Trunk Watermain
Project No. 86-2
On August 24 , 1987 the City Council approved the assessment roll
for the Chanhassen Hills trunk watermain (minutes attached) . The
• assessment is a unit assessment based on acreage and density.
From day one in the project, the City' s consultant has had dif-
ficulty with clearly identifying the proper ownerships in this
area as well as piecing together the property descriptions to
identify all of the proper parcels for the roll. I was lead to
believe that they had gotten closer than it has turned out .
With the Lake Susan Hills PUD and subsequent ownership transfers
thereof ( i . e. Argus Development) , some of the property ownership
questions have come to light and errors have been identified in
the roll. Through the assistance of Mr. Don Patton representing
the Lake Susan Hills Partnership, and the work that their con-
sultants have done for their own property transfers , we have been
able to piece together with confidence the accurate parcel
ownerships and acreages. We have had several meetings with Mr.
Patton and have prepared a revised assessment roll that agrees
now with the actual properties in the assessment area.
There were also some calculation errors in the roll prepared by
our consultant . One major error was found in the calculation of
the assessment for the first property on the roll, PIN
25-0140200 . Instead of multiplying the acreage by the 1 . 85 unit
density, the consultant divided and came up with 90 less units or
approximately $52 ,000 less than what should have been assessed.
These calculation errors have also been corrected on the supple-
mental roll.
The original dollar value of the assessment roll was $443 ,682. 89 .
The revised assessment roll now levies $514 , 838 . 95 or an increase
of $71 ,156 . 06 over the original roll. The attached supplemental

roll dated August 9 has recalcul ted the assessments fo
those properties which are affected and comes up with a net
supplemental assessment recognizing the payments that were made
by the property owners in the 1988 tax year.
Adoption of the supplemental assessment roll follows the same
procedures as the original roll in that a public hearing needs to
be called and held prior to certification to the County. It is
therefore recommended that the attached supplemental assessment
roll dated August 15 , 1988 for the Chanhassen Hills trunk water-
main be accepted and a public hearing be called for September 26 ,
1988.

Improvement Project 86-2
The Chanhassen Hills Trunk Watermain Project was completed
early this spring. Final project costs totalled $394,655 .21 . A
detailed breakdown of this cost is attached. Those properties
deriving direct benefit are proposed to be assessed. The map in
the feasibility study excerpt depicts the benefitting area.
A development rate of 1 .85 units per acre was recommended in the
feasibility study. Building units in excess of 1.85/acre are
' collected with the building permits . The trunk assessment is
based on land area and building density and not actual construc-
tion costs . As such, the dollars assessed are typically higher
than the actual project cost. The proposed assessment amount in
this case is $443 ,682 .89 . Excess funds are deposited in the
City' s Water Expansion Fund to also pay oversizing and other
general benefit costs associated with the water utility
throughout the service area.
As is explained in the Summary of Project Costs , several property
areas required adjustment from the feasibility study. The Carver
I County records have been very difficult to interpret. As such,
the total assessment income is less than the feasibility study
projection, i .e. $443 ,682 .89 versus $576 ,434 . Since this is an
area/density assessment, this difference does not pose a problem
as the actual trunk charges will be recovered as the property is
developed.
This project also includes a lateral assessment for those proper-
ties which abut the watermain as it traversed through the
Chanhassen Hills First Addition ( see map and assessment roll) .
- Notice for this assessment was duly advertised and individual
mailings were directed to all affected property owners .

It is therefore recommended that the Chanhassen Hills Trunk
Watermain, Improvement Project 86-2, be assessed in conformance
with the method described in the approved feasibility study, as
noted on the attached assessment roll. Further, that the
assessment term be set at 4 years with a 9% interest rate. This
is based on the results of the bond sale for the Bonds of 1986 ,
which provides the long-term financing for this project. I

The overall overhead is 24.8%, based on construction contract
' cost and total cost.
Assessments
' The assessment roll is enclosed. Please note that the P.I.D.
numbers on the computer output have been revised, since Carver
County's P. I.D. system is different from that used in other coun-
' ties. A sheet listing the actual P.I.D. and the corresponding
computer output P.I.D. is enclosed.
Trunk assessments are based on $650 per unit and 1. 85 units per
acre. Several areas were adjusted or computed by us, as follows:
25-014-0200: We calculated the railroad ROW at 0.45 acre
' with Section 14. Therefore, assessed area + 68.25 - 3 - 0. 45
- 45.07, or 19.73 acres.
25-022-1100: We deleted the 0.22 acres in Section 22, which
clearly is outside the assessment area identified in the
feasibility.
25-023-1600: Total plat area = 24 .46 acres from Ron Krueger
Associates. Portion in Section 14 consists of Outlot A, Lot
9, and Lot 15, plus northerly 15 ' of Lots 10 - 17 = 6. 97
acre.
Plat area in Section 23 = 24. 46-6. 97=17.49 acre.
Area 261.81 X 245 = 1.47 Acre
So: Assessable area in 25-023-1600 = 59 . 02 - 1. 47 - 17.49 =
40. 06 acre.
Lateral assessments were based on estimated prices of $13/LF for
6 inch watermain and $400/each for 6 inch valves. Fittings and 3
hydrants also were included in the lateral charge. The overall
overhead of 24 . 8% was used.

The service assessment was based on the bid prices for a connec-
tion and 30 L.F. of service pipe, again using the 24.8% overhead.
The lot and block numbers for the plat have been revised since 1
the feasibility study was prepared. The lateral benefit lots
were assessed as follows: (please refer to Appendix B of the
feasibility report) . 1
Block 4, Lots 21-29 : 593 front feet, assessed to parcel 25-
023-1700.
Block 3 , Lots 16-25: 876 front feet were assessed to 25-023-
1600. Lots 34 and 35 were not assessed; they were not given
services and will receive lateral benefit from the north-
south streets.
Block 7, Lots 4-6 and 15-16: 504 front feet were assessed to
25-023-1600. Lot 1 will receive lateral benefit from the
north-south street. Lots 2 and 3 are assessed individually
as 25-185-0410 and 25-185-0420.
Block 2, Lot 8 and Block 8, Lot 1 also will receive lateral
benefit from the north-south street and are not assessed for
lateral benefit here.
As I mentioned to you, the total assessment income is less than
the feasibility study projected, although, it still exceeds the
project cost by about $50, 000. Apparently this is due to discre-
pancies in the parcel numbers and areas as presented in the fea-
sibility compared to those in the assessment roll. As you re-
call, the parcel numbers and areas have been the cause of some
confusion. We are measuring the area to be assessed as presented
in the feasibility for comparison with the assessment roll. We
will let you know our findings shortly. 1

The City Council will hold a public hearing to consider proposed

All written objections to the assessment not received prior to or '

failure to object prior to or at the assessment hearing is due to
a reasonable cause.
An owner may appeal an assessment to the District Court pursuant
to Minnesota Statute Section S429. 081 by serving notice of the
appeal upon the Mayor or City Clerk of the City of Chanhassen
within thirty (30) days after the adoption of the assessment and
filing such notice with the District Court within ten (10) days
after service upon the Mayor or City Clerk. I
Residents who are 65 years of age or older, or retired by reason
of permanent and total disability may apply to have payment of
the assessment deferred. The application shall be made to the
City Clerk within thirty (30) days after the adoption of the
assessment roll by the City Council.
City staff will be available between the hours of 8"00 a.m. to
4:30 p.m. weekdays until the time of the public hearing to answer
questions about the proposed assessments. You may also telephone
City staff at (612) 937-1900.
You will be notified by mail of any changes adopted by the City
Council in interest rates, prepayment requirements or the amount
of the adopted assessments from those contained in this notice.

17 IX PROJECT HISTORY 1
This feasibility report was authorized by the Chanhassen City I
Council at its meeting on May 5, 1986, as a result of a petition
by a developer, Meritor Development Corporation. The petition
was submitted to request a feasibility study addressing the II extension of a trunk watermain to their proposed development,
Chanhassen Hills, located on the south side of Lake Susan. The
proposed project area is shown in Exhibit A.
PROPOSED WATERMAIN EXTENSION II
11 Currently, no watermain exists in or near the proposed project
II
area. The closest watermain lies on the north side of Lake Susan
extending west to County Road 17 (Powers Boulevard) from Well
10 Number 4. According to a report titled "Water system Analysis II for the City of Chanhassen", prepared by OSM, the ultimate water
system plan calls for an extension of the 18 inch watermain south
Ill along County Road 17 to County Road 18 (Lyman Boulevard) , then
east on Lyman, then north on the east side of Lake Susan and
II
looping finally back into the system at Well No. 4.
F3 The ultimate development plan proposed in the report represents a
I
concept plan and is, therefore, subject to revision as °
development in the area occurs. With the proposed Chanhassen
I:I Hills development on the south side of Lake Susan, such a II revision is warranted. By routing the proposed watermain through
the Chanhassen Hills Addition rather than along Lyman Boulevard,
II the trunk watermain can provide lateral benefit to lots within
the development. The proposed trunk watermain alignment is shown
II
in Exhibit A. The alignment within the Chanhassen Hills
development is shown in greater detail in Exhibit B.
ilFour hydrants are proposed along County Road 17 to serve future
II development and to facilitate watermain flushing.

construction begins.
PROJECT FUNDING
IPThe project is proposed to be funded by combination y a tion of trunk
benefit and lateral benefit charges.
11111 Lateral assessments are proposed for benefited lots within the
proposed Chanhassen Hills plat. A lateral benefit of $24 .59 per
ill front foot is proposed, based on the estimated cost of a 6 inch
lateral along the watermain alignment within the plat boundary.
This lateral assessment includes the cost of service connections
Fil and service pipe extended to the property line. Front footages
are tabulated in Appendix B. The proposed lateral benefit
assessment would total $63, 655.
fl The proposed Chanhassen Hills Addition would be assessed a trunk
charge of $650 for each of the proposed 232 units, for a total of
$150,800.
IF Areas on either side of County Road 17 would derive benefit from
the proposed project because they could connect readily to the 18
inch trunk watermain. Therefore, it is proposed to assess a
IF trunk charge on the basis of $650 per unit and 1.85 units per
acre to benefited areas outside Chanhassen Hills. These

The project is feasible and will benefit the areas served. I
The total estimated cost for the project is $416, 600. Lateral
benefit assessment of $63 , 655 is proposed for the Chanhassen II Hills Addition. Trunk benefit assessment of $512 ,779 is proposed
for Chanhassen Hills and for other benefited areas to the west
and northwest. The total proposed assessment is $576,434. II We recommend that this report be accepted and that a public
hearing be scheduled for the proposed project.

state of flux?
\ . Gary Warren: Pending on those corrections of some acreage and then Roger can

' Mayor Hamilton: You've got to approve them with conditions and those
conditions will come back.
' Don Ashworth: This is one that I had talked to Mr. James about and I
apologize for not getting it in my report. We verified the bond years and
that was longer than the four years. I can't remenber if it was 8 or 10?
' Gary Warren: 10.
Don Ashworth: We would not want to exceed the bond years. When we initially
_put this in we felt that we had it right. We went back and it is a 10 year
period of time so the City Counci could go 8 to 10 years.
Mayor Hamilton: That would certainly seen more reasonable.
' Reslution #87-93: Councilman Geving moved, Councilman Horn seconded to
approve that the Kerber Blvd./CR 17 Trunk Watermain Improvement Project 86-14
' be assessed in conformance with the method described in the approved
feasibility study as noted on the attached-assessment roll. That the
assessment term be set at 8 years with 9% interest with the discussions as
indicated here by the City Manager regarding acreage adjustments that will
come back as refined assessment roll and also the comments regarding Mr. James
and Mr. Jacobson. All voted in favor and motion carried.
- CHANHASSEN HILLS TRUNK WATERMAIN IMPROVEMENT PROJECT 86-2.
Gary Warren: Very similar to the Kerber Blvd. watermain improvements, we
.discussed the Chanhassen Hills improvements are proposed to be assessed trunk
benefit. In the feasibility study, the benefitting area proposed and the
additions to trunk watermain—which does indeed come down Powers and to the
I � pm benefitting properties, we call it
�'"? Chanhassen Hills development. The local benefittin
,�_ lateral assessment that are incluced in here for those properties that are
401 ._Y�" abuttin the residential e'� g quivalent so likewise again, we re talking about
,M assessing the trunk benefit for the project at $650.00 per unit and the
density of 1.85 per acre.
Al Klingelhutz: I guess the one question I have, is this an area sewer
assessment or is this an assessment that would be against a property owner
that he could hook up to that sewer immediately?

Gary Warren: Our $650.00 per unit assessment that has been levied against the
property was done as a total improvement project.
Al Klingelhutz: The reason I ask that question is, I feel I'm going to be
assessed for one unit on my property. As far as I know, there is no lateral
or trunk line within 300 feet of any part of my property. I was wondering
without a benefit how I could be assessed at this time.
Councilman Geving: This is a trunk. '
Al Klingelhutz: If this is a trunk line, that's why I ask, is an area
assessment similar to what you put in on Lake Ann sewer? '
Vi/ Roger Knutson: That's what I would call an area assessment. That's what a
trunk is. If the engineers have determined that you are benefitted by the
trunk and a lateral can be hooked up to that trunk to serve your property.
Gary Warren: I think maybe the sheet that I had on first Al.
Mayor Hamilton: Perhaps you could show us specifically how Al's property is
going to benefit.
Al Klingelhutz: This is my property right here. 1
Gary Warren: You're part of Chanhassen Hills.
Al Klingelhutz: Originally I never was part of Chanhassen Hills.
Mayor Hamilton: This was developed before the project was even started.
Councilman Johnson: Was that resubdivided as a part of Chanhassen Hills?
Mayor Hamilton: He purchased it from them prior to their subdividing it. 1
Gary Warren: I'll have to look closely at the area. Right now, at first look
and I'm looking at this, it looks like it's not included in the overall
assessment area but the better maps we have will just confirm that.
Al Klingelhutz: If it's an area assessment I have no objection but if it's
different than that.
Mayor Hamilton: Personally, I don't see how you're benefitting Al so I don't
see where your property is going to benefit.
Councilman Geving: I would prefer to remove Al Klingelhutz from the
assessment roll. '
Mayor Hamilton: If it's an area assessment he doesn't have a problem with it
and I guess that's why Gary should take a look at it.
Gary Warren: Basically as Roger is saying, it is an area assessment in that
we are talking about a lot of unplatted area that will be serviced and

-- benefitted off of the 18 inch main.
ICouncilman Geving: Are you saying then Gary that he could benefit if he were ir- to subdivide those 6 acres and get water from the trunk?
IGary Warren: What I'm saying I guess is I would like to look more closely at
the original feasibility map. With what I have here, it would seem as though
he was not in what we call the service area.
I ! Al Klingelhutz: I have no plans to subdivide at this time. Maybe another 10

and it's an area type improvanent. .

Al Klingelhutz: If it's an area assessment then I have no problem versus
direct benefit...
I Councilman Johnson: It sounds like we should have the engineer review this in
more detail and bring it back on a consent agenda with or without Al on it.
Based upon the looks of the map, he shouldn't have been on it. It looks like
II it was an error. I'm saying you better look at the whole rather than just one
page out of the feasibility study. Look at the whole feasibility study.
Resolution #87-94: Councilman Johnson moved, Mayor Hamilton seconded to

A RESOLUTION ADOPTING THE ASSESSMENT ROLL FOR THE
CHANHASSEN HILLS TRUNK WATERMAIN IMPROVEMENT PROJECT 86-2
WHEREAS, pursuant to proper notice duly given as required by
law, the Council has met and heard and passed upon all objections
to the proposed assessment for the Chanhassen Hills Trunk
Watermain Improvement Project 86-2 .
NOW, THEREFORE, BE IT RESOVLED BY THE CITY COUNCIL OF
CHANHASSEN, MINNESOTA:
1 . Such proposed assessment, as amended, a copy of which is
attached hereto and made a part hereof , is hereby
accepted and shall constitute the special assessment
against the lands named therein, and each tract of land
therein included is hereby found to be benefitted by the
proposed improvement in the amount of the assessment
levied against it.
2 . Such assessment shall be payable in equal annual principal ,
installments extending over a period of 4 years and
shall bear interest at the rate of 9 .0% annum from the
date of the adoption of this assessment resolution. To
the first installment, due in 1988 , shall be added
interest on the entire assessment from the date of this
resolution until December 31 , 1988. To each subsequent
installment when due shall be added interest for one year
on all unpaid installments .
3 . The owner of any property so assessed may, at any time
prior to certification of the assessment to the county
auditor, pay the whole of the assessment on such prop-
'• erty, with no interest charged if the entire assessment
is paid within 30 days from the adoption of this resolu-
tion; and he may, at any time thereafter, pay to the city
', treasurer the entire principal balance of the assessment
remaining unpaid. As such payments are made, current
annual amounts certified at the County shall remain
payable as part of the property tax process .
4 . The clerk shall forthwith transmit a certified duplicate
of this assessment to the county auditor to be extended
on the proper tax lists of the county, and such
assessments shall be collected and paid over in the same
manner as other municipal taxes .

SUBJECT: Lake Susan Water Assessments
We have been working with Gary Warren and the county to correct
the water main assessments as a part of the current development
' plans. The enclosed Tabulation 1 summarizes the information in
the feasibility report from Donohue and actual assessment. The
comparison shows over $60, 000 in excess assessment. Items #1
' and #8 have the greatest errors, with #1 being under by 64% and
#8 is over nearly double what it should be . These need to be
corrected by the City. Item #7 has incorrect acreage because a
parcel in the industrial park is included in the county
' records . This error is being corrected at the County.
You and I also discussed a way of deferrment of assessments on
' some of the parcels. The total cost subject was around
$400, 000. $214, 455 was assessed to Chanhassen Hills as a part
of its current development. $284 ,255 was shown in the
feasibility report for Lake Susan Hills and $77,754 for Jim
Curry. This $176, 000 difference is far in excess of project
bonding requirements. Since the plan for the land is to keep it
in agricultural use until development would start, we want to
' work a deferment of assessments on parcels scheduled for
development some years in the future. As I have told the
council, parcel referenced #1 (remainder) and #4 will be late
' in developing. These assessments are not used for payment of
bond debt and could be deferred.
' I will be glad to review my calculations with you and Gary at
your mutual convenience and discuss methods for deferment of
assessment.
