iAttached please find a report prepared by Gary Ehret, BRW, in
response to questions raised during the public hearing (copy of
iminutes attached) .
As will be noted in the correspondence to Fr. Barry, I am
suggesting that the Council consider the staff adjustments being
i recommended since our last meeting. I would then ask that the
Mayor request whether there are any objections to the revised
assessments as being recommended by staff from either the public
I or Council. Hearing none, I would suggest that a motion be made
regarding those parcels . Hopefully, such process can reduce the
amount of debate if all parties are in agreement. Parties which
we anticipate reaching agreement with include: Old St. Hubert' s
i Church property, St. Hubert' s Church and School Property, Mr.
Sorenson, and potentially Mr. Brown.
' If agreement is reached with the above owners , the only remaining
objections will be Hillman, Mr. Hanson, Mr. Hendrickson, and
potentially Kallestad/Pauly. The Council/HRA have approved the
I condemnation for the Hendrickson and Hanson properties . The
court process will consider the market value of the properties
including payment for removal of fixtures and relocation. The court
process does not typically consider special assessments generated
i as a part of the taking. State law is quite clear in that
such value must be considered on the basis of a "before" versus
an "after" value. This subject is addressed further in the admi-
nistrative section regarding the appeal being made by Mr. Burdick
regarding the value of his lands on West 79th Street. In
recognition of the fact that the City will be acquiring both the
Hanson and Hendrickson property, and that the after values of the
assessment will not be considered by the court, this office finds
no reason to adjust those assessments.

In regard to a potential objection being received from Kallestad/
Pauly, it should be noted that no award has been made by the
courts regarding the land acquired by the City for the project.
The court did give the City the right of entry and the right to
carry out the improvements, but the final value for that taking
has yet to be determined. It is only logical that an objection
would be raised to insure consistency with actions taken to date.
It would not be advisable for the City Council to modify either
of these two assessments as both the Engineer and City Attorney
have spent significant time verifying that the method of
assessment/amount for each of these properties is sustainable in
the court process currently in progress .
Again, Mr. Ehret addresses the assessment question raised by Mrs.
Hillman in the amount of $2 ,221 .47.

Mr. Hanson expressed the following concerns: '
A. Did not receive notice of the public hearing.
B. The City did not receive easement agreements from Mr. Hanson.
C. Mr. Hanson suffered a loss of business.
D. Mr. Hanson felt that he received no benefit.
We offer the following information on each of these concerns: I
A. Mr. Hanson was notified via letter of the public hearing on January
15, 1987. A copy of the notification and the postage-paid envelope
are included for Council information. Mr. Hanson was also notified of
the final assessment hearing July 31, 1988. A copy of his assessment
notice and the mailing envelope are enclosed for Council information.
I believe the City has met the notification requirements of Minnesota
Statutes 429.
B. Easement agreements from Mr. Hanson were not required for the
construction of the project. If encroachment occurred on Mr. Hanson's
property, it should have been minimal . We have attempted to restore
any areas of encroachment to the property owner's satisfaction
wherever possible.
C. The City Council and staff are well aware of the effort in time and
money that was spent to minimize the impact to local businesses
(temporary access road/parking, etc.). Loss of business no matter how
undesirable or unfortunate is not a compensable or relevant issue to
the assessment process. ,
D. Mr. Hanson's business was connected to the new sanitary sewer and
water main by this project. His property contributes storm runoff to
the new storm drainage system. Mr. Hanson' s property abuts West 78th
Street, with his parking being connected directly. We believe that
his business is directly benefitted by these improvements and the pro-
posed assessments reflect this benefit. i
Conclusion:
We recommend that no change be made to Mr. Hanson' s assessments. '

These parcels are all integrally related for assessment purposes. We,
therefore, will attempt to address the concerns expressed in this area by
both the property owners and City staff.
Assessments against the parcels listed above include:
A. Sanitary Sewer
B. Water Main
C. Storm Sewer
D. Streets
E. Parking Improvements
The assessment rates and methodology used and applied to these parcels for
Items A-D have been reviewed for consistency with other parcels within the
downtown project. We believe that the assessments for sewer, water, streets
and storm sewer are consistent, correct, and defensible in an assessment
appeal . We recommend that no change occur to these assessment items.
We have also reviewed the assessment methodology for the parking lot impro-
vements with both staff and the City Attorney. Changes have been made to
the parking lot assessments for the parcels identified above to further
encourage consistency to all parcels.
In addition, Mr. Pauly expressed concern about the dimensions used to figure
his assessments. The actual property dimensions used were based upon the
County 1/2 Sections, existing platting, and a site survey for the Kallestad
property. The dimensions used in the final assessment roll have been
verified and are correct.

#13 25-6920020 - Brown, Gary (Car Wash)
Mr. Brown spoke relative to these two properties and expressed the following
concerns:
I A. Waiver of Trespass/Right-of-Entry.
B. Failure to notify Mr. Brown of the project public hearing and the pro-
posed assessments.
C. Mr. Brown expressed concern about "the mess you left me" in the
construction of the project.
D. Mr. Brown felt that there was "no benefit" to his property from this
improvement project.

After review of the assessment rates and methodolgy used and applied to this
parcel , we have revised the assessments for this parcel . The new assessment
amounts, as illustrated on the revised assessment roll , is $6,462.85, which
is $632.88 less than the assessments previously estimated.
Father Schneider has indicated that the Church anticipated assessments I
totaling $8,762.09 for the Church/School site on the north side of West 78th
Street. This amount was based uon the preliminary assessment roll . Current
assessment amounts are proposed to be $18,010.22. This amount is based upon
rates and methodology used throughout the downtown project, and the final
improvement costs.
We have reviewed these assessments and find them to be consistent, as

described above. We, therefore, cannot recommend a change in these
assessments from those presented. I
#12 25-3500380 - Hillman, Phillip and Nancy
The Hillmans have objected to the placement of a storm sewer assessment I
against their property. They also raised the issue of previous storm sewer
assessments.
We offer the following information: I
This parcel was previously assessed for storm sewer under Project No. 67-2
in 1967/1968 in the approximate amount of $500.00. This assessment was for
a project which did not adequately handle the drainage needs of the area and
resulted in downstream storm water problems.
. The downtown project storm sewer is a new trunk storm sewer designed to I
alleviate these problems. It also is designed to flow into the storm sewer
pond on the Burdick property which contributes significantly to the environ-
mental treatment of this water prior to flowing downstream.
The Hillman property does contribute storm runoff albeit slowly, to the I
downtown project. This property was not excluded last year when the City
Council acted to eliminate the residential properties from the downtown
assessment roll .

If you elect not to pay the full amount within thirty (30) days after the
hearing date, the assessment will be spread over 13 years with installments '
appearing on your real estate taxes beginning next year. Interest will be
included at the rate of 8 percent of the unpaid balance.
The proposed assessment roll is on file with the City Clerk. Written and oral '
objections to the proposed assessment by any property owner will be considered.
No appeal may be taken as to the amount of any assessment adopted unless a r
written objection signed by the affected property owner is filed with the City

I had hoped that Al Klingelhutz would be able to join in any

meeting potentially occurring between you and me. My reason for
asking Mr. Klingelhutz to participate in that type of discussion
simply recognized his extensive background in land acquisition/
assessment processes and the state laws that a City must conform
II
to. After making my request to Mr. Klingelhutz , he had recon-
tacted me asking if I would be available to meet with the two of
you on either the afternoon of August 23rd or 24th. I assumed he
II
was making arrangements with you and I held appointments for both
of those afternoons . On Friday afternoon, September 2nd, I
received your telephone message from 10 : 22 a.m. (copy attached) . II Ironically, Mr. Klingelhutz was at the front counter at that
time. He asked whether he thought you or I would like to have
him attend. I stated I was not sure, I was on my way out of the
office to another meeting, and may not be able to return your

phone call yet that afternoon. I would contact him after con-
tacting you.
Tuesday morning was the typical crises after a long weekend. II
10 :30 a.m. came and went before I was able to start returning any
phone calls . Your letter was then received.

IIAs I tried to state at the last Council meeting, I was confident
that an error would be found bringing the actual assessment for
II the old St. Hubert' s Church to an amount equal to or less than
that originally given to you. As stated in my last correspon-
dence, the only reason I recommended tabling was that I was
hearing the engineer' s recommendation to be different than what
I I we discussed. The reason that I was confident that the
assessment would be equal or less was in knowing that the unit
prices for that portion of the project came in under the original
II estimate. Therefore, either the methodology changed or an error
had been made. The latter was found to be the case. Specifically,
Mr. Ehret' s previous notes as well as your questions had led him to
recheck the assessment regarding the storm sewer as it would
I I apply against the cemetery property. He continued to find that
he had made that adjustment. What finally surfaced was the fact
that the program used to recompute final assessment figures had
I I not been changed for the lateral benefits as they would apply to
the cemetery property. Correcting such now produces the
$6 ,462 . 85 being recommended.
IIWe remain $9,000 over on the St. Hubert' s Church and School
property. As I previously stated to you, the City found that the
watermain along Great Plains Blvd. was in far worse condition
I I than our records indicated it should have been. A decision was
made, after the project started, to replace that watermain.
Recognizing that the existing watermain should have served the
church for another 10 to 15 years , a 50% "useful life" credit was
recommended by myself and the engineers . That recommendation has
not been acted upon by the City Council and staff continues to
recommend that the 50% credit be applied. The other difference
between the original estimated project costs and current actuals
reflects an increase in storm sewer costs . This one also was
perplexing to me in that a majority of the proposed assessments
in the downtown area are less than originally estimated. Then
1 why is St. Hubert' s Church and School higher? The answer to that
question stems from the bidding process . Specifically, the engi-
neers had estimated that the cost of sanitary sewer replacement
would be "x" per foot, that the cost of street construction would
be "y" per lineal foot, and that the cost of storm sewer improve-
ments would be "z" per square foot. The actual bids received, in
the aggregate, were lower than the engineer' s estimates .
However, in close examination of those bids you will find that
the contractor' s bid was approximately 20% higher for storm sewer
work while being 10% lower for street, watermain, and sanitary
sewer work. As most property owners had street/sanitary
sewer/watermain/storm sewer assessments , their aggregate assesse-
ment amount was lower than originally estimated. On the other
hand, the church was not assessed for street or sanitary sewer
work as the existing street/sewer were in adequate condition.
