The project included two parts; Part A - South Lotus Lake Park improvements and Part B - South Lotus Lake Addition. The project was done obviously as a public improvement with Part B improvements assessable to the benefitting properties ( see feasi- f bility study excerpt ) . As shown on attachments , 13 residential lots were split from the property for development by Bloomberg Companies. Outlots C and D also remained in the posssession of Bloomberg and has since been subdivided into South Lotus Lake 2nd Addition. The Bloomberg Companies via the development contract executed March 6 , 1986 have waived their rights to contest the special il assessments. As the attached assessment roll reflects , however, several of the lots have been sold to individual property owners and therefore the need for this assessment hearing. All current property owners of record on July 27 , 1988 were mailed assessment notices. The legal notice appeared in the official newspaper on July 28, 1988. The attached August 10 , 1988 memo prepared by VanDoren Hazard Stallings (attachment 6 ) summarizes the assessment methodology I I for the project . The October , 1985 amended feasibility study had anticipated $84,029 to be assessed. The actual value of the assessments tabulated from the attached roll equals $82 , 491 . 76 . II The City received $21 ,765 in a LAWCON/LCMR grant for storm drainage improvements. ll No written objections to the assessment have been received by this office as of the writing of this staff report . The net storm sewer assessment to the City of 1 Chanhassen for Hill Street is $11,340. 1[1 COST TABULATIONS The Cost Tabulations table presents the distribution of all costs associated with the construction of the South Shore Drive improvements including the Hill Street improvements. All improvements are proposed to be financed by the City Y of Chanhassen. As the table indicates, properties which will benefit from the project will be assessed their proportional share of all applicable costs in conformance with the assessment methodologies outlined in the Proposed Improvements section of this study. RECOMMENDATION As indicated by the information herein, the South Shore Drive improvements are feasible from an engineering and financial perspective. It is recommended that the South Shore Drive Improvement Project proceed in accordance with the If' requirements of Minnesota Statutes, Chapter 429. The total project cost including construction , legal, engineering , administration and fiscal costs is $82 , 491 . 76 . The amount proposed for assessment is $82 , 491 . 76 . Written and oral objections will be considered at the meeting , but the Council may consider any objections to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advi- sable. An owner may appeal an assessment to the District Court pur- 1 suant to Minnesota Statute Section 429 .081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Chanhassen within thirty ( 30 ) days after the adoption of the assessment and filing such notice with the District Court within ten (10 ) days after service upon the Mayor or City Clerk. No appeal may be taken as to the amount of any assessment adopted unless a WRITTEN NOTICE signed by the affected property owner is filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Residents who are 65 years of age or older , or retired by reason of permanent and total disability may apply to have payment of the assessment deferred. The project was broken down into four components: paving, watermain, sanitary seer and storm drainage. Additionally, the paving portion was divided into Ithree segments: South Shore Drive, Hill Street and the Highway 101 turn lane. The assessment methodology for each component as identified in the feasibility study is as follows: IPAVING I South Shore Drive Since the street separates the park from the residential area, the cost has been equally divided betceen the City and the five residential lots. I Hill Street The reconstruction of Hill Street is being funded by the City as a general public safety improvement with the exception of one additional lot created by I the realignment. Lot 1, Blk 1, is being assessed a percentage of the cost based on the front footage of this lot compared to the front footage of the total construction with the City being assigned the remainder. ITurn Lane Since turn lane construction benefits the entire subdivision, the cost has been assessed on an area basis to all parcels, excluding the lots that have IIfrontage on Erie Avenue. The cost of the waterline installation has been equally divided I between the remaining four lots. SANITARY SEWER I Block 2 is served by an existing sanitary seer line. This existing line was extended to serve Lots 1 and 2, Blk 1. The cost of this construction has been divided equally between these two lots. I A new sewer line was constructed to serve Block 3 and future phases of the development. Lot 1, Blk 3 was assessed the same amount as Lots 1 and 2, Blk ' 1. The remainder of the cost was assigned to the future development. Since the remainder of the development has now been platted, this cost was assessed to these lots on an area basis. I STORM DRAINAGE The costs for the storm drainage system, excluding Hill Street, was assessed I on an area basis to the contributing parcels. The Hill Street system is being funded by the City as part of the general public safety improvement. I I I I I I I I I I . Two weeks later every tree and shrub was run over by the cat. Last fall there was a letter sent to property owners as ' to what there assessment would be. I did not receive any such letter, or notice. When we did get an assessment notice, I called ' Todd at City Hall and asked why I was not notified last fall, his responce, they did not know who owned the property. We purchased the property from the City of Chanhassen about four years ago, at which time we paid for water mains and ' sewer trunk lines .
