ISUBJ: Assessment Hearing, Downtown Redevelopment Project 86-11A
I Bonds sold in 1987 provided most of the funding necessary for the
construction of the downtown project. Phase I work was antici-
pated to be completed by this time and, therefore, assessed as a
I part of the 1988 work program. First principal and interest
payments ( for parcels designated as Phase I parcels) are sche-
duled to begin paying principal and interest in 1989 .
Accordingly, it is necessary to carry out the assessment at this
I time so that such can be included with certifications in October
for collections starting, again, in 1989 . Several items contri-
buted to our not meeting original completion schedules for Phase
I I; however, the biggest factor lies with our lateness in starting
construction. As the Council will recall, Mr. Burdick contended
that there was no public purpose being served by the establish-
ment of the ponding area and going through the court process
' to remove this delay. Signing the contract documents and
starting construction before we were assured of no legal conten-
tions could have placed the City in the position of being
1 required to pay the contractor regardless of whether the work was
performed or not.
I Although the Council will receive a number of complaints
regarding assessments prior to completion of improvements, such
is authorized under state statute. Each of the concerns will be
noted by staff and, assuming that such was included in the feasi-
I bility report, assurances will be given that the work will be
completed prior to the date of certification. [ Please note that
property owners have a 30 day period in which to make payment,
I without interest penalty, following adoption of the roll by the
Council. Assuming that tonight' s hearing is postponed for a two
week period to resolve issues which staff is unable to address
Monday evening, we would still have time to meet the October cer-
' tification. Staff is also verifying a change in the state sta-
tute which may give additional time for the certification past
the original October 10th deadline. ] (s:1,,)I

Although the Council may have received initial feedback as to the
number of congigcred property owners which will be before you, staff
has been attempting to work with each of the property owners to
resolve differences prior to Monday evening. I sincerely doubt
that objections will be made, at least by the major property ')
owners . I would also caution Council members regarding land
taking claims. Condemnation proceedings/court hearings are
still in progress regarding Burdick, Kallestad, and Pauly' s . In
each of these cases the owner received relatively large payments
as a result of the taking ( includes damage awards if
applicable) . You may wish to have the City Attorney address any
such claims in a confidential manner back to Council members
before being swayed by a particular property owner.
Generally, all assessments are less than originally proposed.
Complaints may be received regarding lack of notice; however, a
photocopy of all envelopes that were mailed is on file and
available if requested ( sample attached) .
%- The City Council may have already heard of the concerns from
St. Hubert' s Church. As can be seen from my letter of August 10 ,
1988 , there were simply portions of the final assessment roll
which did not conform to the negotiations which occurred for land
acquisition. I am hopeful that I can have all of these issues
resolved prior to Monday evening. [Update: I met with Fr. Barry
Friday morning. The effect of the changes made (per my letter of
August 10th) is an assessment amount of approximately $9 ,300
higher than discussed in January of 1987. Father Barry did
remind me that we also asked and received 5 ft. of right-of-way
on the east side of Great Plains Blvd. at no cost to the City.
The value of that taking could be contended to be $4,000 to
$4,500 . ]
Adoption of the roll as presented is recommended. Should
questions be presented which staff cannot respond to, tabling
would be in order (August 22nd or 29th? ) . ,
Hopefully, the attached assessment roll has sufficient margins
for Council notes/actions.

Final Assessment Roll
Dear Mr. Ashworth:
The final assessment roll for the Downtown Redevelopment Project has been
completed by our office and is attached herewith for your review, consideration,
and presentation to the City Council at the public hearing August 15, 1988. We
' would like to take this opportunity to review with you specific information
about the assessment roll , so that you and the City Council are aware of the
pertinent information applicable to the public hearing.
This letter is intended to summarize the following information:
#1 Public Notice Information
#2 Estimated Project Costs
#3 Assessment Methodology
#4 Final Assessment Roll /Notice Errors
' It is difficult to provide all of the necessary information pertinent to the
project because of the project size, complexity, and the number of properties
involved. However, the synopsis provided below, should provide to you some of
the critical information germane to the public hearing.
#1 Public Notice Information
' The following data applies to the public notification process for this pro-
ject:
o Records indicate that all property owners proposed for final assessment
were notified of the initial project public hearing held January 26,
_ 1987, assuming they were the owner of record at that time. Copies of
the notice mailings are on record in your office.

o Notification of the final assessment hearing was made in accordance
with applicable 429 statutes in the City's official publication. The
notification appeared in the Herald on July 28, 1988. The notice
' included individual property identification numbers and a legible map
of the proposed assessment area.
o Individual notices of assessment were mailed to the property owners
identified on the final assessment roll on Friday, July 29, 1988, in
postage paid envelopes from Minneapolis, Minnesota. Copies of the
notice mailings are on record in your office.
#2 Estimated Costs
' Project costs used to establish the final assessment roll are in some cases
estimated final costs. As you are aware, the project has not been completed
at the time of the establishment of the final assessment roll . BRW person-
nel have made every effort to review each bid item, as well as any other
items of work to establish accurate "as-built" data, and to estimate the
final quantities of work for those items not completed. In all cases we
have estimated the final costs as accurately as possible.
IIThe final assessment roll is based upon accurate cost data for the sanitary
sewer work, water main work, storm sewer work, and most of the demolition
and grading work. We estimate that the final costs for these items should
' be within one-half to one percent of those used in the final assessment
roll . Areas of work which are not complete, and required estimates for
work remaining to be completed are: the street finishing work including,
sidewalk, wear course paving, landscaping and streetlighting.
#3 Assessment Methodology
The preparation of the final assessment roll used as a basis for estimating
the final assessment rates, the assessment methodolgy implemented during
the feasibility study in establishing the preliminary assessment roll . The
exception to this are those instances where City Council action during the
original public hearing directed specific action, or where areas were out-
side of the original scope of work but abut improvements which were added.
' Specifics of the assessment methodology used in establishing the final
assessment roll are described below:
' ASSESSMENT METHODOLOGY SUMMARY

1. Lateral Assessment -
' Those properties abutting streets in which the existing sanitary
sewer was replaced with a new sewer (in the area of replacement)
and receiving benefit from the new sanitary sewer are assessed on
a front foot basis.
' 2. Service Assessment -
II Existing businesses abutting the new sanitary sewer that remain
(at least on an interim basis) , had a sanitary sewer service pro-
vided. Each property being served by a new service is assessed a
uniform rate for the cost of that service. Separate costs for
each new service were not recorded, rather, it was felt that a
uniform rate per service would be appropriate.

was incorporated into the assessments. The credit was based upon an
estimated remaining useful life. For the assessments shown, a normal
life expectancy of thirty years was assumed. The existing sanitary

' B. Water Main
Water main assessments are split into two (2) types.

C. Storm Sewer -
' Consistent with current City policies, one-half (1/2) of the cost of
the storm sewer system was assessed.
Assessment is proposed against Downtown areas contributing to the new
storm sewer system based upon the contributing drainage area of each
parcel within the Downtown area. Residential areas north of the down-
town were included in the assessable square footage at one-half the
commercial assessment rate, but the assessment for the residential area
has been omitted from the assessment roll , as directed by the City
Council .
D. Grading/Roadways/Lighting -
Properties abutting new roadways or existing roadways where improve-
ments were made are assessed on a front foot basis.
Those properties abutting existing roadways and benefitting from the
improvement of these existing roadways are being assessed 26/30th of
the cost of the improvements. Recognizing the remaining value of the
existing roadway, a "credit" was incorporated into the assessments.
The "credit" was based upon an estimated useful life of thirty (30)
years. The roadways at the beginning of this project were about 26
years old. Thus, a credit of 4/30th was imposed against the actual
cost of the improvements.
Those properties abutting a new roadway and benefitting from the
construction of the new roadway, are being assessed the full cost of
the improvement. No credit was used.
Parking lot improvements are assessed against adjacent properties bene-
fitting from the improvements, on a uniform rate per square foot basis
for the full cost of the improvements.
E. Landscaping -
Landscaping is assessed fifty percent to properties abutting the
landscape improvements on a front foot basis. Assessments for the
landscaping are included in the roadway assessment rate shown on the
assessment roll .
Landscaping in Heritage Park is not assessed to abutting properties,
but is covered by the fifty (50) percent assessment reduction described
above.

F. Others -
The construction costs for the storm water pond, railroad crossing,
traffic signal conduits, and clocktower/entry monument, where costs
deemed attributable to all users of the Downtown improvements and are
not proposed for assessment.
*NOTE: The assessment rates shown and illustrated in the assessment
roll are final subject to the normal basis of assessment
objection or approval . The final rates are based upon final
construction, acquisition and administrative costs, or best
estimates of same.
#4 Errors to be Corrected
Final notices of assessment were mailed to individual property owners on
Friday, July 29, 1988. Minor typographical errors or mathematical errors
have been noticed in the review of the mailings. We would like to correct
these errors while establishing the final assessment roll . A summary of
the errors follows:

Dear Fr. Barry:
Thank you for your letter of August 8, 1988. Since receiving your previous
letter, I did have an opportunity to review potential issues with the City's
consulting engineer for this project, Gary Ehret (BRW) . Your most recent letter
helps in pinpointing your concerns.
Prior to discussing specifics of your letter, I cannot help but take exception
to your statement "it is also common knowledge that the developers have
overspent first budgets by extremely large amounts". You may be disappointed in
the scope of the project or policy decisions made; however, all costs associated
with the improvement project have stayed within the feasibility study estimates
and public hearing presentations from nearly two years ago. The study estima-
tes, contracts awarded, and costs paid to date are available for public inspec-
tion. The validity of these statements can best be seen in reviewing the
assessment roll itself wherein 95% of the assessments are less than originally
proposed. [Your property falls within the 5% deviation - such being the basis
for our correspondence.]
I am in total agreement with your first point regarding cemetery footage. I
relayed this point to Gary Ehret after receipt of your letter and he is
attempting to verify such footage has in fact been deleted. Secondly, I am also
in agreement with your statements regarding Fred Hoisington. Mr. Hoisington had
kept me abreast of the decisions being made by the Church and the City regarding
the negotiation for land acquisition as a part of the project. The City in no
way is attempting to not honor the decisions made last winter/early spring.
Without question, both the acquisition from yourself as well as from Mr.
Klingelhutz took into consideration proposed assessments being considered by the
City, and established positions for both the Church and Mr. Klingelhutz based
upon the estimated assessments and benefits likely to be received by both pro-
- perty owners. As the project involved more than 200 parcels benefitting from
the project, I find difficulty blaming Mr. Ehret for not deleting the proposed
parking lot improvement for the old St. Hubert's Church property. In all like-
lihood, the failure in communication probably best lies at my doorstep for not
confirming that Mr. Hoisington had in fact confirmed all aspects of the acquisi-
tion with Mr. Ehret.

NOTICE OF PROTEST
Ili THE CITY COUNCIL OF THE CITY OF CT3ANHASSEN, MINNESOTA:
You and each of you are hereby notified that the Soo Line Railroad Company,
being aggrieved, does hereby protest the action of the City Council and does file
this Notice of Protest with the City Clerk of said City, and the grounds upon which
this protest is based are as follows:
That it is an owner of property within the City of Chanhassen, Minnesota.
II.
' That a portion of its property is located within the storm sewer improvement
district and is being assessed therefor for an assessment of $38,558.62.
III.
That the Soo Line Railroad's present and future use of said property is
restricted entirely to railroad uses and will not benefit from the storm sewer
improvement.
' IV.
That, as to the Soo Line Railroad Company property, any assessment would be
' arbitrary, capricious, unjust, discriminatory, inequitable, and excessive.
V.
That any assessment against the Soo Line Railroad Company's property would
' result in depriving the protestant of said property without due process of law in
violation of Section I of the 14th Amendment to the United States Constitution and in
violation of the Constitution of the State of Iowa.

Mr. Ashworth:
We received your letter of assessment on Monday, August 1, 1988.
Please consider this letter as the most controlled form of written
objection to comply with your ground rules.
it In November of 1987, we entered into a bonafide agreement with the
City which we felt was a legally binding one based on your projected
assessment on our property. We essentially traded a parcel of our
property to the City for $16,000. 00, which was to more than cover our
ultimate assessment of $11,074. You have, since that time, utilized n ;A
approximately one-half of that property for City parking, and ask us °'
to pay $67,000 for improvements ! More than eight times the value of Z
the land we sold you, to make improvements we do not need. We have our
own parking lot on our land, built in accordance with City ordinances. ,dJ`r`
Also, the street assessment of $20,387 is a new surprise. You have G' ).U�}
taken the road frontage from us, building parking area virtually up to & Qd�1
our building, and in fact, detracted from the value of our property. �Dv
In your original plans we were to receive no assessment for street
improvements since our property does not have any street frontage.
It appears to us that the City has given us an estimated assessment,
conned us into a deal on property, and then changed all the rules. /vo
From an estimated $11,074 assessment before, to the current $98,604
(after making a contractual agreement on land) we see your original n it'
estimate was in error by some 890%. 6
We feel that the original deal with City and the settlement that was a Ni
made was a very bonafide agreement and we strongly protest any further kc1
