APPLICABLE REGULATIONS
Section 20-812 permits warehouse and office as a permitted use in
the IOP District.
Section 20-815 allows a maximum lot coverage of 70%, a front yard
setback of 30 feet, a rear yard setback of 10 feet and a side
yard setback of 10 feet. This section also allows a maximum
height of 50 feet for the prinicipal structure.
' Section 20-1191 requires a 10 foot strip of land between abutting
right-of-way and vehicular use areas including one tree per 40
feet and a hedge wall or berm of at least 2 feet.
' Section 20-1192 requires interior property lines to be landscaped
with one tree per 40 feet.
Section 20-1211 requires interior landscaping for vehicular use
areas.
Section 20-1125 requires for warehouse one parking space for each
1 ,000 square feet of gross floor area up to 10 ,000 and one addi-
tional space for each additional 2 ,000 square feet, plus one
space for each company vehicle. For office it requires 3 spaces
per 1 ,000 square feet.

ANALYSIS
The applicant is proposing to construct a 25 ,000 square foot
office warehouse building which will be rented to different
businesses.
' The 25 ,000 square foot building is located in the southwest
corner of the site. The easterly portion of the site will remain
as it exists within the existing trees and meadow.

The site is providing the required 30 foot front yard setbacks
from Highway 5 and Park Drive and is also providing the 10 ' side
yard setback required along the south property line. The site
contains parking along the westerly and northerly portion of the
building with loading docks located along the south and east side
of the building. The building is surrounded on all sides by
parking and vehicular area.
PARKING AND LANDSCAPING
The applicant is proposing to have one-third of the building '
used as office space and two-thirds of the building used for
warehouse. The applicant is providing 43 regular parking spaces
plus two handicapped spaces for a total of 45 parking spaces
which exceeds the requirements of the zoning ordinance.
The applicant is providing the required berming between the vehi-
cular area and road right-of-ways and is also providing adequate
amount of vegetation along the westerly and northerly portion of
the site. The vegetation on the west and north side is deciduous
but should include some evergreens to provide 50% winter opacity.
The site plan is providing Colorado Spruce along the southerly
lot line to screen the loading dock area. The amount of Colorado
Spruce along the south lot line should be increased to provide
continuous screening of the loading and dock area and the
landscaping should continue to the edge of the parking area on
the south side of the site. The applicant is providing an 8 foot
high wood fence on the east side of the loading area which will
also act to screen the docking area from Park Drive.
The site plan has two dumpsters in the docking area which are
screened on three sides. The ordinance requires that dumpsters
be screened on all sides . The applicant is also proposing to
screen all rooftop equipment.
ACCESS ,
The applicant is providing access at the most southwesterly
corner of the site to locate it the furthest distance from Hwy. 5 11 as possible. This has been approved by MnDOT. The applicant is
also showing the proposed Hwy. 5 right-of-way. The applicant
has been in contract with MnDOT prior to designing the site plan
to accommodate the proposed right-of-way as best possible. MnDOT
has reviewed the plans and found them to be suitable.
GRADING, DRAINAGE AND UTILITIES i
Attachment #3 is a memo from the Assistant City Engineer
addressing grading, drainage and utilities .

MISCELLANEOUS
The building will be rented to separate businesses and staff
will review the type of business being proposed for the building
' when they receive occupancy permits from the Building Department.
This will guarantee that any business moving into the site is
permitted within the IOP District.
RECOMMENDATION
The site plan meets the requirements of the ordinance and

Sec. 20-815. Lot requirements and setbacks. '
The following minimum requirements shall be observed in an "TOP" District subject to
additional requirements, exceptions and modifications set forth in this chapter:
(1) The minimum lot area is one(1)acre.
(2) The minimum lot frontage is one hundred fifty(150)feet, except that lots fronting on
a cul-de-sac shall have a minimum frontage of sixty(60)feet.
(3) The minimum lot depth is two hundred(200)feet.
(4) The maximum lot coverage is seventy(70)percent. '
(5) Off-street parking areas shall comply with all yard requirements of this section,
except that no rear yard parking setback shall be required for lots directly abutting ,
railroad trackage; and, no side yard shall be required when adjoining commercial
uses establish joint off-street parking facilities, as provided in section 20-1122, except
that no parking areas shall be permitted in any required side street side yard. The '
minimum rear yard shall be fifty (50) feet for lots directly abutting any residential
district. Side street side yards shall be a minimum of twenty-five (25) feet in all
districts. Other setbacks are as follows:
a. For front yards,thirty(30)feet.
b. For rear yards, ten(10)feet.
c. For side yards, ten(10)feet.
(6) The maximum height is as follows:

(5) The removal of diseased and damaged trees is permissible.
(d) Tree removal not permitted under subdivision,planned unit development or site plan
review shall not be allowed without the approval of a tree removal plan by the city council.
Tree removal plans shall include the content requirements as dictated in section 20-1177 and I
identify reasons for tree removal. The plan shall be submitted three (3)weeks in advance of
the city council at which it is to be considered.

DIVISION 2. PERIMETER LANDSCAPING REQUIREMENTS I
Sec. 20-1191. Generally.
(a) Where parking areas are not entirely screened visually by an intervening building or

structure from any abutting right-of-way, there shall be provided landscaping between such
area and such right-of-way as follows:
(1) A strip of land at least ten (10) feet in depth located between the abutting right-of-
- way and the vehicular use area which shall be landscaped to include an average of
one (1) tree for each forty (40) linear feet or fraction thereof. Such trees shall be
located between the abutting right-of-way and the vehicular use area.
(2) In addition,a hedge,wall,berm,or other opaque durable landscape barrier of at least
two(2)feet in height shall be placed along the entire length of the vehicular use area. ,
If such opaque durable barrier is of nonliving material, a shrub or vine shall be
planted along the street side of said barrier and be planted in such a manner to break
up the expanse of the wall. A two-foot berm may be used; however, additional

landscaping at least one (1)foot in height at time of planting shall be installed. The
remainder of the required landscape areas shall be landscaped with grass, ground I
cover, or other landscape treatment.
(b) This division applies to perimeter landscaping.

Sec. 20-1192. Required landscaping adjacent to interior property lines.
(a) Where parking areas abut property zoned or, in fact, used primarily for residential or

,institutional purposes,that portion of such area not entirely screened visually by an interven-
ing structure or existing conforming buffer from an abutting property,there shall be provided
a landscaped buffer which should be maintained and replaced as needed. Such landscaped
buffer shall consist of plant material, wall, or other durable barrier at least six (6) feet in
height measured from the median elevation of the parking area closest to the common lot line,

and be located between the common lot line and the off-street parking areas or other vehicular
use area exposed to the abutting property. Fences shall be constructed according to the
standards in section 20-1018.

Sec. 20-1193. Combining with easements.
The required landscape bufferyard may be combined with a utility or other easement as
long as all of the landscape requirements can be fully met, otherwise, the landscape bufferyard
shall be provided in addition to, and separate from, any other easement. Cars or other objects
shall not overhang or otherwise intrude upon the required landscape bufferyard more than
two and one-half(21/2)feet and curbs will be required.

Sec. 20-1211. Generally.

(20) or more vehicular parking spaces, shall provide interior landscaping in accordance with
this division in addition to "perimeter" landscaping. Interior landscaping may be peninsular
or island types.
(b) This division applies to interior landscaping of such areas.

' Sec. 20-1212. Landscape area.
(a) For each one hundred(100)square feet, or fraction thereof, of vehicular use area,five

Chanhassen Lakes Business Park
Planning File No. 88-13 , Dolphin Construction
IThis site is located on the south ea st corner of Highway 5 and
' Park Drive. The site is composed of a flat , open field with a
creek which traverses the northeast corner of the lot.
Sanitary Sewer
Municipal sanitary sewer service is available to the site by the
existing 10-inch diameter sanitary sewer along Park Drive.
Sanitary sewer services have been extended to the property line.
Water Service
' Municipal water service is available to the site by a 10-inch
diameter watermain along Park Drive. A water service has been
extended to the property boundary.
' Access
The plan proposes a 30-foot wide driveway at the southwest corner
of the subject parcel. The proposed driveway maintains the maxi-
mum separation for this parcel from State Highway 5 . We find
that this plan is acceptable.
1 Grading and Drainage
The plan proposes a minimal amount of grading to the site. Tree
removal has been reduced to a minimum.
The plans propose that a storm sewer system be constructed along
' the southerly side of the parcel which will drain to the existing
sediment pond located on the east side of the parcel. The storm
sewer plan calls from PVC storm sewer pipe. The City' s standard

is RCP for the urban areas . The plan should be revised to incor-
porate reinforced RCP in the storm sewer design. The applicant
will need to obtain a permit from the Watershed District for the
construction of the storm sewer and within the proximity of the
existing sedimentation pond.
The predeveloped runoff rate has been maintained by the construc- ,
tion of the existing sedimentation pond as part of the Chanhassen
Lakes Business Park One project. Further on-site ponding will
not be necessary. '
Erosion Control
The plans do not address erosion control. A revised erosion '
control plan showing the City' s standard for Type II erosion
control shall be submitted to the City Engineer for approval
prior to final review.
Recommended Conditions
1 . The applicant shall obtain and comply with all conditions of
the Watershed District permit .
2. The plans shall be revised to address erosion control and '
shall show the City ' s standard details for Type II erosion
control. These plans shall be submitted to the City Engineer

Land Development in Chanhassen Lakes Business Park. As you know, we are planning
to construct a 25,000 square foot office/warehouse building at the southeast
corner of the park entrance.
The building is to be known as "Park Place", will house several existing
Chanhassen firms and should attract several new business entities to the city.
The architectural firm of Krech, O'Brien, Mueller and Wass, Inc. shall represent ,
the owner and provide any support you may need in the review and approval
process.

Conrad: Yes, that seemed like the logic to use. If TH 101 is not going
II to be going through there anymore, we' re trying to resolve that issue with
them and I 've got to believe that we got to press that point Larry that
we' re trying to resolve the TH 101 traffic issue and push it other places .
IIEmmings: No alternative for TH 101 keeps it where it is .
I .Conrad : And putting an island in there is certainly not going to help.
Brown: That's the direction we' ll go back to MnDot with and hopefully
speed the process up in getting it back to central office . As Jo Ann
I mentioned, there will be an open house so this will be a little fuel to
the fire.
I Conrad : We' re making efforts to solve some other traffic problems. The
community is going out of their way to solve those problems and now we' re
creating additional problems for businesses . That just doesn' t make
sense.
IBatzli moved , Ellson seconded that the Planning Commission table action on
Site Plan Review #88-11 until the issues with the TH 101 median,
I additional right-of-way and Gary Brown' s access can be resolved with City
Staff. All voted in favor and the motion carried.

IBrian Wass : I'm Brian Wass . I 'm the architect . This is Joe Hardy.
Conrad: Anything you want to tell us?
Joe Hardy: No , unless you have any questions .
Brian Wass: The only question I ' ve got is the 15% opacity. I don' t know
Iwhat that means . On the north and west side. What ' s the issue there?
Ellson: If you had trees with leaves that fall down in the winter, you
could get rid of that with evergreens . . .
IIBrian Wass: How high does that go?
IOlsen : We have a minimum of 6 feet .
Brian Wass: Okay, so we' re looking for a maturity of something that ' s
t'-' about 6 feet high?
Headla : Is the parking lot going to have any lights?

Olsen: They are showing lighting standards . . .
Headla : You don' t have any problem with the way they' re going to have
their lights?
Olsen : No . Actually have met the standards. • ;
Headla: And have they talked much about signage?
Olsen : . . .but they' ll have to meet the requirements of the ordinance.
Brian Wass: There were some elevations. The intent is for individual
backlit letters . 1
Headla : Is that going to be built right into the building? Are we dead
sure they' re not going to touch any of the trees there? What I 'm
wondering is if we should put in something about saying that any trees
they take out they replace with an equivalent amount of wood. Like if
they cut down a 4 inch tree, for whatever reason , they've got to put up 4
1 inch saplings or something like that.
Olsen : We can do that. We can have them stake out their extent of
grading and I can walk the site with Larry. . .
Headla : I 'd feel a little bit more comfortable with that type of
response. I don't think that' s restrictive. I just want to encourage
them to try and keep as many of those trees as they can. I
Brian Wass : That is the intent of the plan so far . We've been out and
taped the site and in addition to the survey information we received and
the intent is to leave that existing grove just the way it is .
.Headla : How close do we come to that? '
Brian Wass: It's shown right on your plan. It shows the extent of the
existing grove and where we ' re developing up to the edge of that . It ' s a
very defined edge because it's kind of an alfalfa field now. The intent
is to come up to the edge of those trees but not to disturb them. Number
one because they are a good diameter, large mature trees and also because
that ' s the point where the ravine starts to take off and we just don' t
want to get into that.

Brown: If the commission so chooses , as we did on the Woodcrest
Subdivision when the same issue came up, we can have the applicant erect a
snow fence at the limits of trees .
Headla: I think that' s a good idea . '
Ellson : Then they take it down after they' re done constructing?
Headla: That would give me a lot more confidence. 1

IHeadla moved , Wildermuth seconded that the Planning Commission recommend
approval of Site Plan Request #88-13 as shown on the site plan stamped
"Received August 29 , 1988" and subject to the following conditions :
1 1. The applicant provide additional and continuous screening along the
south lot line to the easterly side of the parking area .
II2. The applicant provide evergreens along the north and west property
lines to provide 50% opacity.
I3. The applicant provide complete screening of the dumpster areas .
4. All rooftop equipment must be screened.
I5. The applicant shall obtain and comply with all conditions of the
Watershed District permit.
I6. The plans shall be revised to address erosion control and shall show
the City's standard details for Type II erosion control . These plans
shall be submitted to the City Engineer for approval prior to final
Ireview.
7. The plans shall be revised to include an energy dissipator manhole

8. Calculations which indicate the increased volume of runoff shall be

9. The driveway shall be constructed with a concrete cross gutter P er the

Planning File No. 88-13 Site Plan , Dolphin Construction
My previous memorandum for the site plan had recommended an
energy dissipator to be located prior to the discharge into the
existing ponding area.
Since that time, the Watershed District Engineer Bob Obermeyer
has contacted me and requested that the energy dissipator be
revised to the type of structure as shown in Attachment No. 1 .
Mr. Obermeyer further recommended that the discharge pipe for the
storm sewer system be extended into the pond such that the outlet
is submerged, and the discharge velocity is not to exceed three
feet per second.
It is therefore recommended that the site plan for Dolphin
Construction, further described as Lot 1 , Block 3 , Chanhassen
Lakes Business Park, be approved upon the following condition:
1. The applicant shall revise the site plan to incorporate the
Watershed District ' s recommendations and shall submit three
sets of the revised plan to the City Engineer for approval
PRIOR to construction. The applicant' s engineer shall also
supply calculations which verify that the discharge velocity
will not exceed three feet per second during a 100-year storm
event.
