1 SUBJ: Approval of Plans and Specifications for the
Seven Forty-One Crossing Site
File No. 88-17, HSZ Development
The City Council approved the site plan for the HSZ site on July
25 , 1988 and the final plat for the Seven Forty-One Crossing
1 stamped "Received July 13, 1988" subject to staff ' s conditions.
Condition #1 for the site plan stated that the applicant shall
1 submit to the City Engineer for approval the plans and specifica-
tions for the installation of the storm sewer pipe and utilities
prior to the application for a grading permit. Attached are the
plans for the construction of these utilities.
1 The sanitary sewer and watermain have been proposed in accordance
to staff ' s previous reviews as approved by the City Council. It
1 should be noted that the storm sewer pipe for the HSZ Development
and the Reed property will be constructed along the existing West
64th Street and down the platted right-of-way for Oriole Avenue
to the City' s parkland. The original submittal of the plans had
1 proposed the outlet of the storm sewer to be located further
north. The City requested that the storm sewer system be
extended further to the south such that flooding of the Ziegler
1 property could be avoided and to reduce the length of potential
erosion between the storm sewer outlet and the actual wetland.
Since the City benefits by the extension of the storm sewer at
1 the developer' s sole expense , a wetland alteration permit will be
processed through the Herman Field park proposal. In addition ,
staff has reviewed the outlet conditions with the Watershed
District and has had the developer revise the storm sewer system
1 to include an energy dissipator to further insure that erosion
will not be a problem near the wetland.
1 Page Cl-B of the plan set indicates that the installation of the
pipe encroaches into the wetland. Staff has reviewed the loca-
tion of the wetland in the field and finds that the actual

wetland is located further south (away from the pipe outlet ) .
Staff will be working with the developer to insure that the storm
sewer pipe will not encroach into the wetland. '
Staff is taking measures to insure the protection of the wetland
by using Type III erosion control; that being snow fence, silt
fence and staked hay bales surrounding all construction of the
storm sewer pipe within the wetland setback area. These plans
have been reviewed by the Watershed District.
Staff has reviewed the areas which will require tree removal for
the installation of the storm sewer pipe. The largest tree to be
removed is approximately a 6-inch diameter Box-Elder tree. The
remainder of the trees consist of 1-inch diameter saplings . We
find that this is acceptable.
In light of the nearing close of the construction season, the
developer has requested that the City allow him to proceed with
grading of the site pending Watershed approval. The next
Watershed District meeting will be held on October 5 , 1988 . The
Watershed District has indicated that the outlying issues to be
resolved are minor and will be resolved prior to the next
meeting. Staff is recommending that the applicant be allowed to
proceed with construction if the City receives a favorable letter
from the Watershed District indicating that approval is pending
the October 5 , 1988 meeting . In addition, the applicant should
provide the City with the executed development contract , the
necessary financial sureties to guarantee the proper installation
of the improvements , and a copy of the necessary permits from the
Minnesota Department of Transportation for access onto Highways
41 and 7.
The specifications for the construction of the utilities and
grading has been referenced as the Standard Specifications for
Construction from the Minnesota Department of Transportation
(1988 edition) . It is expected that the construction of these
utilities and public improvements will also conform to the latest
edition of the "Standard Utilities Specifications" as prepared by
the City Engineers Association of Minnesota. Any conflict of
these two specifications shall be superseded by the City stan-
dards for construction.
Recommended Conditions
It is therefore recommended that the plans and specifications for
the HSZ Development and the Reed property be approved upon the
following conditions: '

1. The applicant shall receive approval from the Minnesota
Department of Transportation for the access permits from
' State Highway 7 and State Highway 41 and shall provide the
City with a copy of these permits prior to the commencement
of any construction.
2 . The applicant shall receive and provide the City with a copy
of a favorable letter of intent from the Watershed District
' which indicates pending approval for the and resolution of
the outstanding items for the drainage facilities prior to
the commencement of any construction or grading.
' 3 . The applicant shall enter into a development contract with
the City and provide the City with the necessary financial
sureties to guarantee the proper installation of these impro-
vements prior to the commencement of any construction or
grading.
4. The proposed erosion controls shall be Type II erosion
' control ( staked hay bales and snow fence) with the exception
of the storm sewer pipe located adjacent to the wetland area
which shall be protected by Type III erosion control ( staked
hay bales, snow fence and silt fence) .
