SUBJ: West Village Heights Sewer & Water Project ------
Special Assessment Hearing 2-Os-Re File No. 87-1
IThis is a public hearing for the West village Heights sewer and
water improvements which were installed last year to service the
I Burdick, James and Jacobson parcels. The project included sani-
tary sewer constructed along the south side of West 78th Street
from Powers Boulevard east to Kerber Boulevard, then north to the
West Village Heights Townhouses. The project also included
II watermain extension from Kerber Boulevard into the West Village
Heights Townhouses.
II The attached preliminary assessment roll dated July, 1988 has
been prepared in accordance with the methodology approved in the
feasibility study in that it is a unit assessment. As there are
I only three properties involved, the roll is relatively straight-
forward. It should be noted that the Richard S. Brose property
shown in the roll is under contract-for-deed with the T. F. James
Company. James, Jacobson, and Burdick have agreed to be assessed
I for this project and waive the right to a public hearing as shown
on the attached April 6 , 1987 letter to the Council. The wording
in their letter is a bit nebulous as to their waiving their
I rights to object to the value of the assessment and therefore it
was thought best to hold this public hearing. We have not
received any objections to the roll as of the writing of this
staff report.
IThe total costs for the improvements including legal , engi-
neering , administrative, and fiscal costs is $155 , 488 . 96 for
II sanitary sewer and $29 ,760 . 00 for watermain. There are 110 . 8
sanitary sewer units which results in an assessment of $1 , 403. 33
per sanitary sewer unit and there are 64 watermain units which
I results in a cost of $465 . 00 per watermain unit. The project is
totally assessed to the benefitting properties. The feasibility
study had anticipated the sanitary sewer unit assessment to be
approximately $1 ,505 . 23 per unit and the watermain assessment
Iunit to be approximately $413 . 36 per unit.

If no unresolved objections are presented at the public hearing ,
it would be appropriate for the City Council to pass a resolution
adopting the attached West Village Heights sanitary sewer and
watermain assessment roll dated July, 1988 and authorize cer-
tification of the roll to the County. The assessments will be
spread over 8 years at an interest rate of 8% on the unpaid
balance.

' NOTICE OF ASSESSMENT HEARING
CITY OF CHANHASSEN, MINNESOTA
NOTICE IS HEREBY GIVEN that the Chanhassen City Council will
meet at 7: 30 p.m. on Monday, August 15 , 1988 , at the City Hall
' Council Chambers to pass upon the proposed assessment for the
West Village Heights Public Improvement Project No. 87-1. This
project includes sanitary sewer and watermain improvements.
Abutting properties and those properties deriving benefit from
this project are proposed to be assessed. Specifically, proper-
ties to be assessed include:
' 25-8780010 , 25-8780020 , 25-8780030 , 25-0140500
The proposed assessment is on file for public inspection in
' the office of the City Clerk. The total project cost including
construction, legal, engineering , administration and fiscal costs
is $185 ,248. 96. The amount proposed for assessment is
$185 , 248. 96. Written and oral objections will be considered at
' the meeting , but the Council may consider any objections to the
amount of a proposed individual assessment at an adjourned
meeting upon such further notice to the affected property owners
' as it deems advisable.
An owner may appeal an assessment to the District Court pur-
suant to Minnesota Statute Section 429 . 081 by serving notice of
' the appeal upon the Mayor or City Clerk of the City of Chanhassen
within thirty ( 30 ) days after the adoption of the assessment and
filing such notice with the District Court within ten (10 ) days
' after service upon the Mayor or City Clerk. No appeal may be
taken as to the amount of any assessment adopted unless a WRITTEN
NOTICE signed by the affected property owner is filea with the
' City Clerk prior to the assessment hearing or presented to the
presiding officer at the hearing.
Residents who are 65 years of age or older, or retired by
' reason of permanent and total disability may apply to have payment
of the assessment deferred. The application shall be made to the
City Clerk within thirty ( 30 ) days after the adoption of the
assessment roll by the City Council.
