Between the subject site and Hwy. 5 is an unimproved public street right-of-way of Lone Cedar Lane (Attachment #1) . The applicant is proposing to vacate a portion of the Lone Cedar right-of-way to provide additional square footage to his property to permit the subdivision of the site into two single family lots ( see subdivision report and plat) . The subject site is currently serviced by a gravel drive from Lone Cedar Circle. Two lots located directly to the east of the subject site have direct access to Hwy. 5 and are not dependent upon the improvement of the Lone Cedar Lane right-of-way for their access (Attachment #2) . The city does not have any plans to improve the right-of-way. With the vacation of the street right-of-way, the lots maintain the required 90 feet of street frontage along Hwy. 5 . The applicant has presented the vacation request to the lot owner to the east whose property abuts the Lone Cedar right-of-way and has right of use to the Lone Cedar right-of-way. The property owner to the east has no objection to the vacation of the right- of-way as long as the applicant provides an easement which he could use if necessary to cross the two subject sites for access to Lone Cedar. The applicant is willing to provide this easement and is in the process of having it defined. Attachment #3 is the memo from the Assistant City Engineer which addresses the street vacation. RECOMMENDATION Staff recommends that the City Council approve Vacation Request #88-5 to vacate a portion of Lone Cedar Lane as shown on the site plan dated "Received August 15 , 1988" and subject to the following conditions : 1 . The applicant shall provide an easement for Lot 3 , Block 1, Cedar Crest to cross Lot 4 , Block 1 of Cedar Crest. I ' 2 . A 15 foot drainage and utility easement shall be centered over the 12 inch watermain for the entire length of the right-of-way to be vacated. ATTACHMENTS 1 . The proposed house pad must be outside of the existing drainage or utility easements. Recommended Conditions 1 . The applicant shall submit plans for the construction of the driveway for Lot 1 , Block 1 to the City Engineer for approval prior to final plat review. 2 . The applicant shall obtain written approval by the Minnesota Department of Transportation for the construction of the . I driveway onto Lone Cedar Road prior to final plat review. 3 . The proposed driveway for Lot 1 , Block 1 shall maintain a minimum separation of 100 feet from State Highway 5 . I 4 . A 15-foot utility and drainage easement shall be centered over the 12-inch diameter watermain for the entire length of the right-of-way to be vacated. Attachments I 1. Right-of-way diagram. 2 .
