As cer- tified by the attached affidavit of mailing, all affected proper- ties and properties anticipated to be assessed for improvements have been notified of this hearing. Two letters have been ' received from interested parties concerning the project . One is from Mr . B. C. Burdick who objects to being assessed for the pro- ject and the second letter is from Mr. Charlie James. ' Attached is a copy of the preliminary assessment roll dated August 11 , 1988 which had not been included in the original supplemental report. A copy of this roll has been transmitted to Mr. Burdick and Mr . James. Please remember to bring your copy of the Supplemental Report No. 1 to the Council meeting. If you have misplaced your copy , please contact Kim Meuwissen at City 1 Hall for another . Gary Ehret of BRW and I will be present at the August 22 meeting to answer any public comments presented and discuss the attached letter from Mr. James. If after the close of the public hearing the Council wishes to proceed with adding this cul-de-sac roadway to the project scope , a resolution authorizing staff to prepare plans and specifica- tions would be in order. As stated in the attached staff report dated June 9 , 1988 , this supplemental report was necessi- tated by the denial by Carver County of a right-in/right-out con- nection at County Road 17 for the existing alignment of West 78th Street. The attachments thoroughly review the conditions surrounding this issue. Attached is Supplemental Report No. 1 prepared by BRW as requested by the Council. The report specifically addresses the cost of improvements and the feasibility of constructing the remaining portion of existing West 78th Street as a public road- way cul-de-sac. The remaining aspects of the original feasibi- lity study have not changed, however , we have taken the opportunity in this supplemental report to upgrade the costs from the original report to reflect anticipated construction of these facilities in 1989 and 1990 instead of 1988 as originally thought. MnDOT' s accelerated schedule for Highway 5 improve- ments may also dictate a rethink of this construction schedule. To refresh everyone 's memory, the project was split into two pha- ses, Phase I being the improvements north of Highway 5 and Phase II being those improvements south of Highway 5 . The remaining portion of West 78th Street was to become a private service drive at the expense of the abutting property owners. With this supplemental report , the private drive becomes a public cul-de- sac and the abutting properties in turn are proposed to be assessed for the cost of the cul-de-sac construction and ancillary improvements. It should be noted that a small segment (105 feet by 45 feet) of additional right-of-way will be required from Lot 1 , Block 1 of Burdick Park 2nd Addition to accommodate the cul-de-sac on the Burdick property. The report has not included any acquisition costs for dedication of this right-of- way, assuming it would be dedicated at no cost to the City. In light of recent condemnation proceedings concerning Burdick pro- perty, this may not be a realistic assumption. I ATTAc MENT 1* I Don Ashworth July 21, 1988 Page 2 Escalating the construction costs fo r 1989 and 1990 by 2% and 4% ' respectively, the total estimated project cost for Phase I and Phase II is $2 ,157, 900 versus the original feasibility study estimate of $1 , 940 ,500 . Applying the assessment policies con- sistent with the original feasibility study report and giving a ' 5/30 credit for the remaining value of the existing West 78th Street roadway ( i.e. 5 years useful life remaining) , generates assessable amounts of $1 ,053 ,100 with the remaining $1,104, 800 to be covered by tax increment financing. It is there- fore recommended that the attached Supplemental Report No. 1 for the West 78th Street detachment feasibility study be accepted by the City Council and a public hearing be scheduled for August 22 , ' 1988. C. Burdick, for them to II construct and utilize as a private drive for access to their properties (see map). A right-in/right-out connection to Powers Boulevard at the existing intersection of West 78th Street was anticipated at that time. Since this was a ' connection to a County road, the jurisdiction for this connection laid with the Carver County Board. The County Board has recently denied this right-in/right-out connection to Powers Boulevard (Attachment No. 2) . This leaves the connection and access issue unclear as it relates to the Burdick pro- II perty. The County Caimissioners have agreed to listen to an appeal from Mr. Burdick, however, it is anticipated that they will uphold their denial of this right-in/right-out connection. 1 Discussions we have had in the past, including my discussions with the City Attorney, have concluded that it would be appropriate to consider amending the II West 78th Street feasibility study to look at the construction of a public street cul-de-sac in the area that was anticipated for the private drive, to properly address street access for the Burdick property. Mr. James has verbally indicated to me personally that he does not care whether or not this is a public II or private roadway. Amending the feasibility study would prompt a new public hearing which would also allow Mr. Burdick further opportunity to voice his opi- nions to the City concerning this issue. I It is therefore recaimended that the City Council authorize amending the West 78th Street feasibility study dated July 20, 1987 to address the construction of II a public street cul-de-sac along the previously proposed private drive access between the James and Burdick property. Swamcnn WHEREAS, Carver County is authorized under Minnesota Statute 160 to control access to County Roads, and WHEREAS, the City of Chanhassen has proposed a relocation of the 78th Street entrance onto CSAH 17 ( Powers Blvd. ) from its present location to a point approximately 340 feet north of its present location, and WHEREAS, the plan includes a proposed " right in-right out" ut private access at the existing 78th Street entrance onto CSAH 17 ( Powers Blvd. ) , and WHEREAS, construction of the "right in-right out" access and the 78th Street entrance as proposed would result in two accesses on CSAH 17 within 650 feet of T.H. 5, and WHEREAS, the Carver County comprehensive plan classifies CSAH 17 as a minor arterial roadway, and the access standards therein state that the desirable access control in- cludes "No access between Public Streets" , and 11 WHEREAS, considerable discussion has been held among Carver County , the City of Chanhassen and the involved developers concerning the private entrance, and WHEREAS, the Benshoof & Associates , Inc . study of the " right in-right out" access states "Negative traffic impacts could occur if this drive were used as a ' short cut ' for traffic destined to the Downtown area' . The report also lists measures to possibly alleviate the use of the access as a short-cut. I do not anticipate being able to attend this meeting , and I have suggested that the meeting be re-scheduled. Since it is not feasible to re-schedule, I would like to submit my written comments for the public record and would ask that you enter this letter into the record of the Public Hearing. ' My primary concern is to minimize the costs and assessments to the property owners in the vicinity of this project. The proposed assessments for this project would be an impossible burden were it not for the opportunity to mitigate these costs through the use of Tax Increment Financing. This miti- gation will be successful only if the development of the properties can pre- ceed the assessment levy, and this is no small risk. I would like to make a suggestion: Since MN DOT is accellerating the Hwy 5 improvements, can the City get State money to help with the W. 78th project, particularly since the City and property owners are providing the W. 78th Street R.O.W. at no cost to MN DOT and the relocation is being occasioned by the proposed Hwy 5 improvements. The West Village Heights plat and the site plan for Block 2 Lot 1 were devel- oped in full consideration of the future access needs of Mr. Burdick. The driveway location was determined to give full access to Mr. Burdick at the first point where his preliminary plat indicated a driveway would be allowed. We designed our site plan and building around the access points. , Furthermore, we have platted an outlot which is available to the City or Mr. Burdick. The original intent of the creation of this outlot was to provide latitude for the design geometries of the driveway connection to W. 78th. However, in order to meet the lot coverage and landscape ratios required for Lot 1 Block 2, we had to incorporate additional land to the east side of this driveway, thus decreasing the size of the outlot and creating a strip of land between the outlot and the driveway. See Exhibit "A" attached hereto. I anti- cipated that the City would trade the outlot to Mr. Burdick for land required by utility or street improvements and that I would grant an easement to Mr. Burdick to use the driveway as part of a larger encompassing non-easement agree- ment for the private driveway to be maintained by the two parties on the vacated portion of W. 78th Street. I had anticipated that in exchange for donating the new right of way, I would be given an appropriate portion of the old R.O.W. ' If the existing West 78th is to become a cul-de-sac and to remain a public street, I would like to see a partial vacation of the remaining R.O.W. to allow for the minimum R.O.W. instead of 75' now existing as 40' on Burdick and 35' on James. Notwithstanding the above, as to whether this is a public or private roadway 1 per se, I have no strong opinion.
