IAttached is a letter from the City' s consultant stating that the
public improvements for the construction of the roadway have been
' completed in conformance to the approved plans and specifica-
tions. Staff has reviewed the project and offers the following
comments .
I Several areas along the roadside will need additional seeding to
sustain a vegetative cover . Due to the lack of cover in these
areas the silt fence should remain intact through the spring
I thaw.
The City Council approved the conditional use permit ( 86-4) for a
beachlot for this subdivision on June 1 , 1988 . The beachlot that
1 has been constructed does not comply with the approved plans or
the DNR permit. The developer has been notified and is reviewing
the plans with staff and the DNR.
IIt is therefore recommended that the City Council accept the
public roadway improvements for the Lake Riley Woods North
I Addition contingent upon the developer furnishing the City with a
one-year warranty bond and a set of as-built reproduceable
mylars. The date of this acceptance shall commence upon the date
of receipt of the above-mentioned documents. It is further
I recommended that the financial security that is in place be
reduced to recognize the acceptance of these improvements. A
portion of the financial security shall be retained to guarantee
I compliance with the DNR and to maintain the erosion controls as
discussed.

We will submit a set of reproducible drawings pending your approval.
It is my understanding that Gary Tousley has performed a final field
inspection and acceptance of the project.
We are requesting final acceptance of the street and utility construction by
the city.
Please let us know when we should submit a warranty bond and any other
necessary documents.

1 Thank you for contacting us regarding the above-referenced beach
alteration projects on the south side of Lake Riley. As we discussed
on site on July 18, 1988, both of the adjacent sites have been
I over-developed with regard to state permit guidelines as well as
shoreland guidelines.
WALLSTED PROPERTY
1 The three major concerns on this site include 1) sanding in excess of
the amount allowed without a DNR permit (the DNR allows installation
1 of a beach sand blanket 50 feet along the shoreline or one-half the
width of the lot, whichever is less, and extending only 10 feet
waterward of the ordinary high water level, and no more than 6 inches
1 thick) ; 2) excessive clearing of vegetation, exposing the homesite to
the lake; 3) potential construction of an asphalt path to the
shoreline with unknown methods of dissipating runoff at the bottom of
the hill.
IRegarding the sanding-if the owner/developer/contractor is not willing
to cooperate with the City in immediate restoration of all but the
I 50'x10'x6' sand blanket, the DNR would treat the project as a
violation of state laws and regulations-a misdemeanor under Minnesota
Statutes §105.42. It appears that the homeowner is already
cooperating with the city in regard to vegetative plantings to
1 mitigate the removal of natural vegetation, therefore we encourage the
cooperative removal of all excess sand. In addition-if not already
addressed-the drainage down the access path should be reviewed for

potential erosion of the lake.
LAKE RILEY WOODS NORTH
IIThe extensive sanding, removal of vegetation, and cutting into what

appears to have been an ice ridge at the ordinary high water level are
all concerns of the DNR. DNR Permit #88-6090 was issued to George
1 Nelson and Associates for a sand blanket as shown on the attached
plan. The final project is not in compliance with the plans. We
would like to see a restoration plan for the site which: removes all
1 sand not approved by permit, and otherwise restores the vegetation.

It appears that the person responsible for the sanding at these sites
has taken advantage of low water levels on Riley Lake. They should be II made aware that the ordinary high water level (OHW) does not change
with the lake level-it is a fixed elevation representing the highest
elevation the lake has maintained for a sufficient period of time to II leave evidence upon the landscape. (An approximation of the OHW of
Lake Riley would be elevation 865.)
