City Planner, DATE: November 9 , 1988 SUBJ: Wetland Map Staff has contacted Mr . Paul Burke from the Fish and Wildlife Service about using the Fish and Wildlife Service to update our ' wetland map. Mr. Burke said that they would be very pleased to do that. Mr. Burke stated that the Fish and Wildlife Service would review aerial photographs and also make on site visits to create a ' complete and up to date map designating the wetlands within the City of Chanhassen. There would be no cost to the city for this except to buy the maps from the Fish and Wildlife Service. We ' can also purchase mylars from them so that we can make our own maps. In addition, Mr. Burke will be working with the city to create a computer program that would allow staff to punch in a certain area of the city and determine whether or not a wetland ' exists on that site. Mr. Burke said that they would be ini- tiating the project in November or December, 1988 and the map would probably be completed some time in March, 1989 . Green - Project Manager Dear Mr. Green: Amoco wishes to express our strong concern over MN DOT proposed plans to - - ' add a solid median on Highway 101 between Highway 5 North to the railroad in Chanhassen. II Should this median be constructed severe damage will be done to the existing businesses on both sides of Highway 101 as traffic will not be allowed ingress or egress respectively and therefore business failure will occur. . We are particularly disturbed that this current project follows what we were informed and shown as the "Downtown Redevelopment TH 101/ Great Plains Roadway" plan dated 5/8/87. This plan changed elevation of T.H. 101, added ' medians north of Amoco's northerly drive cut to the tracks, right of way slope changes occured etc. Our concern further is that a proposal to relocate T.H. 101 is also being considered, making the median proposal one of a nonsensical approach. The street functions fine today and will continue to function in a safe ' manner well into the next century. Businesses have invested tremendous sums of capital to improve their appearance and some wish to even spend more capital dollars to improve their businesses. It clearly seems that MN DOT wishes to meddle in the free enterprize system in order to cause chaos without compensation. Amoco respectfully requests your discontinuance of this project as being a.worthless expenditure of public funds. The customer subsequently cancelled his purchase agreement with us, whereby we should have requested a refund on this permit immediately. Somehow, this "slipped through the cracks". We did verbally request a refund from the city 2 weeks ago, and received ' the enclosed reply. To date, we have built several homes in Chanhassen, including a Parade of ' Hanes entry in Hidden Valley, the area in which this permit was pulled. Since we have every intention of building more homes in the area. I am requesting a waiver of the 180 day rule in the Uniform Building Code ' Secion 304 (F) (see attached) and a refund of $3,395.18. Apparently the Chanhassen Elementary School was sponsoring a PTA meeting and several hundred cars were in attendance causing a parking problem on and near fire department ' property. I was informed that firefighters who lived nearby observed the parking violations and notified the Carver County Sheriff' s Department. I talked with Captain Pagelkopf of the Carver County Sheriff' s Department who looked into the matter and notified me that there were two squads on the scene in response to the calls about the parking violations with over twenty warning tags issued. There were, according to Captain Pagekopf, no hydrants blocked, nor were the doors to the fire station. ' I will be contacting the principal of the Chanhassen Elementary School, Dr. Kathleen Macy, and informing her of the parking ' problem that occurred during the function. I Chanhassen Elementary School 7600 Laredo Drive Chanhassen, MN 55317 1 Dear Dr. Macy: I On Tuesday evening, October 11, 1988 , there was apparently a large PTA function taking place at the Chanhassen Elementary School. This function attracted several hundred cars that ended up parking in areas that proved to be a hindrance to public I safety response to fires. Several off-duty firefighters observed the situation and notified the Carver County Sheriff' s Department. The Carver County Sheriff' s Department responded 1 with two squads and wrote over 20 warning notices to the viola- tors . In the past, the Chanhassen Elementary School and the Chanhassen I Volunteer Fire Department have worked very closely together coor- dinating their respective open houses. Unfortunately for this year, the main Fire Station is under construction and we were not 1 able to have our open house as in past years . I would ask only that if any large functions are planned at the Chanhassen Elementary School in the future that the Chanhassen Public Safety 1 Department be contacted so we can gear our efforts to prevent any parking violations that might occur. Cable commission contributions are needed to broaden the base of I funding for the channel and to meet the match requirements for the legislative funds. Contributions made by programming members of the channel cannot be used as a match. It was, therefore, ' very reassuring at the June meeting to hear positive remarks con- cerning financial support from cable commissions. As a result of that meeting the suggestion is for commissions to I contribute ten cents per subscriber per year to the regional channel, with the realization that a lesser amount may be more feasible for some. We have already received the suggested amount I from three commissions. That level of support will allow for greater outreach to promote broad use of Channel 6 and to provide a synergy which will benefit local community channels and our region as a whole. IThe TCRCC Board is working for widespread financial support which is necessary to ensure the success and availability of this I unique regional channel to the public. The channel's first year of operation was funded by programming members, a foundation grant and some tape handling fees. Pro bono work and services I played an important role in activating the channel. Equipment space and the microwave signal path from the WCCO II facility to cable system headends has been contributed. MEMORANDUM e°P v O 10L AL TO: Mayors, Managers, Clerks �_ -Uc-�`=6r tel FROM: Ann Higgins, Federal Liaison 6C6) SUBJECT: Proposed Rule for National Primary Drinking Water Regulation IICity officials have serious concerns about the workability and steep cost increases that are likely to affect water utility operating costs II if new proposed federal drinking water regulations are implemented as now proposed by the U.S. Environmental Protection Agency (EPA) . The regulations call for the elimination of lead contamination of drinking water supplies. EPA published the proposed new regulations on August 18. 1 Some 53, 000 water utilities throughout the nation will be affected. It is expected that nearly all systems in Minnesota will be required to install treatment equipment and/or to take other measures to comply with Inew standards for maximum contamination levels. The official comment period on the proposed regulations has ended. It is nevertheless, very important for city officials to make your concerns I known directly to members of the Minnesota Congressional Delegation. Comments and examples of the impact on local water utility operations and potential impact on utility rates for city residents should also be I brought to the attention of Representative Gerry Sikorski (6CD-MN)., who serves on the House Environment and Commerce Committee. He authored legislation (H.R. 4939) during the '88 Congress. As originally drafted, the bill would have imposed far-reaching mandates on cities to I regulate the level of lead in drinking water. While the bill was amended to remove features in conflict with the current EPA regulatory process, concerns over the threat of lead contamination in the environment may I cause the effort to be renewed in 1989. (Addresses for Representative Sikorski's local and D.C. offices are listed on the next page. ) Since members of Congress are out of session for the November elections, Imake it a priority to contact them while they are in the state. Senator Durenberger also serves on a committee of jurisdiction on this issue: the Senate Environment Committee. It is important to communicate your I concerns to him as well. Pay particular attention to the impact of the proposed increased regulation of lead and pH levels on the local water utility operation and let lawmakers know the potential for cost II increases to the city and for residents who must pay increased rates to cover the costs for new treatment and corrosion control measures that may be imposed if regulations are adopted as originally proposed. I 1 IFor drinking water systems serving less than 500, the new regulations # would require water utility operators to take 10 samples for testing and to submit an annual report on maximum lead and copper contaminants and I pH levels in the first year; in the following years, water utilities serving populations of less than 500 would submit additional reports II every 5 years in order to comply with the new regulations. Cities serving 500-3,300 would be required to obtain 10 samples for testing to . . - . • sam.le - ' - - and submit an annual report the first _ year and then repeat the sampling every 2 years. Cities serving 3,300- ' 10, 000 would be required to sample 20 units each quarter. Cities serving 10, 000 - 100, 000 would have to have 30 samples tested each quarter. Systems serving over 100,000 would require 50 samples per quarter. Testing parameters would also be expanded, significantly Iincreasing the cost of testing. The proposed federal drinking water regulations are designed to I to prevent corrosion of lead and copper plumbing material by water and to remove lead from distributed water. The federal Safe Drinking Water Act requires that final regulations be promulgated no later than June 19, 1989. The proposed NPDWRs require water utility operators II to meet "no action" levels for lead, copper, and pH. If maximum contamination levels (MCL) are not achieved, cities would be required II to install or improve corrosion control treatment (best available technology) , drill new wells or blend water from other sources. Very complex and costly sampling and testing requirements would also add to the cost of local water utility operations. ICurrently, the maximum contamination level (MCL) for lead in drinking water is 0. 050 mg/1; in the future it would be 0.005 mg/1. I Another way of expressing the measure is parts per billion; the current standard is 50 parts per billion (50 ppb) ; the new limit would be set at 10 ppb. II Copper is not considered nearly as toxic; the current MCL for copper is 1. 0 mg/1; the new proposed maximum contamination level is 1. 3 mg/l. The proposed NPDWR rules also require a pH level for drinking water Iof not less than 8. 0. Many water systems and groundwater sources in Minnesota are stable at a pH lower than 8. Water utility operators strongly object to the arbitrary assignment of a specific II minimum pH level and point out that requiring cities to raise the level to 8. 0 will require purchase of costly equipment and chemical treatment supplies and result in scaling and deposits in the II distribution and plumbing system. It is evident that pH should not be included in a criterion since there is no reliable correlation between pH and the leaching of lead from plumbing systems. I The proposed regulations would also require city water utility operators to initiate and carry out sample site selection that is complex, unworkable and costly. The rule would require a first-draw sampling in indvidual residences. At each monitoring point, the city would have to meet the maximum contamination level. If not, combined treatment would be required. The sampling procedures would require utility operators to obtain samples at the ILLD# 77 zpo- 7. ) tap as a "morning first-draw" or another 8-18 hours standing sample. The sampled units would be required to have either new lead solder ' (less than 5 years old) or lead service connections or interior plumbing. National figures on the cost of corrosion control, public education and compliance with maximum contaminant levels indicate that for very small (under 500) drinking water systems, meeting the new MCL requirements would increase rates by $340 per year for single- - 1 family residence service lines. The cost of installing corrosion control treatment measures would increase individual water utility rates by $27 per year. ' Costs for larger systems are somewhat less per ratepayer but are cause for serious concern for city officials who must implement standards mandated by regulations. In many instances, the costs may far outdistance the degree of public benefit derived since lead levels in drinking water had not previously been viewed as a state or local public heath issue requiring costly treatment and corrosion control. Mr. Headla stated that he felt that the curbing for Stratford Ridge was on his northerly property boundary. I immediately set up a meeting with Mr. Ted Kemna of Schoell & Madson and Mr. Headla to try and rectify the situation. From our discussion, it appears that ' Mr. Headla had signed a Quit Claim Deed to adjust his northerly property bound- ary along with the previous owners of what is now the Stratford Ridge property. Mr. Kemna was going to check with the County to see if this was in fact recorded. I I also understand that Mr. Headla is having Schoell & Madson survey his lot to rectify where the property pins are. To date, I have not received information regarding the resolution of this ' problem. Since this directly involves Stratford Ridge, I would ask that either you or Ted Kemna resolve this problem and notify the City with written confir- mation that this problem has been taken care of. ' Those of us living at this intersection are also concerned about safety. We feel that a residential type of lighting, like the lantern at Stellar Court , would be suitable. During September, 29 single family permits were issued for a total valuation of $2 ,941,500 . As of September 30 , 1988 , we have issued 261 single family permits. This compares with 233 single family permits issued through September 30 , 1987. In August the building department took in $36 , 943 in permit reve- nue and in September $39 ,741 was received. Total permit revenue as of September 30, 1988 is $349 ,104 . 1 Fire The Fire Department responded to 36 calls in August and in Sep- tember they responded to 48 calls. Through September 30 , 1988, ' the Fire Department has responded to a total of 294 calls for service. This compares with 330 total calls for service for all of 1987 . I showed a film on bus safety which was followed by a safety talk by "911" and me. I gave the kindergarten classes a program about the police as community help- ers. I also used this program as a way to introduce myself to the kindergar- ten's as the District School Liaison Officer. In this program, the students ' saw a film about policemen as community helpers. I also performed a magic trick for them and each student received a sucker with a saying on the stick which said " I will help Chaska Police Lick Crime". I investigated a sexual abuse report which involved a student at the Chaska Elementary School . The case was referred to Illinois police authorities because that is where the crime occurred. I investigated a report of some inappropriate touch among some Chanhassen Ele- mentary School students. I referred the case to Carver County Social Services for follow-up. ' CHASKA MIDDLE SCHOOL: I received three calls for service from the Chaska Middle School . These included: a locker theft, a middle school student being threatened by other students, and a parent who reported that her son had been drinking at home. All three of these situations were handled within the school . CHASKA HIGH SCHOOL: ' I received seven calls for service from the Chaska High School which included: a harassing phone call report, a theft report, a child abuse report, and three fight/assault reports. The theft case and three assault cases were handled I within the school . The child abuse case was investigated and referred to social services for follow-up. GENERAL INFORMATION: In September, I attended meetings at the Carver County Multi-Disciplinary Child. Abuse Team; District #112 Community Education Advisory Board; District #112 Youth Advisory Board; and the Chaska High School "Welcome to Wednesday", where I presented a short program on the Police/School Liaison Program. I also chaperoned four high school athletic events in September. Attached please find the first draft that Vicki has provided me with. Please recognize that as we work with and molded the new reporting forms , a number of complaints did not get onto these new forms. The violent crimes of murder, forcible rape, robbery, and aggravated assault increased 5 percent as a group while the property crimes of burglary, larceny-theft, and motor vehicle theft increased 1 percent. II During the first quarter of 1988, the increase was 1 percent over the same quarter of 1987. When comparing the second quarters of 1987 and 1988, an increase of 2 percent was reported. Crime Index trends by population groups and by geographic regions appear in Tables 1-3 below. Paragraph 5.10 of the Development Contract for Pleasant Hill provides: ' The Developer shall donate to the City a perpetual ten (10) foot wide easement for a pedestrian trail system along the east line of Lot 5 and the south lines of Lots 3 and 4. Trail construction ' shall be limited to the area directly abutting the property lines of the plat and only deviate as required to save mature trees. The obligation to furnish and install the surfacing and to maintain the system shall be solely that of the City. In no case ' shall the trail be constructed to a width exceeding six (6 ) feet. The City has not received the required easement. You have three ' options: 1 . Contact the present owners and obtain the easements. ' 2. I reviewed and approved the terms of the Development Agreement, part of which Mr. Knutson reproduced in his July 26, 1988 letter to Curt. The ' preparation of the plat, the approval thereof and the drafting and recording of the various documents was handled by him without the benefit of legal counsel and in a spirit of mutual ' cooperation with the City you represent. Your letter is the first notice Curt has had that the City neglected to obtain the trail easement it required in the Development Agreement. Mr. Ostrom is, an -individual who -is organized and responsible and conducts himself in all respects in good faith. He had assumed, and I think rightly so, that the ' documents the City had him execute contained everything the City was requiring in order to approve the subdivision. At no time did the City ever suggest that it was Curt's responsibility to draft and present to the City the trail easement to which you refer. On the contrary, I think it was always understood that whether the City intended to reserve that by separate document, or otherwise, that it would be incumbent upon the attorneys for the City to prepare that document. Obviously, people from the City were negligent in the fulfillment of their duties. MDNR Chapter 105 Water Appropriation Permit - Irrigation of turf areas at Hyland Lake Park Reserve from Hyland Lake: Bloomington ' Lengthy discussion occurred pertaining to the water appropri- ation permit application for the Highland Lake Park Reserve area. The Managers expressed concern and questioned the use ' of groundwaters for irrigation of the lawn area within the park. Mr. Obermeyer reported that the application seeks to use waters from Hyland Lake provided that water levels remain above certain elevations so that water is only to be used for irrigation purposes and that the water levels of Hyland Lake remain above the natural ordinary high. Manager Scribner commented that notwithstanding the fact that the draw down of lake levels should not adversely impact the natural ordinary high water mark for Hyland Lake, she still felt this was a bad use of waters and did not support this appropriation of waters based upon policy decisions . G. #88-63 : Utility Improvements - Lakeland Drive; Grading and land alteration permit: Minnetonka rMr. Bruce Grubb presented the grading and land alteration permit application for this utility improvement in Minnetonka . J. #88-65: Utility Installation - Starring Lake Second Addition; Grading and land alteration permit: Eden Prairie K. #88-66: Utility Installation - Cheyenne Place; Grading and land alteration permit: Eden Prairie L. #88-67: Utility Installation - Bell Oaks Second Addition; ' Grading and land alteration permit: Eden Prairie M. #88-68: Bluestem Fifth Addition - Grading and land alteration permit; site grading: Eden Prairie N. #88-69 : River Point; Grading and land alteration permit - site grading; County Road 18 and Old Shakopee Road: Bloomington Mr. Marc Mogan of James R. Hill, Inc. submitted the grading and land alteration permit application for the River Point development in Bloomington. During the course of consideration ' of this permit application, the Managers inquired of Mr. Mogan whether Mr. Rahr had had an opportunity to review these plans and specifications for grading on this site adjacent to Mr. Rahr's residence in Bloomington. Mr. Mogan noted that Mr. Rahr had reviewed these plans when they were submitted to the Bloomington City Council for review and approval, which ' approval had been given. The Managers also noted that _part of the property covered by the grading and land alteration permit application lies within the Lower Minnesota River Watershed District. Accordingly, the Managers instructed the District ' s ' advisors to submit a copy of the permit for site grading to be issued to the developer to the Lower Minnesota River Watershed District, indicating what formal action was taken by this ' District with regard to this permit application. O. #88-70: Wyndham Nob Second Addition - site grading; Grading and land alteration permit; Townline Road and Chennault Way: Eden Prairie The Managers noted the appearance of Messrs. Don Patten and Marc Mogan on behalf of the developer of this project in Eden Prairie, Minnesota I I Minutes Regular Meeting of October 5, 1988 Page 4 ' P. #88-71: Data Sery Expansion; Grading and land alteration permit - West 78th Street and Prairie Center Drive: Eden Prairie Q. #88-72 : Natural Gas Distribution System - Carver Line Extension; Grading and land alteration permit; Vinehill and T.H. 7 north and east to Tonkawood: Minnetonka Mr. Jim Anderson of Minnegasco, and their counsel, Gary Ganrud were both present to discuss this grading and land alteration permit application. The representatives from the permit ' applicant noted that work had ceased pending receipt of all permit applications. The representatives explained to the Managers that this entire gas distribution system lies both ' within the Minnehaha Creek : Watershed District and this watershed districts and that permits are needed from both districts as well as the various municipalities involved. Mr. ' Obermeyer reported that the project is in general conformance with the policies and criteria of the District and recommended that permits now be issued, notwithstanding the fact that work had initially been commenced prior to securing all necessary permits. In addition to the appearances and comments noted above, Mr. ' Obermeyer submitted his report regarding each permit application. The District 's engineer reported that all of the applications are in conformance with the general policies and criteria of the District. Mr. Obermeyer recommended that permits be issued ' subject to all permit conditions as noted in the District ' s proposed letter permits . Following discussion and based upon the engineer's recommendations and comments as noted above, individual 1 motions were duly made, seconded and unanimously adopted for the issuance of permits for each permit application. The only exception was that Manager Scriber voted not to issue favorable comments to the Minnesota Department of Natural Resources pertaining to the water appropriation permit application by the Hennepin County Park Reserve District. Following these actions, Chairman Fiskness ordered all permits issued to permit applicants ' and comments submitted to the Department of Natural Resources as required by law. Treasurer' s Report The Treasurer submitted his formal reports for September and October, 1988. Following presentation of those reports for the months indicated, it was moved by Cardinal, seconded by Peterson, that the reports as submitted be approved and the bills identified in those reports be authorized for payment . Upon vote the motion carried. Minutes Regular Meeting of October 5, 1988 Page 5 Treasurer Cardinal then commented upon the need to consider ' hiring new accountants to replace the current accountant in the event that time is not available by the present accountants to maintain the books and records of the District. Following ' discussion, the Managers instructed Mr. Cardinal to initiate any necessary interviews to retain the necessary accounting services for the District. ' Basic Water Management Project - Eden Prairie Chain of Lakes Mr. Obermeyer reported that payment for easements acquired by ' the District which had previously been authorized still need to be processed. General discussion followed during which the Managers reaffirmed the payment due and owing to Mr. Earl Seifert. ' Accordingly, the Managers instructed the Treasurer to process that payment by next month. Messrs. Richards and Obermeyer reported on the current status of investigations resulting from the threatened litigation from the general contractor, S.M. Hentges & Sons, in completing the Eden Prairie Chain of Lakes project. Mr. Richards reported that ' background information had been obtained in order to respond to those claims made by the attorney representing the general contractor. Mr. Richards recommended that a meeting be held with the general contractor and its counsel in order to attempt to resolve any differences that might exist between the contractor and the District. Following discussion and based upon the attorney' s recommendation, the Managers instructed Messrs . Richards and Obermeyer to meet with representatives from the general contractor to discuss the disputed items . ' Lake Riley Chain of Lakes - Cooperative Project - Environmental protection Agency and Minnesota Pollution Control Agency ' Mr. Obermeyer reported that he had recently been advised that the Substate Agreement between the watershed district, local municipalities, the Minnesota Pollution Control Agency and the United States Environmental Protection Agency is still being reviewed by the Minnesota Attorney General 's office. The District ' s engineer reported that consideration is being given by the federal agency that this project might not be funded due to �C the lapse of time to finalize the agreements among the various governmental agencies . Messrs. Obermeyer and Richards recommended that the Board of Managers meet with representatives from the federal agency to discuss the status of this project to determine whether or not the project can be funded. The Managers discussed generally the desirability to proceed with this contract in order that this clean water project affecting the cities of Chanhassen and Eden Prairie could still go forward. Chairman Fiskness r Minutes Regular Meeting of October 5, 1988 Page 6 indicated he would participate in that meeting with representatives from the District 's staff and the federal agency to discuss the current status of this project in order to determine how to proceed to initiate the project . Further action on this matter ' was continued until the District 's staff have meet with representatives from the other governmental agencies involved in the funding and Iimplementation of this clean water project. engineer 's Report Mr. Obermeyer reported on approximately 15 projects for which plans and specifications have been submitted to the District for preliminary review and comment. The Managers discussed the ' general criteria applicable for these development projects lying within the District. Following discussion, the Managers instructed Mr. Obermeyer to submit the District 's comments to the developers and affected municipalities in order that formal grading and land alteration permits can be secured by the developers for these various projects . I Mr. Obermeyer reported that one project had been submitted to the District for review for which a grading and land alteration permit is not necessary. This project is an office warehouse development near County Road 1 in Eden Prairie. The Managers instructed Mr. Obermeyer to advise the developer that no permit would be required. Mr. Obememeyer reviewed the current status of various permitted construction sites throughout the District. He noted that many of these sites were completing construction activities for the year and were preparing for the winter shut-down. The Managers requested Mr. Obememeyer to field inspect the Timber Ridge project to ensure that it is in full compliance with permit ' conditions . Mr. Obermeyer noted that he is continuing to discuss the condition of this particular project with the on-site contractor to ensure that the site is brought into full compliance with permit conditions . Purgatory Creek - Floodplain Analysis Study ' Mr. Obememeyer reported that he has completed stage 1 of the floodplain analysis of Purgatory Creek. This reach of the Creek runs principally down to the Edenvale Golf Course from upstream of this particular site in Eden Prairie. General discussion followed during which the Managers were advised that a meeting has been scheduled with representatives from the City of Eden Prairie to review the floodplain analysis completed to date and to update the City regarding the District ' s intended review of the Mitchell Road area in Eden Prairie. The Managers instructed the staff to continue towards completion of this floodplain analysis as quickly as possible. I Minutes Regular Meeting of October 5, 1988 Page 7 Minnesota Association of Watershed Districts - Annual Meeting The Managers noted that the annual meeting of the Minnesota Association of Watershed Districts is upcoming in approximately 2 months. General discussion followed regarding the need to designate delegates to this annual meeting. Chairman Fiskness . requested this matter be placed on the Board's agenda for further 1 consideration in November. District ' s Policies ' The Managers discussed the need to review the procedures for the Managers ' consideration of grading and land alteration ' permits. General discussion centered around the need to provide some type of system whereby permits can possibly be considered in a more timely fashion. Following discussion, the Managers suggested that a special meeting be held in order for the District to review all policies and criteria pertaining to grading and land alteration permits and the methods by which these permits would be reviewed by the Board. ' W- - . v - 1 -v - ; thorized Projects Mr. Richards rep• - representatives from Hennepin County had contacted him to discuss the basis upon which the Managers wished to levy for the basic water management project previously approved by the Managers in response to a petition from the City of Eden Prairie. Mr. Richards commented that such terms as tax capacity and other modifications to the levy authorization granted to special purpose districts, including this watershed 1 district, had modified the procedures by which the Managers could levy money for payment of basic water management projects . General discussion followed during which the Managers noted the desire to maintain a normal increase based upon increased valuations of property lying within the District in order to assess properties for basic water management features benefiting the entire District. Following discussion noting the various valuations of lands from 1987 to 1988, Manager Cardinal offered the following resolution and moved its adoption, which motion was seconded by Manager Peterson: ' WHEREAS, the Board of Managers of the Nine Mile Creek Watershed District have authorized and ordered the undertaking of the Eden Prairie Chain of Lakes Basic Water Management Project, all based upon receipt of petitions, notice and public hearings, all as required by law; and 1 1 1 Minutes Regular Meeting of October 5, 1988 Page 8 WHEREAS, Minnesota Statutes § 112 . 61, Subd. 3 authorizes a levy of a tax in addition to the annual levy for the administrative funds of the District to pay the cost of the basic water management features of improvement projects initiated by ' petition of a municipality; and WHEREAS, the Board of Managers have been advised of the ' variations and modifications of the tax levy authorizations conferred upon the watershed district, including the procedures including tax capacity; and WHEREAS, the Board of Managers are desirous of and intend to authorize a tax levy to collect a sum certain as hereinafter prescribed, regardless of its authority to levy a higher amount based upon mill levy authorisation; and WHEREAS, all notices and hearings as required by law have been given or held; NOW, THEREFORE, BE IT RESOLVED: ' That a mill rate be levied upon all taxable property in the Riley-Purgatory-Bluff Creek Watershed District, Hennepin and Carver Counties, State of Minnesota, for the year 1989, for the purpose of raising the sum of $189, 034 to be used by the managers to pay management features of tice Eden Prairie Chain of Lakes improvement project initiated by the City of Eden Prairie; said annual levy shall be in addition to the annual administrative expense fund levy and said mill levy shall not exceed a rate in excess of one third (1/3) of a mill, regardless of what mill levy authority said Nine Mile ' Creek Watershed District may in fact have. As I stated, Roger Gustafson, Carver County engineer, Jcinn Olson, Assistant Chanhassen City Planner, and I reached an agreement whereby there would be a right-turn-in/right-turn-out. Therefore, if the County is taking a negative position on this matter at the present time, as the City of Chanhassen claims, we cannot say that their position has been consistent. (612) 937-1900 November 10, 1988 Mrs. Ginger Gross 2703 Ches Mar Farm Road Excelsior, MN 55331 Dear Mrs. Gross: In speaking with you today, it appeared that you felt that ' complete information is not being presented to the Planning Commission and City Council concerning the Ches Mar Farm PUD. You stated that you have been in contact with certain Planning Commissioners and City Council members to present information you have about the Ches Mar Farm PUD. You also stated that you were not notified of when the Planning Commission reviewed the Ches Mar Farm PUD proposal presented by Brad Johnson. The Planning Commission, this past fall-1988, did review a sketch plan proposal for the subdivision of the Ches Mar Farm PUD pre- sented by Brad Johnson. Since this was a sketch plan, it was not required to have a public hearing, therefore, property owners were not notified. The sketch plan review was for the Planning Commission to review the item to determine whether or not the applicant should go forward with the preliminary plat at which time formal recommendations would be made and the public would have the opportunity to have input on the proposal. tI met with you also in October, 1988, where you had presented some facts about what had been happening with the Ches Mar Farm property, stating that proposals had been made to purchase some ' of the lots and that these proposals had been refused and in turn certain people were saying that they were unable to sell the pro- perty and needed to pursue other options with the property. At that time, I stated that we had not heard of this information and that this should be presented to the Planning Commission and City Council. I asked you to put your comments in writing which could be included in the planning report. As of this date, I have not received such a letter. After today' s phone conversation, it is my understanding that you still feel that this information is not being presented to the proper parties. Again, I would request 1 that you submit your comments in writing in the form of a letter to my attention.
