BOX 147 • CHANHASSEN, MINNESOTA 55317 (612) 937-1900 ' MEMORANDUM i TO: Mayor and City Council FROM: Don Ashworth, City Manager iDATE: December 12, 1988 SUBJ: Joint Powers Agreement, Southwest Communities Coalition The attached contract between Carver County City and the Cit of Chanhassen is similar to that entered into for 1988 . A new ' contract is needed for 1989 . I believe the contract is self- explanatory, i .e. communities in the southwest area have banded together to employ Mr. Boland to lobby in our behalf . The pri- mary work has been in the area of the Metropolitan Council' s Development Framework Plan. Chanhassen acts as the lead agency in that we direct the work of Mr. Boland and seek reimbursement i of member cities for such billed work. The joint powers agreement formalizes the process with Carver County in that it recognizes that Carver County must reimburse Chanhassen for the work we bill them for. Most of the other jurisdictions within i the southwest area do not require the same level of formalization and most are bound solely on the basis of a letter from the chief administrative officer stating their intent to belong and to pay icosts. Approval of the attached joint powers agreement for the Southwest Communities Coalition lobbying efforts is recommended. CLJ 1 " 11 JOINT POWERS AGREEMENT - SOUTHWEST COMMUNITIES COALITION LOBBYING ' CARVER COUNTY & CITY OF CHANHASSEN THIS AGREEMENT is made and entered into by the County of Carver, hereinafter i referred to as "the County" , through its Board of Commissioners and the City of Chanhassen, hereinafter referred to as the City" , through its City Council . WHEREAS, The Metropolitan Council has adopted of a new Development and Investment Framework for the Metropolitan Area, and will be adopting new Transportation, Sewer, and other Plans; and, 1 WHEREAS, a number of southwest suburban communities are of the opinion that the Framework and the proposed changes in other Metropolitan Plan could be detrimental to the future of the area; and, WHEREAS, a qualified lobbyist wou l d be useful to the parties to effect changes in the proposed Plans; and, ' WHEREAS, MS 471.59 provides for the joint exercise of powers by units of government; and, NOW THEREFORE, IT IS AGREED in consideration of the mutual covenants and promises herein, the parties agree as follows: 1. The purpose of the contract is to provide for the employment of a lobbyist to represent the parties before the Metro Council regarding the Metropolitan Develop- ment and Investment Framework and related plans. 1 2. The City of Chanhassen shall act as the lead agency in that the City will enter into all contractual arrangements and perform all administrative activities relating to the employment of a lobbyist. 3. The City shall be the sole contractor with the lobbyist for the purposes of lob- bying regarding the MDIF and shall perform all administrative functions relating to the employment of the lobbyist. The city shall indemnify and hold the County harm- less from any and all claims arising from the employment of the lobbyist. 4. The City shall bill the County on the same schedule as the City is billed by the lobbyist. The amount billed shall be based on the pro rata assignable to the County based on the total amount submitted by the participating jurisdictions. The County shall remit funds to the City in amounts not to exceed a total of $2000. The County shall make payment within 30 days of the receipt of a bill . 5. The City shall maintain such records as required by statute regarding the pay- ment of the lobbyist. The City shall make such records available for review by the County should the County desire to do so. I I L II Page 2 Joint powers-SWCC Lobbying 6.
