I SUBJ: Consider Carver Soil and Water Conservation District for
Erosion Control Services
I The Carver Soil and Water Conservation Service District is
requesting the city' s input as to whether the City of Chanhassen
would consider entering into an agreement to have the
I Conservation District perform erosion control inspection and plan
review on development projects . A similar program is underway in
Dakota County. Given the amount of subdivisions that the city
has processed in the past and will continue to process in the
II future, and given the Council' s concern for proper erosion
control and continued maintenance of it throughout the duration
of a project, the proposal would assist city staff in meeting
IICouncil objectives.
The proposal contains recommendations for fees for services that
II would be paid by the developer or applicant. If the city were to
pursue entering into an agreement with the Conservation District,
these fees could be re-evaluated at that time and new fees
established if so desired.
IIThe proposed method of carrying out this review can be accom-
modated into the city' s current plat and plan review process .
II Staff refers applications out to a variety and or all of thirteen
referral agencies. The Conservation District is currently one of
them. We request enough copies from the developer so that
another set of plans can be forwarded to them. They would pro-
vide vide their written comments which would be included in the staff
report presented to the Planning Commission and City Council.
This is the same process now completed by MnDOT, 'DNR, or our sep-
' tic system consultants.
The inspection and enforcement procedures would have to be
I reviewed with the City Engineer and coordinated with his office.
The action before the Council tonight is merely to identify the
Council' s "degree of interest" in pursuing an agreement with the
Conservation District.

RECOMMENDATION
Staff recommends that the City Council authorize staff to prepare
a letter to the Conservation District Board stating our intent to '
pursue an agreement with the Conservation District.

PROPOSAL FOR URBAN SERVICES
Introduction '
This proposal outlines services the District intends to offer. Realization
of this offer depends upon acquiring an additional qualified staff person. The
services are to assist the city in an erosion and sediment control program.
The proposal can be rewritten in consultation with the cit y become to beco
an
agreement. The agreement can be renewable annually or terminated within thirty '
days written notice provided by either party.
Services are proposed for new construction or development projects exceeding
2 acres in size and/or four homesites per platted property or immediately adjacent
to a stream, wetland or lake.

I. Plan Review
A. Services Proposed
I1. Preliminary Plat Review
a. Describe general soil properties and identify potential soil
based limitations to the intended land use.
b. Locate lakes, streams and wetlands off site subject to impact
from proposed land use change. Where appropriate, note current
' condition of off site features.
Ic. Review adequacy of preliminary erosion and sediment control plan
based upon pre-established criteria. These criteria will be
developed in consultation with the city prior to implementing a
formal agreement. The criteria will be based on standards
provided by the USDA Soil Conservation Service and the Associa-
tion of Metropolitan Soil and Water Cosnervation Districts and
the needs of the city.
d. A written report noting variances from the standards will be
given to the city after the District receives the plat.
I2. Final Erosion and Sediment Control Plan
a. The final erosion and sediment control plan would be reviewed
relative to the standards. A written report will be provided
to the city.

1 . When site inspections are made, existing erosion control measures I
are compared to those called for in the erosion and sediment control
plan agreed to in Step A, 2a. Deficiencies are noted and sent in a II
letter of non-compliance to the developer, along with a schedule
when the practices are to be implemented. A. copy of this letter II
is forwarded to the city. The District will make a follow up
II
contact with the developer.
2. If the items noted in the non-compliance letter are not installed II
according to the schedule, a letter of non-compliance is sent to
the city. The city will then proceed to implement the necessary I
erosion control measures according to the terms of the development II
agreement.
