the original
I proposal for realignment is the remaining option, the city would
have to evaluate authorizing condemnation on the property once
again and potentially with the building and parking improvements
already built on the property.
IThe following item on the agenda indicates that the applicant has
revised the site plan in compliance with staff' s conditions and
I the Planning Commission' s direction. Given that all city
requirements have been met during site plan review, the following
item recommends approval of the site plan subject to various
1 standard conditions.
