Approve Amendment to Development Contract for Arrowhead
Addition - Project No. 00-09
In conjunction with the sale of the property to be platted as Arrowhead Addition,
the developer has requested modifications to the development contract.
Specifically, the changes involve the name of the developer. The conditions of
approval remain as previously approved on October 23, 2000. The developer,
Arrowhead Development Corp., is transferring the development responsibilities to
the new owner, Twin Cities Habitat For Humanity, Inc. Attached is a revised
development contract incorporating these changes.
It is therefore recommended that the City Council approve the revised
development contract dated November 13, 2000.

DEVELOPMENT CONTRACT
(Developer Installed Improvements)
SPECIAL PROVISIONS
AGREEMENT dated October 23, 2000 by and between the CITY OF CHANHASSEN, a
Minnesota municipal corporation (the "City"), and, TWIN CITIES HABITAT FOR HUMANITY,
INC., a Minnesota Corporation (the "Developer").
1. Request for Plat Approval. The Developer has asked the City to approve a plat for
ARROWHEAD ADDmON (referred to in this Contract as the "plat"). The land is legally
described on the attached Exhibit" A".
2. Conditions of Plat Approval. The City hereby approves the plat on condition that
the Developer enter into this Contract and furnish the security required by it.
3. Development Plans. The plat shall be developed in accordance with the following
plans. The plans shall not be attached to this Contract. With the, exception of Plan A, the plans
may be prepared, subject to City approval, after entering the Contract, but before commencement of
any work in the plat. If the plaiIs vary from the written terms of this Contract, the written terms
shall control. The plans are:
PlanA:
Final plat approved October 23, 2000, prepared by Advance Surveying &
Engineering.
PlanB:
Grading, Drainage and Erosion Control Plan dated October 26, 2000, prepared by
Advance Surveying & Engineering.
PlanC:
Plans and Specifications for Improvements dated October 16, 2000, prepared by
Wenck Associates.
PlanD:
Landscape Plan dated October 26, 2000, prepared by Advance Surveying &
Engineering.

ITom time to time as financial obligations are paid, but in no case shall the security be reduced to a
point less than 10% of the original amount until all improvements are complete and accepted by the
City.
7. Notice. Required notices to the Developer shall be in writing, and shall be either
hand delivered to the Developer, its employees or agents, or mailed to the Developer by registered
mail at the following address:

Notices to the City shall be in writing and shall be either hand delivered to the City Manager, or
mailed to the City by registered mail in care of the City Manager at the following address:
Chanhassen City Hall, 690 City Center Drive, P.O. Box 147, Chanhassen, Minnesota 55317,
Telephone (612) 937-1900.
8. Other Special Conditions.
A. The development shall pay full park and trails fees pursuant to city ordinance in lieu of
park land dedication.
B. If any soil corrections are done on the property a final grading plan and soil report must
be submitted to the Inspections Division before permits will be issued.
C. Address numbers must be posted at the driveway entrance on Powers Blvd. and on each
dwelling.
D. A detailed grading, drainage, erosion control, and tree removal plan will be required for
each lot at time of building permit application for City staff to review.
E. The applicant will be required to enter into a development contract with the City and
provide the necessary financial security to guarantee installation of the public
improvements and conditions of final plat approval.
F. The applicant shall dedicate the southeasterly 50 feet of Outlot A for public street
purposes for Holly Lane.
G. The applicant shall prepare and have recorded a 20-foot wide private drainage and utility
easement in favor of Lot lover Lot 2 to extend sewer and water service to Lot 1. In
addition, the developer shall prepare and have recorded a 30-foot wide private driveway
easement agreement across Lot 2 to provide access to Lot 1 ITom Powers Boulevard.
The driveway width shall be a minimum of 18 feet wide and a maximum of 24 feet wide
in the common portion of the driveway area. Individual driveways may be a minimum
