I SUBJ: Request to Vacate a Portion of Utility Easement on
7600 & 7602 Erie Avenue, Micheal Sorenson.
Vacation File 88-6
1 Attachment No. 1 shows the existing sanitary sewer easement
which was dedicated in favor of the City of Chanhassen on
I August 12, 1969 . The City has an eight inch diameter
sanitary sewer main which follows the north boundary of the
Sorenson property. The applicant is requesting that the
portion of sanitary sewer easement not required for the
IImaintenance of the existing utility be vacated.
The original property over which this easement was dedicated
I extends 33 feet beyond the westerly right of way line for
Erie Avenue . To date, a roadway, Drainage, and utility
easement has not been located for the 33 foot portion of what
IIwould be right of way.
It is recommended that the City vacate the portion of the
utility easement as shown in attachment 2, contingent upon
I receipt of a roadway, utility, and drainage easement for the
remaining 33 feet within the recognized Erie Avenue right of
way. This would leave a 25 foot easement in effect over the
IIsanitary sewer line .
It is therefore recommended that the City vacate that portion
of the utility easement as shown in attachment 2, contingent -
II upon receipt of a roadway, utility and drainage easement for
the remaining 33 feet within the recognized Erie Avenue right
of way. The proposed easements are shown in attachment 3 .
I The legal description for the easement to be vacated, and the
proposed roadway, utility, and drainage easement have been
included as attachments 4 and 5 respectively.

' That part of the Southwest Quarter of the Southeast Quarter of
Section 12 , Township 116 , Range 23, Carver County, Minnesota,
described as follows:
Beginning at a point on the North line of West 77th Street 200
feet East of the intersection of said North line with the East
' line of Frontier Trail extended, in the City of Chanhassen,
according to the plat of said City on file and of record in the
office of the Register of Deeds for said County; thence North,
parallel to the East line of Frontier Trail extended, 563 . 92
feet, more or less, to the South line of Government Lot Four ( 4)
of said Section 12 , the point of commencement of the parcel of
land hereby conveyed; thence East along the South line of said
' Lot 4 , 582 . 9 feet to the Northeast corner of the Southwest
Quarter of the Southeast Quarter of said Section 12; thence South
along the East line of said Southwest Quarter of the Southeast
Quarter of said Section 12 , 111 . 7 feet to the Northeasterly line
of Erie Avenue; thence Southwest along said Northeasterly line of
Erie Avenue 50 . 4 feet; thence West, parallel with the North line
of West 77th Street, 551 . 7 feet; thence North parallel to the
' East line of Frontier Trail extended, 150 feet to the point of
beginning; excepting therefrom the above described tract the

THIS INSTRUMENT, Made this day of , 19 ,

the first part, and the CITY OF CHANHASSEN, a Minnesota municipal
corporation, party of the second part;
WITNESSETH, That the said part of the first part, in con-
sideration
of One Dollar and other good and valuable con-
sideration to in hand paid by the said party of the
second part, the receipt whereof is hereby acknowledged, do
hereby Grant, Bargain, Sell , Convey and Warrant to said party of
the second part, its successors and assigns , the perpetual right
and easement to construct, maintain, operate and repair
roadways , mains , pipes and appurtenances over , under and across '
the premises described in Exhibit "A" attached hereto and made a
part hereof , together with whatever temporary easments are herein
described, and together with a perpetual easement for ingress and
egress.
