In summary, at this time, median cuts to provide turning movement
' into the Amoco site and West 79th Street will not be supported by
MnDOT. A continuous left turn lane is a possible option. If the
left turn lane is not permitted, then the Amoco site will most
' likely be forced to combine with the Hanus site for access pur-
poses.

1 Dear Chief Gregory:
I am writing to commend Firefighters Mark Littfin and Brian
Beniek for the professional assistance that they recently pro-
vided during the execution of a search warrant at an apartment at
Lakeview Hills. This was an involved process, that could in no
way effectively been carried out without their help.
1 Firefighter Littfin provided a great deal of his time and exper-
tise in helping the individuals executing the search in putting
on air packs , suiting them up with the proper gear, etc. He was
courteous throughout the procedure, and spent a great deal of
time afterwoods cleaning up the equipment.
1 Firefighter Beniek also assisted by video taping the scene. He
did an excellent job and the video tape has been forwarded to the
County Attorney as evidence.
1 This is yet another example of the execellent work that the
- Chanhassen Fire Department provides, not only to the city, but to
the other enforcement agencies in our county. Please extend our
1 gratitude to these firefighters for a job well done.

IRE: Proposed 100 Unit Hotel Project (Chanhassen Country Hospitality Suites)
Dear Mayor, Chairman and Members of the City Council and HRA:
II am writing this letter to express my deep concern over the City and the
HRA's plan to promote and subsidize the Chanhassen Country Hospitality Suites
project. As many of you know I am the owner of the Chanhassen Inn, a motel
I project which now contains 74 rooms. One of the reasons why I decided to
develop a motel at this particular site was because I believed strongly in the
future of the City of Chanhassen and there was a clearly indicated market in
the area. When we opened in March of 1982, my motel was the only one within a
II radius of 7 miles. However, since that time 646 additional motel rooms have
been constructed within the same 7 mile radius. And, within 8-1/2 miles of my
motel the Marriott Corporation has a 320 room hotel under construction in Opus
I Park, scheduled for completion next spring. Furthermore, IDS has started
construction of a training center containing 235 rooms for its trainees and
other IDS personnel and visitors, scheduled for completion in the spring of
I 1990.
Obviously, the impact of all these additional motel rooms and sleeping
facilities on my business is and will continue to be negative for the
I foreseeable future. My gross sales are down 20% over last year. I seriously
question the indication for an additional 100 units in the City of Chanhassen
at this time. I do not question the desire to improve the City or to attract
II additional business dollars into it. However, it is my strong belief that
Chanhassen simply is not ready for this type project at this time. Perhaps in
five or ten years the story will be different as the surrounding area
II experiences further residential, commercial and industrial growth. Certainly
neither my business nor the proposed new hotel would be able to survive under
competitive conditions. It is my understanding that a professional market
analysis was done. I have not seen this report but rumor has it that the
IIreport is negative. If that is in fact the case then it only supports my own

study and research of the market in this area at the present time. It would be
' absolute lunacy to proceed with such a project knowing that it had very little
chance for success.
I have done some financial investigation of my own. The principal,
' interest, taxes and insurance for a project such as the one proposed is
conservatively estimated at more than $750,000 annually. Assuming 100%
occupancy of all 100 suites/rooms, this would amount to a cost of over $20.00
' per day per room. If the occupancy rate is only half of 100%, the PITI would
double to more than $40.00 per room per day. The operation would not have paid
for a single kilowatt of electricity or a single dollar in wages at that point.
' A 50% occupancy rate in the first few years of operation for this hotel is
simply not attainable. According to the article in the paper the Chanhassen
Villager of August 4, 1988, rental rates will be in the $48.00 to $60.00 range.
Assuming that the market would bear these rental rates and assuming a 50%
' occupancy rate, it is obvious that the hotel simply could not survive when two-
thirds to four-fifths of it's income is dedicated to PITI alone. The cost of
utilities, credit card charges, sales tax, room cleaning, maintenance,
' replacement, management fees, payroll expenses, franchise fees and all other
expenses of operation will simply put•any chance for a successful operation
under present circumstances far out of reach.
I would also like to point out what I perceive to be an extremely
inequitable situation here. I have constructed my facility entirely upon my
own resources and private financing with the exception of a small loan that I
was able to obtain through the SBA. I paid $46,000.00 to the City of
Chanhassen for the right to hook-up my units to its sewer and water system.
Now, it is proposed that a competitor, who has a questionable chance of success
' from the start, be subsidized by the City in order that it can better afford to
establish itself. In my opinion is it unfair to cause hardship for an existing
business to benefit a new development. While I realize that people cannot
expect to maintain a monopoly on their form of business in an area forever, I
' contend that I am entitled to some deference by the community for the
investment that I was willing to make and the taxes that I have contributed
over the years. It seems to me that for the City to then subsidize an
' extremely high risk venture which may very well drag me down with it amounts to
poor judgment and unfair treatment.
For all the reasons stated above, I respectfully request that the Council
' and HRA seriously consider the gravity of entering into any kind of agreement
to subsidize this project. I am available to answer any questions at any time.
I would greatly appreciate your keeping me fully advised as to further
developments involving this project. Thank you for your time and your kind
consideration.

' Dear Mr. Melby:
' Thank you for taking time from your business day to meet with
Jerry Schlenk, Dale Gregory and me on August 25 , 1988 to review
your concerns on the South Lotus Lake Park area. As we
discussed, next week the City intends to bring in a backhoe to
' remove the delta material which has developed in the lake area
from runoff from the detention basin spillway and the South Lotus
Lake development area. In addition, we will have maintenance
crews clear the general area of the weed growth around the lower
detention basin and along the fencing between your property and
the park property. We will not , however, remove the cattails or
reed canary grass within the basin as this is beneficial for
' removal of nutrients from the retained water .
Concerning the stones and riprap at the weir structure, we will
' do our best to remove the smaller riprap which has been a
nuisance and which carries over into the lake with storms. We
intend to reinforce the weir with larger riprap.
You requested that we move the boat dock to the west side of the
landing area. Dale Gregory indicated that this had been tried
but due to the lake bottom contours we have had difficulty with
' supporting the right wheel. When we reinstall the boat dock next
season we will do what we can to correct this bottom slope
problem and attempt to install the dock on the west side of the
' landing area.
Concerning your complaint about the weeds in the Bloomberg pro-
perties off of Hill Street , I indicated that I would pass this
concern on to Deputy weed Inspector Scott Harr for follow up.

II Gentlemen,
First of all, I would like to correct a typographical error in my letter
' dated August 4, 1988. It should, of course, read "and" instead of "or".
In reference to the last council meeting. I feel that the left hand Cul
sac taking part of Lot 1 is most unfair. Taking part of this lot

would cause a tremendous amount of damage, due to the particular size and
configuration of the lot. The reasonable and fair thing would be to
construct a true Cul de sac; In other words, a circle, as is the normal
I procedure with Cul de sacs. I, of course, wish to emphasize that I
prefer no stub street and Cul de sac as compared to the right turn in
right turn out arrangement.
II would like to again call your attention to the solemn agreement that I
and the City Council and Mayor of Chanhassen entered into by a unanimous
vote approximately a year ago, which provided for a right turn in right
II turn out on 78th Street. If this governing body decides to repudiate
this agreement, I feel it should be done in an honest and open manner and
not by trying to shift the blame to sane other governmental body such as
I the Carver County Board of Commissioners or MNDOT, who have told me very
clearly on several occasions that they have no interest in this matter
whatsoever.

On August 22 , 1988, the City Council established guidelines to
permit decks on the quad units in the Chaparral PUD to be located
1 within the front yard setback with the following conditions:
1 . The deck cannot extend from the building further than 10 feet.
2 . The deck must maintain a 20 foot front and rear yard setback.
3 . The deck must be constructed to the 10 ' x 20 ' dimension.
4 . Decks that meet the above three conditions could be approved
administratively with a building permit application without
having to receive a variance.
Attached is an addendum to be added to the development contract
file for the Chaparral PUD.

PLAT OF CHAPARRAL AND

WHEREAS, the City has made and entered into a development
contract dated November 9, 1979, and entitled "Planned
' Residential Development Contract Plat of Chaparral and Chaparral
2nd, 3rd, and 4th Additions" (the "Development Contract") , and
WHEREAS, it was implied in the approval of the
development that decks on quadraminium lots could be constructed
within front yard setbacks.
NOW, THEREFORE, be it resolved by the Chanhassen City
Council:
1. Decks may be constructed in the development of the
quadraminium lots which encroach upon the required front yard
setbacks without a variance subject to the conditions set forth
herein.
' 2 . Decks constructed pursuant to this Addendum are
subject to the following conditions:

I am pleased to advise that we have hired a second CSO whose
duties will include animal control.
1 Both CSO' s were hired with the understanding that they will trade
off times to be available for animal call-outs. As soon as the
1 new CSO is trained in, a pager will be used for Carver County
Sheriff' s Office to call a CSO in.
In the meantime, Deb Rand has made herself available for
1 necessary call-outs if she is available. We would like to limit
these current call-outs to those that a deputy is unable to deal
with immediately, or cannot convince the complainant to wait
1 until a CSO is on duty. So, for a short period until both CSO' s
are fully operational, I would hope that call-outs would be
limited to those of a "crisis nature" .
1 I will advise you as soon as both CSO' s are operational.

under separate contract with the Southwest Transportation Coalition in
April.

properties in Hennepin County. Mapping was originated frcan title
II searches and meter plotted with total parcel areas calculated.
Proposed right-of-way limits and actual takings are pending further
design.

will be completed in one week.

regarding the City' s taking of his property on West 79th Street
for the new holding pond. Mr. Burdick is seeking an award in
' excess of $2 . 72 per sq. ft. for the 2 parcels acquired by that
the City.
Both the City Attorney and this office are pleased to see this
' item presented to the Carver County District Court. As such, it
will be the citizens of our County who will make a determination
as to the fair value that should be paid to Mr. Burdick for the
' taking. Factors considered to be highly important to our
appraiser/attorney in this issue include:
' - The court is compelled by state law to only consider
the value of the land "before" the taking. The court can-
not consider potential higher values for the property
because of constructing new Market Blvd. , access to Highway
' 5 , or railroad crossing into the downtown area - all repre-
senting "after" conditions. These would not have occurred
without the City' s action and therefore must not be con-
' sidered. Our appraiser confirmed that the average sale
prices for this area more closely approximated $1 .50 to
$1 . 75 per sq. ft. This fact is further sustained by the
fact that the City, at the commencement of the construction
' process, purchased three lots adjoining Mr. Burdick' s pro-
perty from private, willing, sellers at approximately $1 .75
per sq. ft. These parcels have higher value in that they
' are not encumbered by the low areas included in the Burdick
property; and
' - Mr. Burdick purchased one of the lots approximately six
months prior to commencement of the project. Mr. Burdick
paid approximately $1.50 per sq. ft. The project had been
well known and advertised prior to Mr. Burdick' s purchase.

There is no better indication of the market value of the
land than what was paid for the land at time of commence-
ment of the project. Any payment in excess of its market
value represents a windfall to persons solely interested in
' making a profit at the public' s expense; and
- A large portion of Lot 9 is extremely low and would not be
allowed to be developed without improving the wetland areas
and/or insuring water retention is met as required by the
Watershed District. To consider that the value of the land
which would be undevelopable at market rates is
unreasonable.
As stated at the beginning of this memorandum, both the City
Attorney and this office are desirous of seeing the appeal pro-
cess start. We anticipated such and now feel that it is impor-
tant that the general public become aware of the facts associated
with this issue. It is comforting to note that the trial process
will include citizens from our county who will be given the
opportunity to hear the facts . This issue is significant to our
citizens recognizing the total acreage obtained for the pond and
' roads , i .e. approximately $350 ,000 sq. ft. The windfall position
being sought by Mr. Burdick is an action being taken against and
at the expense of all citizens . We strongly oppose such and
' believe that the court process provides the best opportunity for
the entire community to hear the facts and make a reasonable
decision.

FACTUAL BACKGROUND
1 . Parcel 8 is a vacant, commercial lot located west of State
Highway 101 , fronting on State Highway 5 in Chanhassen , Minnesota .
Parcel 8 ; its size is estimated to be 90 , 151 square feet .
2 . Parcel 9 is a vacant, commercial lot located west of State
' Highway 101 , fronting on State Highway 5 in Chanhassen , Minnesota.
Parcel 9 ; its size is estimated to be 255 , 745 square feet .
3 . B. C . Burdick and Bridgitte Burdick are the fee owners of
land described as Parcel 8 and and Parcel 9 of this action .

4 . The Commissioner awarded $2 . 99/square foot or $270 , 000 . 00
for the taking of Parcel 8 and $2 . 51/sq. ft . or $642 , 600 . 00 for the
taking of Parcel 9 .
5 . Property values at the time of the taking in the area of the
' subject parcel were, from testimony presented by Appellants , shown
to be greater than the amounts awarded by the Commissioner for each
parcel.
6 . Testimony from appraiser Robert Strachota, and supported by
his appraisal, Exhibit P-53 , showed the two subject properties to be
valued at $5 . 21 per square foot or $1 , 800 , 000 . 00 . .

feet of the subject property as selling for $6 . 00 per square foot .
9 . City appraisals failed to take into account value of all the
' land included in the parcels subject to the taking; the City
eliminated 14 , 000 square feet from its appraisals .
10 . City appraisals of the subject property failed to take into
consideration all factors which bear upon the value of the subject
property.
11 . The two parcels covered by this action are contiguous ,
owned by the same fee owners , were occupied as one parcel, and must
be considered as a unit for purposes of assessment of damages .

Dear Mr. Schumacher:
The purpose of this letter is to bring to a conclusion the
ongoing communication between you, our City Council, and myself
concerning the Assumption Seminary Farm. Per our last conver-
sation, you expressed a willingness to comply with the actions
1 that we jointly decided upon to secure the property in order to
preserve public safety.
These items were agreed upon at our June 21, 1988, meeting, which
was attended by yourself, City Attorney Roger Knutson, Public
Safety Director Jim Chafee, Fire Chief Dale Gregory, and myself.
Attached please find my memo dated June 21, 1988 , to City
' Manager, Don Ashworth, in which I outlined the results of this
meeting. You will note that the final paragraph requests a
letter from the City to you stating the specific requirements
that are being made of you regarding the property. The time that
has elapsed since that meeting has been used to solicit input
from the City Council, the City Manager, and the Mayor.
Per my attached memo dated August 18 , 1988, to Jim Chaffee,
. Public Safety Director, which has been endorsed by the City
Manager, we are now in a position to state to you the require-
ments we are making of you, as property owner:
1 . Within 30 days, you are to have all of the barrels on the
property removed in compliance with the law, advising us
of the manner in which the material was disposed.
2 . Within 30 days, you are to provide security measures to
make the property inaccessible to trespassers , advising
us of the method that you take. (Per your letter of July
21, 1988 , I understand that you are considering an alarm
system in lieu of posting an armed guard on the premises ,
as well as seeking to provide adequate security lighting. )

3 . Within 30 days, you are to make arrangements with
' Chanhassen Fire Chief Dale Gregory to arrange for the
dormatory building to be burned, and possibly the gra-
nary. Recognizing that drought conditions may influence
the date of the burn, this particular requirement is
merely seeking that you make arrangements with our Fire
Department to carry out this phase of your agreement at
the earliest possible date.
' 4 . Within 30 days, you are to remove all tires that are
illegally stored on the property, in compliance with the
law, advising us of the method of disposal.
' 5 . Within 30 days, you are to clean up anything that pre-
sents a health hazard inside the barn, advising us of the
' action taken.
6 . Within 30 days , you are to comply with the Chanhassen
City Code Section regarding the storage of any debris on
the property (City Code, Chapter 13 , Nuisances) , advising
us of the action taken.
I have continued to attempt to be cooperative with all parties
concerned regarding the status of your property. I feel that we
have had an ongoing positive relationship with you and your co-
owners. I trust that this will continue now that I have received
the authorization from the City Manager to definitively set forth
the itemized requirements above.
I definitely want these measures taken within 30 days , as a good
deal of time has elapsed already, and with winter approaching,
the potential for problems on the property only escalate. One
' recommendation that had been made was for all of the windows of
the seminary building to be boarded up. I am not requiring this
because I believe that the necessity for some light in the
' building in the event that people are legally inside, as well as
the fact that boarded up windows would only prohibit patroling
officers to see inside, makes this a recommendation that we are
willing to do without.
Per the requirements of our City Code, I am attaching the NOTICE
form regarding the above. I would like to thank you for your
' anticipated cooperation. As always , I remain available to assist
you; to answer questions; to provide resources; or to help in any
other way that I can. I look forward to concluding this matter
with you, and will be looking forward to your reply.

I was asked to contact the representative owner of the Assumption Seminary Farm
I property, Mr. James J. Schumacher, to inquire as to a response to my letter of
July 29, 1988. This letter setforth the following requirements that I
understand were made by the Mayor:
II1. Specific Times for the Completion of Specific Work: Mr. Schumacher
advises me that he is proceeding aa•rapidly as possible to set such
I times; however, he is still awaiting a response from the Carver County
Environmentalist who is assisting him in legally dealing with the drums
of material, tires, etc. He assured me that he is anxious to conclude
this clean-up process and will advise as soon as he knows. I have also
1 talked with Mr. Mike Shotliff, Carver County Envinronmentalist, who con-
firmed this.
I 2. Board up all Windows in Seminary Building-: Mr. Schumacher did state
that his group of owners does not feel that all of the windows need to
be secured in order to make the building safe at this point. Frankly, I
1 think he does have a point, as what available light does come in is
beneficial from a safety standpoint for those of us that are required to
enter the building on occasion.
I 3. Get Rid of Tires: Again, Mr. Schumacher advises that he is working with
the Carver County Environmentalist in order to dispose of the tires pro-
perly.
I4. Clean-up Anything that is a Health Hazard Inside the Barn: Mr.
Schumacher is, again, pursuing this with the County representative.

Contracting in an attempt to maximize efficiency in clean up and preparation work

We are writing to express our concern and the concern of the City of Chanhassen
I regarding the above-referenced project. For several weeks now, going back to
early August, the City has been extremely anxious to start placing wear course
mix downtown. In fact, discussions the week of August 8 indicated paving could
II be expected as soon as the week of August 22. We have represented this to the
City Council , City staff and the local businessmen. We are extremely irritated
that the schedule has continued to slide backwards.
I Representatives of both Shafer Contracting and Hardrives have been out to the
job numerous times to evaluate conditions, with no results as of this date.
II As per our latest discussion of August 30, we are fully expecting wear course
paving to be underway Tuesday, September 5, 1988, with completion that week.
Again, I can not overstate the concerns of the City in this matter. We would

II This is offered as a clarification concerning neon installations on the
Chanhassen Clock Tower and Entry Monument.
I In brief, this project dates back to its initial approval with City Council/HRA
in June 1987. Through much discussion and alternative selections by both City
Council and HRA the package was approved for bidding and the bid date was set
I for September 3, 1987. The bidding climate proved to be poor at this time and
only one bid was received; subsequently, the HRA voted to wait until spring for
rebidding.
I In the Spring of 1988, the project was once again brought up for discussion and
design review. At this time the HRA/City Council ordered the project to be
rebid and a date of April 6, 1988, was set. Through this second set of meetings
I alternatives were discussed pertaining to orientation, number of clock faces and
neon color for signage and general illumination. Upon review of meeting minutes
from both City Council and HRA discussions, I find that there should have been a
I color selection process where a sample panel of potential neon colors was pre-
sented for approval to the HRA. During the construction process this was mis-
takenly overlooked by me, and color decisions were made based solely on design
intent. Therefore, I make the following recommendations:
I1. The Clock Tower and Entry Monument construction is scheduled to be finished
within the next two weeks. As the entire neon installation is presently
I complete, I recommend that the existing color be reviewed once it is
powered-up.
2. If, in fact, the color selected does not meet with majority approval , it
Iwill be removed and replaced with an approved color at BRW's expense.
At this time, I would like to offer my sincere apologies for any inconvenience
I this may have caused and assure you that BRW will rectify this matter in order
to provide the best possible product for the City of Chanhassen.

1 The function of a transportation plan is to not only accommodate
future needs but also to analyze existing problems and to pose
appropriate solutions . Frequently, existing problems are closely
1 related to future needs. A:z a result , a specific action in a
given area can remedy existing deficiencies while providing for
future needs.
Our Annual Certification of Mileage (December 31 , 1988) shows
that we are under our maximum allowance by 2. 81 miles. We there-
1 fore request your review and approval of .our request for the
addition of roadways to our present State Aid System as marked in
red on the attached Preliminary Layout Plan.
' The proposed roadways are as follows:
I. Extension of Powers Boulevard south of Lyman Boulevard
between County Road 18 ( Lyman Boulevard) and Bluff Creek
Drive - total of 1 .59 miles split into two segments as
follows:

I A eneral problem in
g p Chanhassen ' s existing north/south
transportation system is readily apparent in Trunk Highway
I101. Trunk Highway 101 is classified as a temporary trunk
highway and as such has not received appropriations for any
improvements with the exception of absolute minimum
I necessities . The highway has significant alignment and
geometric problems , particulary south of Trunk Highway 5 .
I Therefore, the extension of Powers Boulevard south of Lyman
Boulevard would add functional continuity as a main route
to the City ' s north/south transportation system. This
is also an important link being incorporated into the new
ITrunk Highway 212 alignment study and E. I. S.
III . Extension of Lake Drive East ( Segment 108-010 ) between
Audubon Road and Galpin Boulevard - 0 . 98 miles.
The westerly extension of segment 108-010 would add con-
tinuity as a main route to the City ' s east/west transpor-
tation system. As it now exists , the City' s east/west
system of highways include County Road 18 , County Road 14
I and State Highway 5 . With the addition of Lake Susan Hills
West and the Timberwood Estates developments, the demand for
an east/west highway in this general area is readily
I apparent . The addition of this extension would ease some
of the load on Highway 5 by providing for another east/west
throughway.

Planner, to the agencies referred to by you and the City Council
on January 11, 1988 . We have been informed by the State that all
map companies seek their map information from them or directly
' from the City. The City does not have a list of "local map
printers" . All new subdivisions ( including street names and
street name changes) are sent directly to the State after appro-
1 val by the City Council.
A referral to police, fire, and paramedics was made by the Public
1 Safety Director on September 14, 1987 (original date of Council
action making such change) . You are 'welcome to contact the
Public Safety Director, Jim Chaffee, directly regarding the maps
used by public safety personnel and the frequency of the map
1 updates .
If you are aware of a specific agency which you do not feel was

Hidden Valley subdivision was changed to Sinnen Circle on August
18, 1986. This name change affects Lots 12 through 21, Block 4 ,
of the Hidden Valley subdivision. The City has been contacted
that confusion has occurred regarding the official street name.
Please note this change on your maps . The City is now in the
