A great place to live, work, and play FROM: DATE: SUBJ: Approve Memorandum of Understanding for TH 212 Decorative Railing Maintenance - Project No. 03-09 REOUESTED ACTION Approve Memorandum of Understanding for TH 212 Decorative Railing Maintenance. BACKGROUND In June, 1997, an architectural and visual quality design recommendation forTH 212 was completed that included metal railings on bridges for visual enhancement safety reasons. The railings are installed adjacent to trails. The railings, however, are not covered under MnDOT's maintenance policy since they are an enhancement for the corridor. The maintenance and replacement responsibility is therefore the local responsibility and, as such, should be considered part of the trail system. The maintenance of the railings is anticipated to be minimal. The railings will be galvanized metal and will be painted. The painting typically lasts between 15-20 years and with proper maintenance, the railings will last as long as the bridges, 50 years. At this time, staff recommends approving the Memorandum of Understanding with MnDOT. The MOU covers the topic of decorative railing used on the TH 212 Design-Build project. The procedure for executing this MOU is as follows: 1. The City signs the two original copies and mails them back to Jon Chiglo, Metropolitan Division - Waters Edge, 1500 West County Road B-2, Roseville, MN 55113. 2. Mn/DOT obtains the remaining signatures. 3. Mn/DOT mails a fully signed original back to the City. If you have any questions, feel free to contact me at 651-582-1340. WHEREAS, the State included in the construction contract S.P. 1017-12 for proposed US Trunk Highway No. 212, community requested aesthetic metal rail for the bridges; and WHEREAS, the State's Policy and Procedure for Cooperative Construction Projects with Local Units of Government states that all aesthetic treatment and features on local roads on top of or under trunk highway bridges will be maintained by the local unit of government; and IT IS, THEREFORE, MUTUALLY AGREED AS FOlLOWS: Upon satisfactory completion of the construction of the aesthetic metal railing for Bridge Nos. 10539, 10038, 10039, 10040, 10041 under the construction contract, the City shall provide for the proper maintenance of the railing, including painting and replacement, without cost or expense to the State.
